So, I'm the lady the mum was refused and banned for 10 years under false misrepresentation last month
And I went out of my way to get documents from a UK lawyer stating she owns the business name.
An affidivat claiming she owns the business name
A letter from CAC stating the shes the true owner of business name
A letter from her bank stating she owns the company and they opened an account for business in her name

I'm so happy to tell everyone that she GOT her Visa today with a letter.
I dont know the contents of the letter but I told her to bring it along with her when she comes in next week.
Thanks everyone Justwise, Tunderule2016, askari01, nairacountry.

She said its her personal business and she has 6 staff who works under her. They asked her if they could verify her business name registration at CAC. Only send officials if the application is complicated... Thanks, Our documents are 100% genuine.
It's a shame. I wish I knew where the error came from.

askari01:

Phardey... you have done the needful, Let your mum reapply as you have said she's going for her appointment today. Be informed that the BDHC would do all verifications... They might even send delegates to the CAC headquaters for clarification, so If your documents are genuine, Congratulation and if Not, it's gonna be very bad. I wish ur mum good luck!!!.

Thanks.
She wrote a detailed to them explaining and told them they errored her application. and she mentioned she never mis represented herself.

I hope they send their Official to CAC to confirm. and I hope CAC won't give them attitide. It's been a very long 2 months and Hopefully, she gets to visit us next month.

Thanks Tunde

tunderule2016:
My opinion is keep calm and dont rush in making any decisions.....
You should definitely put in a strong case.... Yes it is about money for them....since in a week thousands of applications are put in by nigerians.

ECO are bound to make mistakes.... but dont make wrong decisions... When applying again make sure your mom writes a personal letter explaining what happened to her ... she should not get too carried away with emotions but she should make them realize there mistakes ; i believe the lawyer should know what to write up.

Good luck and will keep u in my prayers..

I understand they are really looking for flimsy excuses not to give us visas.
But I know they are wrong and I intend to fight this to the last. Accusing her and banning is so wrong. She has excellent travel history. Never ever stayed beyond a month while visiting the UK.

If I didnt move back here. I'm almost certain she wont even try to apply for a UK visa.
They have no reason.

Infact, my lawyer said we could them because the Business Name is registered to her.
Just no reason for them to refuse her this time.

I'm stating to think everything is about money for them. This is wrong. She was wrongly accused

nairacountry...
1. Everyone is entitled to their opinion

I have my reasons for saying "I just tire for Nigeria jare... too much wahala."
Imagine.. To get a letter confirming the owner of the Business Name is officially N10000
Guess How much I paid N40,000. Why is that?
After paying N5000 extra for courier to bring the letter from Lagos... I still had to send Courier plus to get the letter for her from here cos they said their own courier will take about a week.
Won't you be tired oga nairacountry?
The official cost of obtaining a passport is N12000 or so... yet Nigerians have to pay N28,000
Wont be tired of such nation.
Abeg, I'm not here to lament about Nigeria cos If I start to talk ehn... ground go ground

Fact is that .. we dont know where the error came from? and its tiring and exhausting.

nairacountry:

Take it easy bro. What if the ECO didn't call as insinuated? Would u have been tired of UK too much wahala and then decided your mum should stay back?
If the ECO truly did make that call, be sure the person at the CAC end wouldn't have been naive and dam the consequences and the implications (of such negative/laziness confirmation of Wat is not) to the biz owner and just decided to say contrary to the truth.
The Nigeria you are tired of has being giving you advices, gave you all the letters needed for your mum to get off the hook of this ten years ban......
Pls be open minded
All the best
Travel / Re: General UK Visa Enquiries - Part 3 by phardey: 9:55am On May 25, 2016
Hi Justwise,

We confirmed from CAC that she's the owner of the Business name.
CAC has issued us a letter for UKVI stating she owns the business name.
CAC didn't acknowledge the error came from their incompetent and Lazy staffs because my mum included the refusal letter when she went to CAC to enquire about her Business Name. CAC reckons UKVI never asked them confirmation.

I just tire for Nigeria jare... too much wahala.

justwise:

I'm not saying you should not reapply but you need to be absolutely sure that the document your lawyer CAC is genuine.

If at all the embassy contacted them concerning the business then they must have had a reasonable doubt about it.
Travel / Re: General UK Visa Enquiries - Part 3 by phardey: 11:49am On May 24, 2016
Are you saying she shouldn't reapply.

Because I just applied and submitted now. She's meant to go for her appointment on thursday in Ikeja
I'm not sure the ECO contacted them. Government workers in Nigeria are known for their Laziness.

justwise:

Ok, you can write the embassy with the document but make sure that the document is genuine since the embassy contact the same organization and was told that your mum is not the business owner. Is the case of proving that she owns the business if that is the only reason for refusal
Travel / Re: General UK Visa Enquiries - Part 3 by phardey: 11:22am On May 24, 2016
The CAC Business name is trully hers.
We got a CAC letter to confirm this. I don't just understand Nigeria.
Its bad. Now, I had to pay extra for Ikeja TLS because there are no appointments in VI till 6th of June.

