Travel / US Visa Refusal Under 214(B) by Paaigba(m): 2:15pm On May 24, 2021
Hello VO,
I was refused a B1/B2 visa on 21-May under 214(B) and I want your candid advise on what I did wrongly.

At the invitation of the VO, I approached the window as she says;
VO: Hello, added my name
Me: Hi, and how are you doing today
VO: Fine, where are you travelling to?
Me: I'm travelling to see Florida to see my wife.
VO: What does your wife do in Florida?
Me: My wife is a student and an F1 visa holder
VO: What school does your wife attend in Boca?

At this time, I had a sense that she was also see my wife's profile, because see mentioned the city where my wife school is.

Me: She attends XYZ university in Boca Raton
VO: What course does she study?

So, my wife got into in Dec 2017 to start a program on MBA which started on January 2018. During her courses registration, her department allowed her to register only one major (4-unit course) in the spring semester of 2018 and the rest courses were GMATs. And as a foreign student, she is mandated to take at least 12-unit courses to qualify for health insurance registration. With just 4-unit course and the weightless number of GMATs course, the health insurance companies approved by the school couldn't accept her. It became a bigger problem when she couldn't be allowed to register for the Florida drivers' license for the same health insurance issues. This semester was already half-way and the University kept reminding my wife that they were still waiting for her to submit her health insurance. It became very frustrating that my wife had to schedule a meeting with her course adviser for a way forward. During the conversation, the adviser offered to my wife that she can change her course, under the prevailing circumstance and continue her education. My wife changed to Nursing, despite having first degree in Accounting, because she had a passion for care.

Me: I recounted the above story.
VO: Which means your wife didn't register in the school since she couldn't surmount the Health Insurance problem
Me: No she registered. I'm not sure you understood me clearly, let me go over it once more, because I paid a whooping $10,750 for this GMATs program.
VO: she nodded in acceptance that I should recall the story
Me: I recounted again
VO: And she's with the kids
Me: Yes, Because I do offshore work, we agreed that the kids will go with her. Moreso, the kid's are US passport holders
VO: Why did you not apply for an F-2 Visa

Me: At the time my wife was issued with an F-1 visa, we both had a B1/B2 visas that was issued about 4months earlier. And as her sponsor, I live and work here in Nigeria and I have a great job here in Nigeria that is paying her bills (apart from the school fees which ranged between 4k$ -6k$ per semester, I spent $18k yearly on rental and 12k$ on feeding, and an unquantified amount on children afterschool care, utilities bills and car services). Secondly, my understanding about F-2 visa is that I will most likely go stay with my wife in the US as a dependent which I don't want to do because I have a fascinating job here that I enjoy doing and the job pays well, in order words, I didn't apply for the F-2, so I don't create the impression that I would leave my job and travel with my wife. And finally, I do not think that I can do official trips with an F-2 visa as I do travel for my company Factory acceptance test (FAT) as an when due.

VO: You spent 19weeks during your last visit

Me: You're right Madam and it was not deliberate. I couldn't travel the whole of 2020 because of the pandemic (VO nodded). So once the lockdown was eased, I was able to book a flight and travelled in late October 2020. And just within three weeks of my stay, I received a memo from my office that the offices will be closed because of the Second wave of the pandemic and stated further that we're expected to stay at home and work from home until further notice. So this 19weeks is a one-off, though still within the 6months that homeland allowed me to stay in the US at the point of entry. Then I buttressed further, that she can look back at my 13years of travel history to the US, I have never flouted immigration laws and that the maximum I had stayed is 6weeks and typically, my trips are between 3-4weeks, until this last trip

VO: Nodded, and never asked for any evidence of funds and kept typing on her computers and threw my passport back at me with a green leaflet (refusal under 214(B) letter) inside and said, this time around, I will refuse you the visa

Me: Does it means I can't see my wife
VO: Read the letter under your passport.

The interview was over.

Now, I can't abandon my family in the US because of this setback, which mean I would have to reapply. And I need your candid guidance on how to navigate my next interview and I also need to know what went wrong? My wife just finished her Nursing program this 20th May, just a day before my interview. But I still classified her as a student at the time of the interview, despite the fact that she has finished a day earlier and have also applied for OPT in more than a month ago which is yet to be approved. Is my refusal because of any or all of the following?

1) Stating that my wife was still a student, yet she has applied for OPT?
2) Was it because I spent 19weeks in my last visit? I expected that everyone was aware of the devastation caused all around the world by the pandemic.
3) Is it that I applied for the wrong visa class?

