A close relative was in a similar situation last year. She started her course in September 21 and got a sponsorship job 3 months later. Her sponsor knew she was on a student visa, still new in the country but didn’t see it as a problem. I recall she queried about the 3 month timeline in the UKVI guideline but her sponsor clarified that it wouldn’t affect her application.

She got her COS, applied and was granted a 5 year Tier 2 visa in February. She is now working full time, still studying albeit on a different visa category. Judging from her outcome, I’ll say it’s possible to switch while you’re a student as long as you meet the requirements.

Be aware that no one here can tell you what your outcome will be as every case differ. I’ll advise that you speak to your sponsor about your concerns. This is what my relative did and her employer was more than happy to assist her throughout the process.

Good evening gurus, if as a student in the UK and your program hasn't ended and you get an employer who is willing to give sponsorship to switch to tier 2 , can the student accept? Are their implications?

The rules are if no placement is gotten, it automatically reduces to a year for you to then start your project. So I see no reason why it can't be .. . Just email your respective schools that you now prefer to start project immediately and no longer interested in placements and see what they say

Just the same way some students ask for placements and get additional 1 year

That was why I advised the person can start part time 20hrs and switch towards the end of masters so that employment link is not lost.Alot of companies say no problems but don't know the rules or how to go about it.

COS provided, and he doesn't want to abandon his studies, though we advised him to write to the school for part time studies. Waiting for school reply.

Your masters is barely 6months if I am correct.

With skilled workers visa you need to have 3months left to conclude your masters before you can apply.
The HR in the company knows exactly what the criteria is/are, it is also a point based systems on their part with them issuing a COS.

You may start working with the company on a part time basis of 20hrs per week and hopefully switch when it is time

Pls don't get angry, the said person said this to the employer who wishes to give tier 2 that he start date was January and the course 2years and they said no problem.

However, just to chip in, the UK Gov explicitly allows you. Also, most universities clarifies this.

What you can and cannot do
With a Skilled Worker visa you can:
- work in an eligible job
- study
- ... ...

Overview from Gov.uk
A Skilled Worker visa allows you to come to or stay in the UK to do an eligible job with an approved employer.
This visa has replaced the Tier 2 (General) work visa.

KCL (Kings College) emphasise that you “must intend to work”. Invariably, working becomes primary and study secondary! Ditto, the reverse

USW (South Wales) goes further to put beyond doubt
If you are in the UK in a work related immigration category..., you may undertake study that fits around your work. There is no condition which prohibits study. Therefore you are free to undertake part time or full time study whilst you are working. You should however be mindful of the following issues:
Work/study balance ... ...
Length of the course and visa expiration date ...
Leaving and re-entering the UK ...
What do you intend to do afterwards? ...


Kindly note that a number of UK universities have not updated their websites: Tier 2, Tier 4, Tier 5!!

There is a way you ask tactically.
For example during interviews state that you will need a sponsorship certificate as you are in Africa. Or when they are slating you for interview you can reply the interview mail saying you are from nigeria and is the timing UK time or African time. Sha use brain dey tell them but during your interview state clearly when they ask you if you have questions that you will be needing COs if you pass

That depends on your status at the moment. Are you on a student's visa, dependant visa or any visa that gives you right to work? If no, select no.

If you're from outside the UK, you don't have right to work if you don't have the right visa

Funny I know someone and I hope the person shares his story

He was recently denied PSW he worked above 20hrs when he first arrived and tried to stick to 20hrs towards the end thinking it is safe.

Man's already thinking of going back to reapply for another masters.I asked him to share his story here so people can learn. I hope he does

Rules are rules for a purpose,online and offline. These people can get any record they want.
Pls during holidays can one work more than 20hrs? And what about those working under NHS are they exempted in this 20hrs rules?
