Judge human as a human don't judge human as a programmed machine. A peaceful tenant receiving quit notice is not something any one it going to throw party, of course the anger wiĺl be much and that 6 months must be used complete. So op, calm down for the girl, she go leave or tell am to get another apartment as u pay every dim of it.

Let them visit the court premises to file papers, who do they think own those properties in the court premises littered outside? I went to file papers once and I had pity on the unfortunate people who have their properties carted away by the courts and kept outside where sun and rain will fall on them.
As tenant pray you don't jam a determined landlord who will fight with you to the last.

Please I need your advice and that of any other lawyer in the house about my sister's ordeal with her landlord.

My sister moved into a house she rented in 2019.
According to her, that evening the landlord started disturbing her on phone to sleep with him which she refused. After much persuasion from the man and she refused, the man turned against her and it has been a war for her.
Note that the man collected 10k from her as agreement fee but never gave her any agreement paper to sign till date.

Even though she went with her boyfriend the day she paid the house rent, all of a sudden since this year, the man insisted that the guy won't pass the night in her house any longer.

My sister runs a POS point which she started recently, but the landlord insisted she will not stay where she got a space close to the house. His reason is that he is not in good term with the family living opposite her shop. Now he is even sending people and threatening to destroy the shop of the woman who gave my sister the space to stay.

Note that his wife also take her fruit to thesame woman's shop and he doesn't have a problem with that.

Now on Monday this week, my sister's boyfriend visited her house (not to sleep over). Around 7pm the landlord came to knock on her door and asked her to tell the guy to go that it's late. According to her, she flared up and had exchange of words with the landlord. The next day, the man returned the 6 months rent she paid him barely 3 weeks ago in the presence of my dad who went to visit her and asked her verbally to vacate his house in 7days.

Her boyfriend also came to see my dad in her house to discuss his coming to my family for my sister's marriage introduction rite, but when he was leaving, the landlord started warning him never to come to the house again till my sister vacates.

Now my sister has gone to report the matter to the police and he was been invited to come yesterday but he didn't honour the invitation yet.

My sister simply wants him to serve her a proper quit notice and give her 3 months to vacate the house not the verbal one week notice. She is also asking that he should stop harassing her, her boyfriend or the woman she is staying in her shop.

Please do you think my sister has taken the right steps or is there any other thing she should do?
Was the man right in asking her boyfriend not to come to the house again? . I really need your input on this. Thanks.

Note that she reported this matter to the man who claimed to be the lawyer in charge of the house, he promised to get back to her but stopped taking her calls afterwards before she went to the police.

Whether you gave him/her the notice 1 week after paying a yearly rent, the notice can only take effect at the expiration of the the current rent. So 6 months still applies, some greedy wicked landlord won't like it but its the law....

Did you use the phrase greedy wicked landlord? So the person who wants to live six months of free rent is benevolent and kind, right?

One day you will all die and I will see wether you will be buried with the house...I know what It feel to just bring one useless quit Notice without offence and do you think it that easy to get another accommodation.. I pray God should build mine and thank God I moved in. Just because one useless land lord puss me to it and God remember my prayer. To those who never build house and one useless land lord keep up pressing you, You shall be free from them one day with your own house.

Please don't take laws into your hands, because the law tilts more in favour of tenants. get a lawyer to Give him quit notice if his a yearly tenant If the tenant is on yearly payment, it is 6 months notice that u'll give him and it will start counting frm d day you served him d notice irrespective of how many months he has not paid.

Once the quit notice has been filed validly for 6 months, any day over that 6 months notice means the tenant is holding over that property illegally and he no longer becomes a tenant but a tenant at sufferance and from there onward you dont need to issue him a quit notice again but an OWNERS INTENTION TO RECOVER PREMISES in 7 DAYS And from there onwards the tenant practically has no defence legally when the matter will be filed at the rent tribunal nearest to you.

Tops with all the adjournment within 3 to 5 months the court balliffs will personally come to serve them to eject them of the premises compulsorily.

DO IT YOURSELF (DIY)
If you don't want to contact a lawyer.
Let me give you a summary of what you should do .Serve him the statutory notices ie 7 days and one month,then file a suit for recovery of premises at the nearest magistrate court.

Once the case comes up tell the court you are handling the case yourself,enter witness box and tell the court what the man did and the order you are seeking from them.The bailiff will then enter the box and tell the court that he served the man but he didn't come .The court will then grant you the order you are seeking.You will take the judgement copy and go to the bailiff and pay them for policemen.

The policemen and the bailiffs will go to the man's house one early morning, break his house and pack all his properties to the court premises. I hope you learnt something today from this. Goodluck

If you based in Lagos If its Lagos, go through the human right activist section or Mediation center of the State Government. They have many outlets in each local government in the state. They'll charge a fee of #8,000 and would handled the cases

STREETS
I don't encourage this any longer but its inevitable where a tenant things you must suffer after the initial suffer to build a house. Go to court, pay the clerk and officials and get a notice, paste on his door in his absent and snap then take notice off. Make some other person appear in court in his stead as a proxy tenant he transferred tenant ship to without your consent and get a verdict and evict him immediately as the unpreparedness will rock his life for ever. He can continue the fight from outside your house. The person that appeared is the person you have been seeing around the house and you don't know him. Simply put, he alone can provide that person.