We truly live in an unpredictable world. With people ruining others peoples life for selfish gains. Definitely, if late Ogo was to be faced with current realities, going to this level of shamelessness (media publication) would not have been an option. I honestly believe that if the rules of the game had been followed strictly as prescribed, Ogo won’t have died. Even in the morgue were she is, she would still not negotiate this senseless and shameless act of unwarranted grievances were her opinion sought. Unfortunately, the dead can’t talk. But I strongly believe that she made her mark in the short time she lived and I trust God for His favour and Mercy upon her as she rests in His bosom. The couple in questions

Wonderful write up it is! But it's unheard that the dead wrote. The writer aim is to tell a story of a woman who labored and died to express her unappreciated love to her husband or a caution for women to not love their husbands, It is unfortunate that the writer had been able to capture the hearts of the audience to the extend where they had dished all manner of causes and comments on the late woman's hubby (Kevin). Possibly already achieving his/her aims; I would use this opportunity to caution our commentators to always show restraint till the full story is heard. First, I do not intend to join issues with the writer but I want to state that the story is lopsided. You might agree to some extent that every marriage have their expectation. If a couple who were married in 12yrs with 2 kids still leaves together, it means they had been able to surmount their challenges. This is while I would also advise our women. Don't ever think you are an island in the midst of your in-laws, it doesn't matter how beautiful you are. We are still in Africa were women are expected to marry men as well as members of the man's entire family and show them respect. For me, this is the easiest way to get aligned with the family. But when pride and possessiveness cause you to disrespect your in-laws, then you are bound to face problem. The writer of this story is very selfish, perhaps the late Ogo confided in the writer while she was alive. Possibly too, the late Ogo never also told the writer the many times Kevin sold landed properties to pay hospital bills, the many times a laboring husband came back home from work to fall on empty stomach without food at home or the number of year late Ogo had spent in the US of the 12yrs of marriage while attending to her health issues. As I mentioned before, every marriages have their expectations. If your expectation is to have children and they are not forthcoming, there is bound to be issues. If a woman who never showed signs of sickness prior to marriage suddenly started falling heal barely 12days after marriage, there is bound to be problem, perhaps she hid the sickness from her hubby before marriage, alot comes to the bare. While I share pains with Kevin for having to experience this sad phase of his marital life undermining hitherto the so much that he had spent to salvage the life of his lovely wife, for making several sacrifices to get the marriage going, close confidants such as the writer of this story is desperately trying to make sure more pains are inflicted. It’s shameful and most pitiable. I could only say this much because I knew this couple. For God sake which marriage is a bed of roses? None!

Please Mr/Mrs writer whatever you are stop this calumny. We don't know you but from your right up we suspect who you are. In retrospect, Late Ogo had done 7 surgeries in the 12yrs of marriage. The last was when she had the second baby during which she temporarily passed out. At recovery, she was warned never to have the 8th or any more surgeries in her life time as her ailment would henceforth be therapeutically managed. All of this fell on deaf ears because people such as the writer were envious of late Ogo and unfortunately, Ogo didn't live long enough to see it. Having just being referred to a specialist in Lagos, and agreed with her husband on the "No surgery Rules" she arrived the hospital and decided with one of her sisters, which I strongly suspected is the writer of this story to go for a surgery. As you all know, till today when a patient goes for surgery a guarantor is expected to sign on her behalf. Typically for married women, their husband. While Kevin was still at work and persistently invoking the "No surgery rule" late Ogo's sister signed for her to carry on with the procedure/surgery. Which was a grievous disrespect for Kevin. And the woman died!! If anyone is to be blamed, it is whoever signed against the "No surgery rule".....she signed Ogo's death warrant. Now, going to the internet to tell a story in order to mope up sympathy or perhaps exonerate self is uncalled for and would not solve anything, would only aggravate this problem. As an advocate of peace, I think the emphasis going forward is to ensure that late Ogo's legacy and dream for her children is met.

What is the Charge rates per sq meter of this area? I have an undeveloped property stretched across almost 1380sqm and my agent has collected so much from me to get the C/O for the plot without delivery.

This days, he gets upset whenever he sees my phone number on his phone. Pls I would appreciate this help.

Yet again Nigerian Police has been grossly indicted, this time with Racial killings with most of this events uninvestigated, and when it is, report are not publicized clearly indicative of poor Nigeria Human rights record in this democratic era. With this poor records, it is expected that the Police could be cheaply indicted by Amnesty international.

For all I care, Amnesty international is a humanitarian organization and oversees contemporary world events which has to do with Human rights abuses, corruption, etc diseases and hunger in rare cases. They are not being influenced by nations, organizations or individual. Then, why would they write this about Nigeerian Police?

It is very sad that in our 10 years of democracy, our Police is not leaving up to expectation of the structure instituting it. I have had a personal experience where a Policeman pulled a trigger at an Okada rider just because the rider refused him of 20 Naira. It is really shameful. If the Okada rider had been killed, they will report killing at the seen of a robbery on the struggling Okada man who is simply trying to make a leaving.

We have corrupt police everywhere in the world but I think how's should strive after Police force that have succeeded. What business does the Police have standing on the highway collecting money, yet apprehending those accused of corruption. Is Collection of 20-100 Naira on the highway lesser corruption? The answer is NO

The Police PRO went on air to dissociate themselves from the claim. It makes it more worrisome whereas the Police would have gone back to the drawing board and re-strategies. Its a shame. NPF please "WAKE UP"
