In the absence of any express written agreement governing your tenancy, you are a yearly tenant and you are entitled to statutory notice of 6 months notice. Any notice short of that is not valide....so the notice served on you i void ad initio ....

The appeal does not amount to stay of execution, more so the matter is not within the jurisdiction of state high court.

This is very wrong, the right application is to stay the execution of the judgment of the FHC, and this can only be done at the FHC or court of appeal if appeal have been entered already.
