Using the former Governor of Kogi State, Alhaji Yahaya Bello as a case study to illustrate the consequences of the Economic and Financial Crimes Commission (*EFCC*) not respecting court orders in Nigeria: *Undermining Rule of Law*: Alhaji Yahaya Bello's case serves to highlight how disregarding court orders weakens the rule of law. It sets a precedent that undermines the authority of the judiciary and erodes public confidence in the legal system. *Violation of Rights*: Failure to respect court orders in Alhaji Yahaya Bello's case can lead to the violation of his rights, particularly his right to a fair trial and due process. This violation undermines the fundamental principles of justice and fairness. *Legal Backlash:* Alhaji Yahaya Bello's situation may trigger legal challenges and increased scrutiny from human rights organizations. This scrutiny could lead to legal actions against the EFCC for its failure to comply with court orders. *Loss of Public Trust*: When the *EFCC fails to comply with court orders in cases involving public figures like Alhaji Yahaya Bello, it damages public trust in the agency and the entire justice system. This loss of trust hinders cooperation with law enforcement efforts and undermines the effectiveness of the EFCC's mandate. *Political Fallout*: Non-compliance with court orders in Alhaji Yahaya Bello's case can lead to political controversy and public outcry. It tarnishes the reputation of the EFCC and the government, especially if perceived as politically motivated. This fallout can have far-reaching implications for governance and public perception of accountability. To conclude, the *EFCC's failure* to respect court orders in cases like that of Alhaji Yahaya Bello *undermines the principles of justice, democracy, and the rule of law* in Nigeria, with significant ramifications for the country's legal system and society as a whole.

Nigerians have always been sentimental about issues concerning Politically Exposed Persons and it is understandable. I still remember what many Nigerians said about Col. Sambo Dasuki (rtd) then. What has happened to Dasuki and all the Arms Money they claimed he stole? Has anyone been convicted on the basis of the basis of what was termed then as Dasuki Gate? Even Dasuki that they claimed had weapons “capable of disrupting the peace of any city in Nigeria for a while” is in his house now, enjoying life. I remember what many Nigerians said about Ayo Fayose then too. Some people even said that Fayose would go to jail the moment he was out of power as Ekiti Governor. While still in office as governor, the Economic and Financial Crimes Commission (EFCC) operatives were everywhere, invading properties perceived as his. A petrol station in Akute, Ogun State was shut down by EFCC operatives. The news was that Fayose owned the petrol station, but a few days after shutting down the petrol station, it was reopened by the same EFCC operatives having found out that they acted wrongly. Many buildings in Ekiti were marked with the usual EFCC INVESTIGATION KEEP OFF! The marks were latter to be cleaned when they realized that Fayose did not own the houses. Then, when Fayose said he will report at the EFCC office in Abuja at 1pm on October 16, 2018, many Nigerians said he was only using that as a decoy to run away from Nigeria. But as he promised, Fayose reported at the EFCC office in Abuja, wearing a T-shirt with inscription, “EFCC I’M HERE.” Today is April 19, 2024, Fayose’s trial which started on October 22, 2018, is still on, close to SIX YEARS after it started. Early last year, EFCC bragged about how the then Zamfara State Governor, Bello Mohammed Matawalle will be arrested and prosecuted after his tenure for alleged N70 billion fraud. Today, Bello Matawalle is a serving Minister. He is in charge of defence! Also, in June last year, the Federal High Court, Abuja, restrained the EFCC and Independent Corrupt Practices and other related offences Commission (ICPC) from detaining former Governor of Zamfara State, Senator Abdulaziz Yari. Up till today, EFCC has not invaded the residences of Matawalle and Yari to arrest them. They have not been declared wanted and placed on the watchlist either. It is about Yahaya Bello, immediate past governor of Kogi State. As usual, EFCC is presenting Yahaya Bello as one who is running from investigation and prosecution. His residence has been invaded. He has been declared wanted. He has been placed on WATCHLIST. But in all these EFCC usual dramas, the public has not been told whether or not, Yahaya Bello was at any time INVITED by the EFCC. Methinks EFCC should oblige Nigerians with its Invitation Letter to Yahaya Bello with the date it was received and who received it. Furthermore, on March 14, 2024, EFCC charged Yahaya Bello before Justice James Omotosho of the Federal High Court, Maitama, Abuja for alleged N84 billion money laundering offences, alongside his nephew Ali Bello, Dauda Sulaiman and Abdulsalam Hudu. Now, the question is, if someone has been charged to court, of what essence is the arrest and interrogation? When charges are filed by the investigating authorities against and accused person and such person is arraigned in court, it presumes the conclusion of investigations, meaning that such an accused only has business with the court, not the investigating authority any longer. Therefore, in the case of Yahaya Bello, he only needs to appear in court on the next adjustment date or when he is served with the court processes. Meanwhile, there is a court order barring arrest and prosecution of