magoo10:Dear sir, it was just the decision on an interlocutory motion for stay of execution by the Appellant (GTBank ). The final appeal is yet to be canvassed. And also the money being referred to here is not to be paid to INNOSON directly but to the court which will hold it as a trustee pending the determination of the final appeal. In other words, if Gtbank wins at the Supreme Court, the money goes back to them and if INNOSON wins, it goes to him. It's actually a time worn principle of law that when a money judgment is given, the judgment debtor must pay or show ability to pay off the judgment debt before audience is even given to him for his appeal to be heard so as not to deprive the judgment creditor of the fruits of the judgment. I hope this short write up puts paid to the rather erroneous headline. Thanks. |
I have been following comments on this thread since morning and I laugh. How anyone thinks that Fayose's candidate will win in the forthcoming elections beats me hollow. Assuming without conceding that JKF is not popular in the state, has anyone not read his body language and see that he is desperate to return to that seat, and there's nothing more dangerous than a desperate man. Considering that the party Fayose belongs to does not control the Police and Armed Forces anymore, I predict that JKF is about to deal Fayose a bitter dose of his own medicine come this elections and with Fayemi having gathered a great financial war chest from his stint as minister , aligned with the determination of some young turks in the South West APC to defenestrate Asiwaju Tinubu (see what happened in Ondo State as a reference for my point). I hate to be the bearer of bad news but welcome Governor JKF back to Ekiti State come the next election. I'm not a fan of either men but this is just my unbiased opinion from reading the tealeaves. |

When people want to mislead the unsuspecting public for their selfish gains, they peddle all manners of falsehood. An order of interim injunction is an ex-parte application(i.e only the party seeking it is in court, the other party(ies) is/are not in court) and it has a lifespan of seven days and is renewable for another seven days. So seeing that this order was given last year, it is my opinion that the order has elapsed despite no appeal against it as the period for it has long since elapsed. Please the Ekiti State government should stop giving a dog a bad name in order to hang it. They should do the needful legally and stop peddling deliberately misleading information. N.B: I am not an APC or PDP member, I just felt I should contribute my own two cents to the ongoing debate. Thanks |