Let me tell you a small story on that your DIY advice. It is normally carried out by lawyers or someone closer to them. They manipulate the law to their own advantage. A young boy that got married recently id that DIY to someone and the boy was cursed. I am not sure he can be freed from the curses rained on him. Don't manipulate judgment. Really.. Your sister is getting it wrong

1... Paying her rent without making sure she get the copy of agreement sign properly

2... Going to the police instead of a human right lawyer to report, police will only do nothing ooo...

3... If she is paying half a year payment ND the agreement is sign properly, she will get the three month... But if not sign, it is as if the landlords gave her the ous to be using and can ask her to leave

Thank God for your own, but do not think of any landlords as wicked or selfish...

A man could av built his own personal House and live peacefully... But when he decides to build a house for the purpose of rentage and making himself money for a living, why will someone be bold enough to want to live without paying for it services

You can as well build a rentage apartment let see how nice you can be when your rent is not bin paid.. hahahahahahaha business is business not pleasure

And not everyone will build a house

Which law is that?? Entitled to 6 months in someone else’s apartment *without* pay? This is absolutely untrue !

Granted, the position of most tenancy laws is for Notice to Quit should run for 6 months. However, the tenant must pay for each of the time he stays in that property.

@OP, this is a free advise. I have evicted tenants and j am an estate surveyor. I have used court, mediation centre and traditional method to evict tenant.

First, if the tenant refuses to acknowledge the notice, don't worry. Paste it on her door. Snap the notice showing clearly that it is pasted on her door. Take it off, place it at the entrance of the property take pictures showing the address of the house, full view of the house and closer view of the notice showing all written letters on it. Once the notice expires, serve her 7days notice too and do same if she refuses to acknowledge it. Print the pictures, and copy of the notice. Let your lawyer file matter in magistrate court. The tenant would be served court summon. Day of hearing or mention of the case, appear in court with your lawyer. This might take a little time to achieve. Once court gives judgement, the tenant would pay mesne profit till the day she/he vacated the property. Even if they run away, if you are able to get the new address, court ballif will go and do recovery of the mesne profit. (I have done this before. Took 2years but the man ran and new address was gotten. His suv is in court to be auctioned to pay off the mesne profit)

2. Mediation centre doesn't really have effect like that because they don't have much power to execute judgment. They only appeal to both parties and if there is no resolution, they advise to go to court. Sometimes if tenant know them, they will drag your matter and waste your time.

3. Traditional method is like customary court. Report the matter to the oba in your area (if he is a respected and feared one) they will give tenant 3months self and not 6months to move out. If tenant is stubborn after all warnings, they use boys to move their things out. (I have used this method for 3 tenants in ikotun) this one saves money for you than going to court. They don't request for much.

You re very wicked... Like the tenant paid one year rent and probably she have spent 5months out of 12month you now serve her notice to leave the house immediately her rent is due.. You re very wicked , and you saying you gave her notice earlier enough. Wish I was the lady, I go drag you tire. Shea u get money make we they meet for court, you cant be playing on people intelligent. I'm not sure a lawyer will be that stupid to advice such, maybe you just went to a business center type the notice.

You are entitled to 6months notice not 6months free rent. Please don't twist the law.

I don't know where tenants or people generally thinks once they are asked to leave they have "free-to-stay-6momths".

The purpose of a notice is for you to prepare yourself up until the evacuation day. And it should normally run 6months before your current tenancy expires.

The problem is when landlords issue a quit notice in the morning, they expect you out by evening. Where is the sense in that? As if I'll be living under the bridge and contacting housing agents from there.
That's not how it is done ooooo, if you're a yearly tenant, you're entitle to 6 months and must pay for the 6months as stipulated by the law. if you're a monthly tenant, you're to quit within ,7 days. If you're 6months tenant, you will be given 3 months notice. Meanwhile, if you're owing your landlord, your quit notice will b a short one either yearly tenant or not

The bolded is not a function of the region but the person. I have had the worst tenants from the region you are trying you talking about and even the South West. I have also have the best from both region. it a matter of person not region.

Do not try this method. If it backfire you will be spending some time in jail.
First if you want to quit your tenant, go to your lawyer pay and the lawyer will file the Notice to Quit and register it in the court. A bailiff will be the one that will issue the Notice to quit to your tenant. You have no basis handing the tenant to quit.
After six months, since she is a yearly tenant, go back to your lawyer to issue 7 days owners intention to Recover property. After the expiration of 7 days the lawyer will now file papers in court.
The process may take long before you recover your property, but bear it in mind that for any extra day the tenant stays on your property she will be liable to pay mesne profit. So don't fear that she will live there rent free. No. The court will help you recover your money if you are willing to follow the due process which might seem long.
As for those thinking that they can live rent free in another man's house pray that you don't jam a man who is determined enough to make you pay.

I will like to know what happens if a tenant was finally ejected and still couldn't pay up his/her outstandings? Is there a way the court would punish such tenants either by selling some of his/her belongings or he/she spend some time behind bars.

I totally understand there's nothing like 6months free. It's just a misconception people planted in their head over years.