Yahaya Bello, and EFCC is at the Court of Appeal, challenging the order. So why not wait for the Appeal Court to determine the appeal? Also, a Federal High Court, Abuja, is scheduled to rule on the application by EFCC, seeking a substituted service of the charge on Yahayo Bello, on April 23, 2024. Justice Emeka Nwite fixed the date after counsel for the EFCC, Kemi Pinheiro (SAN), and the ex-governor’s lawyer, Abdulwahab Mohammed (SAN), presented their arguments for and against the oral application. Mohammed, who announced appearance for Yahaya Bello, challenged the validity of the charge on the ground that the court lacked jurisdiction to entertain the matter on the one hand and to have issued the arrest warrant against his client on the other hand. He informed the court that a preliminary objection had already been filed before the court, to the effect. The lawyer urged the court to vacate the arrest warrant order, and pointed out that a High Court in Kogi State had on February 9, 2024, restrained the anti-graft agency from arresting, detaining or prosecuting the former governor. He said the ruling was on a fundamental rights suit filed by the Yahaya Bello, and that the EFCC was a party in the matter. So, why should the EFCC declare someone it is already prosecuting in court wanted? Isn’t it the duty of the court to issue warrant of arrest against an accused it is trying? Methinks once an accused is charged to court, the prosecutor no longer have any right on him or her. In this case, having charged Yahaya Bello to court and his lawyers were in court to represent him, should the EFCC still declare him wanted? Isn’t that the duty of the court? Is it right for an agency of government to act in a way to suggests that it is overreaching the court? The court adjourned till Tuesday, April 23, 2024, to rule on EFCC’s application for substituted service on Yahaya Bello, why should EFCC act like it was seeking self-help? These are questions lovers of democracy and the rule of law should ask, not falling for the usual drama of the EFCC, which in most cases has led to shoddy prosecution of cases. Let me say this again, I am in support of the investigation and trial of anyone for corruption in this country. After all, when the police in Ekiti State invited me for alleged stealing of N13 million while serving as head of the State Broadcasting Service, I reported at the Police Headquarters in Ado Ekiti almost immediately. I was charged to court and granted bail, and I was going from Abuja to Ado Ekiti to attend court from March 2020 till May 2022 that the case was dismissed for lack of prosecution. For more than three years that I was going to court, the Ekiti State Government that took me to court for corruption did not show up. They simply abandoned the case and left me to waste my time and resources coming to court. After the usual drama of the EFCC, the same situation I faced for more than three years is what many Nigerians being prosecuted by the the commission are facing. In some cases, it will be the EFCC that will raise issues about the integrity of judges, causing transfer of cases to other judges and the matters starting afresh. Like I have maintained, corruption cases are not prosecuted and won by public drama as being done by the EFCC. They are won through diligent investigation and prosecution, ICPC has been more successful in prosecuting corruption cases than the EFCC. I hope that soon, Nigerians will begin to ask questions as to why ICPC does not make noise, but has achieved more conviction in corruption cases than EFCC, the Aláríwo (Noisemaker) of Nigeria. It is Yahaya Bello today, tomorrow, who knows whether it will be you or someone very close to you. Reason EFCC must be told to stop being dramatic and do its jobs by the laws of the country. I am still Lere Olayinka. I am here with the Irunmales of Oke Agbonna in Okemesi Ekiti, doing Night Vigil. Source: https://www.vanguardngr.com/2024/04/efcc-and-the-brigandage-that-wont-stop/

In the ongoing discourse surrounding the state of the Ajaokuta Steel Company, a Civil Society Organization (CSO), Integrity Watch, has entered the fray, taking aim at the former deputy governor of Kogi State, Hon. Simon Achuba, and his recent assertions regarding the management of the steel industry. In a statement issued by Integrity Watch's Director General, Prince Daniel Maman Musa, the organization expressed disdain over Achuba's appearance on Arise Tv, labeling it as "shameful" and questioning his moral standing to accuse former Governor Yahaya Bello of hindering Ajaokuta's development. Achuba, in his interview, accused Bello of thwarting efforts to revive Ajaokuta Steel, alleging personal interests in the company's operations. He cited instances of bureaucratic interference and alleged mismanagement under Bello's administration, fueling the controversy surrounding the steel industry's stagnation. The Senate's recent formation of a 10-member ad hoc committee to investigate Ajaokuta's decline further underscores the gravity of the situation. Senator Natasha Akpoti-Uduaghan's motion, identifying political will and bureaucratic corruption as contributing factors, aligns with Achuba's lmfao claims, adding weight to the calls for transparency and accountability. However, Integrity Watch rebukes Achuba's accusations against Bello, asserting that the Ajaokuta Steel issue transcends the state government's jurisdiction. They highlight historical setbacks dating back to 1983 when Muhammadu Buhari halted the project, emphasizing its exclusive federal mandate, how