PRESS STATEMENT ON THE CASE OF COMMISSIONER OF POLICE V OLANREWAJU JAMES (BABA IJESHA)

It would be recalled that the Nigeria Police Force arrested Mr. Olanrewaju James (also referred to as Baba Ijesha) on account of various sexual abuse allegations. On the 30th of April, 2021, the Police forwarded the case file of COP v Olanrewaju James to the Directorate of Public Prosecutions (DPP) for legal advise.

After due consideration of the facts in the case file, the Directorate of Public Prosecutions issued legal advise on the 4th of May, 2021, which is to the effect that a prima facie case has been disclosed against Mr. Olanrewaju James and recommended he be charged under the following provisions of the CriminalsLaw of Lagos State, 2015:

(1)Section 135, Indecent Treatment of a child- punishable by 7 years imprisonment, (2)Section 137- Defilement of a Child-, punishable by life imprisonment, (3) Section 261- Sexual Assault by Penetration- punishable by life imprisonment, (4)Section 262- Attempted Sexual Assault by Penetration, punishable by 14 years imprisonment and (5)Section 263, Sexual Assault- punishable by 3 years imprisonment.
Whilst the State would ensure that Mr. Olanrewaju James's rights as enshrined in the Constitution are upheld, the Ministry of Justice would not relent in its efforts in ensuring that whoever sexually abuses any resident of Lagos State is speedily brought to book.

It is instructive to note that the Lagos State Ministry of justice has been consistent in it's efforts in protecting the vulnerable in our society and since the establishment of the Domestic and Sexual Violence Response Team in 2014, it has till date prosecuted over 800 cases of Sexual and Domestic offenses.
The Attorney-General hereby assures Lagosians and indeed Nigerians that in accordance with the DPP's advise, charges would be filed accordingly.

. Expected judgement. : 1 guilty as charged 2 Not guilty 3 not guilty 4 Guilty as charged 5Gulty as charged. The jail term will be served concurrently.. On his first appearance in court it is expected that he will remanded for some days or weeks or months. .On the second appearance his bail application will be considered subject to the mercy of the judge with some consideration of various factors.

Served concurrently actually means he gets to serve 14years which is the highest.

While he is serving the 14years, at end of the 3rd year, the law will assume he has served the 3years term. At end of year 7, the 2nd term will be discharged and he will serve the rest.

From the Video I watched, and our legal system, he will walk away without serious charges.
In d video, I didn't see resistance from d gal actually and he can as well claim he never Knew d gals age.

As for the rape of d gal as a minor, I wonder how the prosecution will prove it beyond reasonable doubt, he will most likely walk away too.
Best thing to do after rape incident is to report immediately so u can hv evidences to prove it beyond reasonable doubt, but proving rape allegation of 7yrs ago might be a difficult task for d prosecutor.

When I was 14 I knew nothing or little about sex despite been thought in sch so why would I support this.

I've seen ladies blaming the child also , they claim children are spoilt these days that the guy is fully aware of herself.

I don't do hypocrite stuff , I know a lot of girls at age 14 would have had sex one way or the other.

For the fact that she's a minor every guy hoping to be a father would be against this.

After painstakingly watching d video clip, I come to d unavoidable conclusion that d charges r bugos and unsubstantiable. The only charge that may fly is charge number one "indecent assault of a child". That's d only charge that's sustainable.

With a good lawyer, he will work out a free man.

Charges 1 and 5 should be a shoo in conviction. Whether he will be given the upper limit of the sentences and whether the terms will run concurrently or consecutively is another hurdle. I pray the case is fast so that we can get him off the streets. He is definitely a danger to the society.

Kind of wondering on the charges 2 and 3 though. I thought the first DPP opinion is that it is Statute barred? Or is it that there is a new defilement?

I just read a legal write up on Section 218 of the criminal code which sexual assaults and defilement of minors. It is grossly evident that our legislators are absolutely not doing a good job if such a law can exist in its current form.

1. Defilement only applies when the child is below 13years(11years in some state). Action must commence within 2 months of the offender can no longer be prosecuted.

2. If the child is above 13 but less than 16, unlawful carnal knowledge only fetches 2years with or without caning.

There are so many outdated stuffs in the Act except lawyers in the house can elaborate on how DPP got the terms above for a 14year old

The 2015 law is the latest, see below, and it clearly stipulates 18 years as age of consent federally

I believe the man did this for reasons yet to be unearthed. It goes beyond sexual satisfaction or the likes. Otherwise, his status as an entertainment star could fetch him tens of beautiful ladies out there with little or no efforts. A walk on the street will make matured ladies fall for him without asking. This is Nigeria, where even the ugliest of male artistes marry the most beautiful ladies in the society. Yet, the man opted for the self destructive path of "playing" with the minor!
He saw the trap and willingly and foolishly walked into it. Shame! However, justice should still be tempered with mercy. Baba Ijesa is already down. He should be sentenced, of course, if eventually found guilty but they should consider giving him light sentences.
