Hello all
I would like to know best guide regarding below issue it would be great also if anyone who gone through the same.
In feb 2014 we applied n got rejected in October 2014 due to second job salary ( worth of just £80 a month) not reflecting in bank statement as it was a cash but we had all supporting documents which we attached with our appeal n submitt appeal got review deadline of 2 april 2015
But in between we got letter of hearing which is set this month end of march 2015 mean bfore review deadlibe our hearing set by tribunal ( is it normal thing??
We didnt get any outcome/decision from ECO/ECM regarding review of our appeal
And we have started depositing cadh in account since we got refusal so its been 5 month we depositing in bank
And in a couple of week we have to send appeal bundle 5 days bfor hearing do we are now attaching these bank statements too
is there any chance to get overturn/appeal allow on hearing?

we lodged appeal end of october then we got review deadline of 2april but then sudden we got hearing date of mid of this march (means bfore ending review deafline) us it normal??
also we r about to send appeal bundle in 2 weeks as mentioned in hearing letter so is there still any chance to get overturn bfore hearing?? |

Bolssos: Wow! That long ooh...no letter yet from them nor email regarding the date the only letter we receive was to pay for the appeal..This appeal process is really long! God will help us and they will reverse there decision..Amen

justwise: When you get to the tribunal centre early you will see your name and time of your hearing placed on the door of your courtroom, but they don't usually follow that order as you may be called earlier than stated because some may cancel their court date or come late, so that means if you are there they will call you to come in for your case. girlfio: Usually they will only book a court date if the decision has been made to maintain the refusal. Have you contacted the Leicester tribunal office to see if they've received an update from the Sheffield office? no i didnot yet. i thought when they didnt mention any thing regarding review decision because i saw ppl updates abt their letter mentioning the review outcome too in appeal hearing letter. so i was just feeling happy but now worried also how to contact them |

I've never seen them schedule a court date that takes place before the 19 week deadline but that's because they usually wait so long to book them in after their initial review. Basically the 19 week date is the deadline, they can actually do their review anytime from when they receive your appeal. It looks like they've reviewed your case early, made a decision to maintain their refusal and then booked the court date. Which at-least means you won't have to wait too long to present your case.
In your determination letter it should give you the reasons why they've maintained your refusal. What you then need to do is start gathering evidence to address these points to then present to the judge. Has your lawyer been in touch with you about how you will be defended in court?
In regards to the 2nd job evidence, could your spouse get a letter from their employer, on headed paper, stating that over the 6 month period stipulated in your application that £80 per week was paid as wages. My only concern here is that if they did not receive payslips that issues may be raised with the paying of taxes etc. hi as you know i got hearing date before finishing my reviw deadline. so i asked my husband to show me what has written in letter he sent me. letter is just consist of one page and only hearing date address and hearing procedure written in letter. not a single word written about review and its decision. so i think we have still chance to get overturn bfore court anyday |

girlfio: The 19 week deadline should be in your tribunal letter. The 14/15 week point where they usually do the initial review is measured from the issue date of the tribunal letter. Thank you |

paulz: i won my review and i subnit my passport to d embassy on 8 of jan, i now received a email on jan16 that my visa has be processed and is ready for collection,we aim to return your passport at d visa application center where you first lodge ur application within two workings days. it has pass 2 workings days i hav nt yet received any sms for collection,it now getting to jan 22 congratz when did u appeal ?? |

Lexusgs430: If you have documents to prove that this cash payments, had National Insurance contributions and relevant taxation paid. yes we have tax records by HMRC & national insurance too |

girlfio: You need to prove that the wages were received, the only way to do that really is to provide a bank statement in the name of the sponsor. yes wage were receivd and taxes also paid |

if any of job's salary worth of just £80 weekly not shows in bank statement as paid cash. but have all proves (p60, Hmrc tax records, accountant letter, wage slips, job letter that job is genuine
what do u guys think it can overturn or can go for hearing |

The day i received or the day written on the letter?