can Governor Bello who became Governor of Kogi State on 27th January 2016 be responsible for Ajaokuta crisis of Ajaokuta which dated far back 1983 about 41 years ago, when Bello was barely 7 Years old? The Host of the Arise TV Programme Dr. Abati Exposed Achuba's Floors by asking Questions on how he ridiculously accuse Bello of the Challenges surrounding Ajaokuta steel Development? Moreover, Integrity Watch challenges Achuba's credibility, citing a purported history of corruption and misconduct during his tenure in various positions. They allege Achuba's dismissal from previous roles, including his service as former Deputy Speaker with the state assembly and as Director General in Ministry of Environment under former Governor Idris Wada's administration where he was said to be found diverting government funds by issuing his personal receipt to collect funds that belongs to Kogi State Government and sacked for Gross misconduct and embezzlement, as well as his time as deputy governor where he was also sacked for abuse of office, fraud and gross incompetence. In a scathing critique, Integrity Watch portrays Achuba as an unreliable figure, prone to political opportunism evidenced by his frequent party affiliations. They argue that such instability undermines his moral authority to implicate Bello in corruption allegations. Contrary to Achuba's claims, Integrity Watch defends Bello's administration, touting its transparency and accountability in managing state funds. They cite numerous awards received by Bello for dood governance, excellent service delivery, challenging Achuba's narrative of malfeasance within the government. The CSO urged Nigerians to ignore Achuba and "focus more on how the supposed largest steel plant in Africa will become fully operational to improve the economy of the country and reduce unemployment the nation."

The Honorable Minister of Women Affairs, Barr Uju Kennedy Ohanenye has pledged her Ministry’s plans to provide full rehabilitation for the 4 rescued girls from the Al-Kadriyar family after two weeks in the kidnappers’ den. Making this declaration during a visit to the rescued girls at a facility where they are undergoing medical treatment, Barr Uju stated that it is very unfortunate for the girls to pass through such a harrowing experience and pledged that her Ministry has initiated full rehabilitation plans to re-integrate the girls into the society “ the Ministry will closely monitor their recovery and will be there for them immediately they leave this facility and commence full rehabilitation which includes engagement of a psychologist due to the trauma they must been through during the period in the kidnappers’ custody” Speaking further, she added that the Ministry will liaise with the management of the National Youth Service Scheme (NYSC) to ensure that one of the girls will undertake her one year national service with the Ministry of Women Affairs and also solicited for the girls to be moved from their present schools to another safer environment which will not subject them to any form of vulnerability. She also commended the Chief of Army Staff and the Inspector-General of Police for working with credible intelligence and coordinated collaboration among the security agencies which led to the release of the girls last weekend, She expressed the concern of President Ahmed Tinubu over incessant cases of kidnapping in all parts of the country especially within the FCT “Mr. President, Bola Ahmed Tinubu is deeply worried about this trend of kidnapping and is working assiduously towards addressing the situation. After this visit, I will update the President and First Lady about the condition of these girls” she added Also speaking, the father of the girls, Mr. Al-Kadriyar Monsoor thanked the Minister for her visit which has livened up the girls and also thanked security agencies for their efforts which resulted to their release. He however urged the Federal Government to ensure that a stronger synergy exists among the various security agencies as part of measures to improve the nation’s security architecture. While recalling the strategic nature of Bwari Local Government Area, he also harped on the need for robust machinery to put in place at the grassroots through coordinated community-based intelligence sharing to make the work easier for security agencies “Bwari is bordered by 4 states, Plateau, Niger, Nasarawa and Kaduna and this makes the area porous to any form of invasion, government should improve on community-based intelligence and communication to make lives safer at the grass root level of our country” The Minister also presented food beverages, soap, noodles and sanitary items to the girls as part of her Ministry’s preparatory plans towards their rehabilitation after leaving the facility. It will be recalled various sections of the media earlier reported that the girls were abducted alongside their father within their resident at the Zuma 1 area of Bwari Area Council on 2nd January, 2024. Their father was later released to enable him source for ransom. However, the failure of the family to meet their demand within a deadline issued by the kidnappers led to the killing of one of them, Nabeeha. After the young school girl was killed by her abductors, the bandits raised the ransom from N60 million to N100 million with a threat to kill all the sisters. According to Police sources, they were rescued by the FCT Anti-Kidnapping squad in a concerted effort with troops of the Nigerian Army around the Kajuru forest in Kaduna state on Saturday last week.
