The Dean of Law Faculty, University of Calabar, Cross River State, Professor Cyril Ndifon that was accused of raping a law student in the faculty, Sinemobong Ekong Nkang and subsequently suspended has been exonerated from the alleged offence by police investigation. According to a Police Investigation report obtained by THISDAY, and signed by Assistant Superintendent of Police Babatunde Lasisi, 2i/c Force Gender Unit, Force Headquarters, Abuja, three findings were made before recommendation that none of which indicted Ndifon. They after a painstaking investigation discovered that, “from the totality of evidence adduced by the parties and witnesses, the following were deduced: they are · That the evidences of the complainant in this case are incoherent and partly disjointed · That there is no material evidence to corroborate the testimonies of the complainant and build this offence of rape around the suspect sufficiently; and · That penetration which is the crux of the offence of rape was not revealed by the medical evidence “In the light of the above, therefore, it is important to restate that in decided authorities, important and essential ingredient of the offence of rape is penetration. Sexual intercourse is deemed complete upon proof of penetration of the penis into the vagina. This is presently absent looking at the medical evidence of examination of the complainant. “On the other hand, it is a trite in law that for the prosecutor to succeed in a case of rape, the testimony of the complainant requires to be corroborated as a matter of practice. However, ‘corroborative evidence is no more than evidence tending to confirm, support and strengthen other evidence sought to be corroborated. In considering whether evidence is corroborative or not , the court must take the evidence as a whole and not piece by piece and suspicion cannot give such evidence the quality of corroboration, see Ahmed vs Nigeria Army (2011) 1 NWLR (Pt 1227) p.112. There is also no such corroboration to strengthen the evidence in the instant case . “Having highlighted all these, it is humbly submitted that the case file be duplicated and forwarded to the Force Legal Department for legal scrutiny and advise”. Part of the 30 point findings in the investigation showed that Nkang was allegedly incoherent while she could not corroborate facts in statement she made at different times on the case. Also, those who examined her and took her statement noted that she was too calm immediately after the reported incident to have undergone such harassment and that shortly after she was taken by her friends to the police to report the alleged rape, she made a statement and later was handed a form which she filled before she was medically examined by an expert. “That the voluntary statement of the medical officer revealed that the complainant’s clothing was intact, no sign of rumpling nor torn pant and she was calm as she gave her stories. “That the medical report revealed that upon examination of the complainant, there was no bleeding part of her body, no laceration, abrasions nor bruises on her body. On vaginal examination, her panties were not stained, normal female external genitalis observed, no abrasion, bruises, no laceration. There was no hyperemia to show forceful penetration within her vulva and pineal region including her anus. “That the voluntary statement of the medical officer who examined the complainant revealed an impression of query sexual assault to rule out pelvic inflammatory disease. “That the statement of the complainant at the police station is completely at variance with her recent statements at the state CID, Calabar and Gender Unit of Force Headquarters, Abuja respectively”, the report said. Part of the doubts raised by the report was the claim of the alleged victim that when her attacker held her down and removed her panties, he put on a condom and there was a knock at the door which he went to check and returned to put on another condom before he penetrated her, even when the environment was a busy one where students and workers trooped in and out. First, we have all sinned. But the path to forgiveness, there must be admittance of guilt, acceptance of responsibility then penance. Please tell me or show me where she has done any of these in the past weeks since the video and news broke. When this news broke she issued a statement that it was not her, that the video was doctored. That they were out to tarnish her image. When it became obvious that no one was buying that crap she switched stories and tried to play the victim's card, that blackmailers were after her to kill her. Wait a minute, does she expect us to buy this explanation? How about coming out to say I am sorry, my actions have hurt a lot of people especially my family, friends and fans, I take responsibility (which Africans never do, its always someone fault or the devil or someone is after you) and I have asked and still asking everyone my actions have hurt to please forgive me and I truly and sincerely regret my mistake. And I advise all other people to please learn from my mistakes and think about their actions and how it affects others before they act. This simple step is what I call a perfect path to forgiveness and redemption and not piling one lie after another every time on social media.There are consequences for our actions and inaction, this is the consequence of her action or inaction, she should live with it. |
A probe of the Central Bank of Nigeria (CBN) from 2007 to 2014 may be underway if the push by some forces within the government sails through, sources close to the administration have said. The probe, if the authorities finally put a seal on it, would investigate the printing of naira notes under the watch of Professor Chukwumah Soludo and the management of CBN’s “surplus” finances under the watch of the incumbent Emir of Kano, Alhaji Muhammadu Sanusi. The duo had managed the CBN at relative periods of boom but forces in government said that the policies they instituted did not appear to help in the fight against corruption in those eras. Sources close to the administration stated at the weekend that the administration of President Muhammadu Buhari would not close its eye to any perceived unwholesome practices in government notwithstanding the length of time. “We believe that questions that have not been completely answered must be brought forward and clarified as a way of ensuring that the nation’s institutions do the right thing at all times. The duo of Sanusi and Soludo had spoken against the drift in the economy last week, asking the administration to take immediate steps. But a source said that the planned probe did not have anything to do with the current postures of the former apex bank bosses. “If certain questions are left hanging by the past administrations, this should be the time to clear such issues since this administration is determined to fight corruption and corrupt tendencies. The move would also help any of the past officials to clear their names of any perceived wrongdoing,” the source said. While Soludo’s tenure is to come under searchlight for the process of printing new naira notes, the tenure of Sanusi is to come under the searchlight over the distribution of forex earnings to bureau de change operators as well as the report of the Financial Reporting Council of Nigeria (FRCN) which raised several allegations against Sanusi. The 13-page report of the FRCN which was relied upon by the Federal Government to suspend Sanusi from office in 2013 had alleged that the former CBN governor spent N1.257 billion on lunch for policemen and private guards in 2012. It was learnt that Ayewoh, an employee of the Works department, slumped while protesting with hundreds of his counterparts from the 18 local government councils. He was said to have been taken to a hospital, where he was confirmed dead and his remains later deposited in a mortuary in Uromi. The protesting workers carried various placards, lamenting the failure of local government authorities to pay the outstanding salaries, ranging from two to 18 months. Egor Council is said have the highest backlog of unpaid salary arrears.