I pray it ends in praise. It made me very sad. i've spend around £500 on a 6 months visit visa!

its sad.

askari01:
[/b]

The bold statement is very important. The lawyer may not even know if the business registration is genuine. Go and do more verifications all by urself.
1. Check if the names with the CAC correlate with her travel docs

2. Write a very strong letter, with a genuine affidavit and with God it will end in praise.
Travel / Re: General UK Visa Enquiries - Part 3 by phardey: 9:14am On May 24, 2016
Thank so much for this info.
She already did an affidavit and it was in the Ikeja high court with the pink sticker.
The ECO did say she verified with CAC but who knows who is lieing. Any Government in Nigeria is just wrong. I spend about N40,000 to get a letter from CAC stating The business was indeed registered in her name. The official price for this is N10,000 but God knows. I will fight till the ban is removed because she didn't misrepresent herself.

Poor woman is just weak and tired and said she wishes she isnt going through all this stress.

imperialebony:
Sorry for the ECO's libellous act on your mum's visa application. A few days ago when I was advising a nairalander in this forum not to panic because of the mistake made on a visa application form, and I digressed a bit, that I was once emailed by ECO during one of my visa applications in the past, asking why our TCC carried a different/new logo, instead of the former one with the Nigerian coat of arms, some members here who read the post must have thought it was a cooked-up story. Now, your mum's Cert of Reg issue will clear such doubts. These people are needlessly meticulous. They pay attention to every detailed info you bring to their fore. Maybe the format of the cert of Inc has also been changed by CAC and the ECO didn't bother to verify. He/she might have stated it in the refusal letter that she actually verified the cert of Inc with CAC ,just to make her think he/she carried out an in-depth assessment on your mum's application...I guessed the ECO took a decision in a hurry after noticing a change in the cert of Inc's format or logo. Our govt agencies too no dey try. CAC had changed their logos and certificate design/format several times without notifying the general public(mine issued in 2010 was also different from the previous ones I'd seen). They ought to be notifying embassies of every little change on the certificates they issue to the public, to avoid undue punishment in the name of applying for a visa (after paying so much fee, which is non-refundable). Viewing it from another perspective, the ECO could have verified as claimed but the lawyer gave the job to a third party in the process, who now did 'genje' and gave it to your mum. If your mum has a compelling evidence, she could still get her visa after reapplying. Those aforementioned documents would help and even more, as they're inexhaustible(just to fight this case) . Please before she reapplies, tell her to do an affidavit in a court like high court, listing all the docs and stating that all of them are true and genuine. you can even do this yourself, without engaging any lawyer. Go to Ikeja on her behalf with those documents. Meet the people who are adept in processing affidavits. the moment you cross under the bridge towards Ikeja general hospital, you'd have seen them on both sides whispering to you and asking if you want to do affidavit. Pls tell the person that you don't want an ordinary red seal affidavit(which anybody can get by the road side). Tell the person that, what you what is the stamped-logo which is usually in pink ink(and not a red sticker). They will charge you for this though, because they charge per stamp, but negotiable. The stamp will almost litter the affidavit as it will be stamped many times but it's ok(insist you want it that way). With this and other accompanying documents, the 10-year ban could be reversed and she could be issued her visa, if truly those documents are hers and genuine. Also tell her to present the case to baba God.

This is the time she used the business in her application. Business name was registered in Dec 2012. She hasnt travelled to the UK for about 6 years.

She was a frequent traveler to the UK between 2004 and 2010. She and my dad used to apply together.

Hmmm People after inviting my mum here to the UK in April.
I've been too depressed to come back since her refusal. I was too weak ... I swear
I supplied everything, bank statements, payslips, utility bill.
She was refused. The ECO claimed she doesnt own her business.
She's a self employed food caterer that has worked with KFC and Mr Biggs.

The ECO said she all her future applications will be refused till 2026 because the ECO believes she mis represented herself. ECO even said they confirmed At CAC that she's not the owner of the Business.

I con weak...
The business name was registed in DEC 2012 through a lawyer. It was indeed registered in her name.

So, aside from all the proofs we submitted before.

We've gotten a Nigerian Immigration lawyer here in the UK who also used his contacts to get information from CAC that the owner of the Business Name to write a letter to them.
The bank she banks with has also issued her a lteer stating the account/Business name belongs to her because they confirmed from CAC before opening the account for her.
Her recent bank statments then a letter from CAC confirming she's the sole propertior of the company.
A letter from me her sponspor explaining to them she's the owner of the business.
A letter from her saying she owns the owner and an affidavit stating she owns the business.

We hope to re-apply this week.
Has this happened to anyone before?

