OP, you're still not telling us some vital information pertaining to this issue

The company wants compensation from him, money-wise after fulfilling their own obligations (Paid 4 months owed salary and Pension of almost 2years) all within a week.

Common OP, let your brother too fulfill his own contract. Because he must have signed a contract with them to be a worker in that company for a stipulated period.

I am writing this because I feel the management of this company is a group of people who do not want its workers to succeed.

My brother worked for this company for about 5 years, and within these 5 years, salary has never been consistent.

At times they may even stay up to six months before they pay one month

Even when his wife gave birth he met with them and asked them to help him with little money to cushion the cost of the hospital bills, but all to no avail.

Not only the fact that they were not paying salaries, but they were not also remitting his pensions.

You know what that means, these pensions are supposed to be paid on time to enable them to compound in interest.

Before he resigned they were owing to him four months' salary.

He was willing to let it go

So he left without getting paid

As soon as he left it wasn't even up to a week they paid him four months salary at once

After they paid him the salary they sent him a letter that he should come and pay them some money as a sort of compensation to them.

When my brother talked about the fact that they also owe him a pension, it didn't take them a week to remit pension of over 1 year 6 months

So they took him to court, ever since then my brother has been paying a lawyer who has been demanding money-wise.

This is a company that will sack its workers without any sort of compensation.

I feel they are doing this just to create fear in the mind of all the workers in the company so they can also tread with caution, but the effect of their decision is telling on my brother.

Right now he is not concentrating and he is spending money that he doesn't have.

Some time ago they gave him the training he did online and they claim they sent him to Australia to study.

And thereby he should pay them 2 million as compensation.

Guys please I need your advice and how he could handle this case very well.

Stop paying that lawyer, seek advice from another lawyer. The company can only sue of they had a signed agreement.

That is simple nah. He should also sue them. He has evidence of payment made, pension not remitted and other unconventional treatment melted to him. I think his lawyer might not be competent enough because organizations don't like going to court. He can even spread it in the newspaper, labor organization, FIRS and watch how they will beg him to settle out of court

Too bad.

Under Nigeria Labor laws, I doubt if companies are permitted to subject employees to sign enslavement contracts or bonds.
An employee is free to resign anytime provided due notice is given & any company property in his possession returned.

We don’t read agreement before signing in Nigeria, maybe that was stated in the rules of engagement but your brother nor read probably out of excitement

Are there evidences to prove you have once been owe salary and pension ? Then the contract sign was for how many years? And how many years did you work with them? Was there any training expense incurred by you ? Ans these plss.......

Am � certain your story is incomplete. Tell your brother to cehck the terms of contract or agreement he signed with the company. They must have input a clause your brother fails to pay cognizant to. Not until I see that


Modified: I just read in one of your comments, your brother still have 1-2 years left before he leaves according to the stipulated agreement. Lol anyway I believe there is still more to it than this.

Was your brother a trainee before he was fully employed ?

I would have loved to ask you lots of questions but won't do that anyway you have a lawyer and he should advise you accordingly

If na government office now, they would be happy he left. That would be an opportunity to bring in their own person or even start collecting his salary.

There was a contractual agreement that involves the two parties. It was a breach of contract from the company. He has no case to answer. The company is just trying to use emotional blackmail as a tool to get back at him.

Regardless of the contract, since the organization wasn't keeping to terms then he should just tender all the evidence in court like statement of account and the rest, to convince the court to see reasons why he left .. I think if he has a good lawyer, the verdict should be in his favor.

He should have talk with them first for mutual termination of contract.

All this talk of not able to take care of his family is bullsh!t and childish excuse.

I advised most employed young men to cut their living expenses to the bearest minimum and have a side Hustle that can metamorphose to their own company because a 200k salary can't carry a family standardly.

And Quitting the job when you don't have a personal business to fall back to will only compound your problems.

Moving to another company is just because worse because there are so many applicants and almost no job creators so these minute employers abuse their privilege.

Did your brother sign any contract agreement with them? Find out from him the contents of what he signed. Some of the agreement states that you must give the company 1 month notice before you resign or else you'll pay back a month salary. Some persons take this for a joke

Get a good lawyer and countersue them. The contract was voided once they began to owe salaries. I have been in this situation before. If you are in Lagos and need a lawyer, I can link you with the lawyer who handled my issue. She is fire.

So what is his contract of employment like

I feel for him that is why I brought this matter here, in he's words he doesn't want everything to go messy, because he doesn't want his present place of work to know what is happening. And maybe an advice from his lawyer.

Let him countersue them in labour court. He will need to discuss his financial situation and agree compensation with his lawyer.