@justwise... abeg help me oh

@ Just wise

My mum's application has been not been a straightforward one.
She applied for 6 months Visit visa

She used to visit before but stopped in 2010 when I moved back to Nigeria. She used to apply with my Dad in Dubai. She was never rejected once neither did she overstay for once. I'm sponsoring her trip to the UK. She's a caterer in Nigeria. She included information of her business and all in the application. she has a registered business and pays her tax. 3 days to appointment date, a client paid N200,000 into her account using a valid narration for the deposit. She printed off this statement with the money paid in. She submitted my 6 months current account statement, 6 months savings account statement, 6 months payslip, Talk Talk utility bill, tenancy agreement, passport bio page, spouse visa page, hubby british passport bio data page

1st April: Submitted online
14th April: Appointment booked(She had so many commitments in Lagos and Ondo, she she thought 14th would be idle)
14th April: She went for her bio-metrics
14th April: Application sent to Sheffield Email
18th April: Application received in Sheffield Email
18th April: I got a call from Sheffield asking me about me and all. I answered all questions correctly
22nd April: Got an Email stating Application is not straightforward and they cannot conclude her application within the time frame given
29th April: She got a call from Sheffield asking to confirm if she works for the owner of the business or its her personal business. She said its her personal business and she has 6 staff who works under her. They asked her if they could verify her business name registration at CAC. She answered Yes since she's the Director of the company.
2nd May: Decision email came in from Sheffield and after a few hours Decision email from TLS arrived.

No further communication has been received from TLS.
Tomorrow will be 6th May. Can she go to TLS to ask for her passport?

Also, Do you see any signs she may be rejected?

All you have to do is to answer all that questions correctly and honestly, why they asked those questions is immaterial because it will not change anything but answers to those questions will make or break the outcome of her visa application.

Ok. Thanks Much

Add tenancy agreement and utility bills to that list.

Yes you can invite her as long as you can afford it

So, I added the doucments you told me to add and she submitted her application on Friday and I got a call from HO yesterday. I was asked about 15 questions.

Who's applying for the Visa?
Whats her full name?
How old is she?
Whats her relationship to me?
Whats her occupation?
Who's paying for her travel and feeding her?
Will she be staying with me?
How much am i giving her for the cost of the trip?
Who filled the form for her?
What do i do?
Where do i work?
Whats my full post code?
Have i invited anyone over in the last 2 years?
Who else have i Invited?
Will she be travelling alone?

Please Just out of curiosity, Why all that questions and if i answered correctly ... will she be issued the visa?

Hi Justwise, Lexusg

Please I really need your advice.
I'm on spouse visa. I wanna invite my mum for a few weeks.
My hubby has a British passport but he isn't saving anything in this account.
I've been saving in my account. I was told I could invite my mum using my payslips, bank statement, passport bio data page, visa page, my husbands British passport bio data and an invitation letter.

Please is that possible?
Thanks...

So I contacted the HO about my BRP.

This is the response.

Thank you for your enquiry.

You will not require a BRP as your visa is valid until XX XXXXXXX XXXXXX

Accordingly, you should use the Entry Clearance vignette you have been issued in your passport to enter the UK and evidence of your right to be here.
You will not receive a BRP.
Please do not reply to this e-mail.

Thank you

It was introduced newly I guess.

I have been wondering about the biometrics resident permit myself since lately everyone seems to be talking about it. I guess putting the visa on it is recent because my whole visa for the 2 and a half years is on my passport. So phardey, maybe when we renew we'd get the biometrics card. Thanks portsmouth86 for making me understand it better. Congrats once more.

Awwww! Finally cheesy

I'm so thrilled for u. I remember seeing all your messages when I was about applying for my Visa last April.

Quick one please. Does everyone on spouse visa needs the biometrics card. Whats the card for?

Yes, the decision is usually made on the day of the spouse's Interview in London. (Thats if the spouse was called fro interview)

My visa was dated 26th May, Same day my hubby was interviewed in London

Portsmouth86:

Haha you know it grin

He arrived on Saturday, was detained by Heathrow border force for over an hour poor hubby, they called me and asked me to show my ID then let him go.

I took hubby to London for Valentine's day showed him the palace, Trafalgar square Leicester Square, and of course the Nigerian high commission, we watched a movie in Leicester Square and saw the Chinese new yr celebrations.

We collected biometrics card yesterday and it's valid 27th January 2016 til 5th November 2018 so seems decision was actually made on the day I had the interview.

I went to cook some food for hubby he told me to relax he will do it that I done a lot already, and he did the dishes haha feel like he ma wife ooo smiley

Now time for me to get back to work tonight, he's been added to all the bills and appointment to open a bank account on Tuesday smiley

Busy few days I must say haha

@ Jeljay

The NIHS can only be refunded if you will not be given the visa at all. My hubby was refused in October 2015 but we were not refunded the money as he was given an appeal. If you go on their website, it explains it there. It was a minor issue about chats print out not enough, pictures and travel stamps. We have appealed and waiting. The VAF doesn't say refused or granted. We had email with VAF but was refused.

Does anyone know roughly when the ECO response to the court during an appeal. We received a letter from the tribunal saying they have written and send our documents to the ECO and they have until 15th March to let us know the outcome. If they will overturn the decision or we go to court.
Has anyone gone through this process before and how long does it take to hear from them? Thank you

Appeal usually takes about a year to complete if the ECO doesn't respond. My first spouse application was made on 29th April 2013. My appeal was finalized on the 25th July 2014 and it was still a denial but I was told to reapply which I didn't do till April 2015.
