I am writing this because I feel the management of this company is a group of people who do not want its workers to succeed.

My brother worked for this company for about 5 years, and within these 5 years, salary has never been consistent.

At times they may even stay up to six months before they pay one month

Even when his wife gave birth he met with them and asked them to help him with little money to cushion the cost of the hospital bills, but all to no avail.

Not only the fact that they were not paying salaries, but they were not also remitting his pensions.

Before he resigned they were owing to him four months' salary.

So he left without getting paid

As soon as he left it wasn't even up to a week they paid him four months salary at once

After they paid him the salary they sent him a letter that he should come and pay them some money as a sort of compensation to them.

When my brother talked about the fact that they also owe him a pension, it didn't take them a week to remit pension of over 1 year 6 months

So they took him to court, ever since then my brother has been paying a lawyer who has been demanding money-wise.

This is a company that will sack its workers without any sort of compensation.

I feel they are doing this just to create fear in the mind of all the workers in the company so they can also tread with caution, but the effect of their decision is telling on my brother.

Right now he is not concentrating and he is spending money that he doesn't have.

Some time ago they gave him the training he did online and they claim they sent him to Australia to study.

And thereby he should pay them 2 million as compensation.

This is why you must read your offer letters carefully before accepting any offer. If possible, let a lawyer verify it.
We do not know the terms of his offer so we may not be able to give accurate advise but the monies he avoided paying a lawyer before is what he is paying now with interest.

Most likely this case will be settled out of court but we all have lessons to learn from it.

A tip for your brother though, there's a stipulated period when a company should pay his pension to the PFA, if they've been missing it, he can sue them also for breaking the pension legislation, damages and lost income (his money should have made more interests by now). wink

Within a week they paid him one year plus salary they are owing him plus pension meaning they have the money but they chose to owe him. They are very wicked!! May that company get bankrupt before the end of this year in Jesus name.

This company has nothing on your brother unless he’s been stealing from them or misused/damaged any company property in his care. Also as per the legal charges, there is the legal aid council that provide lawyers for people who cant afford one - FOC. Lagos state government has an arrangement for this too - FOC. There are lots and lots of NGOs who will take up a case like this FOC.

Also, if everything you wrote in this story is true, you should be counter-suing and demanding for compensation running into millions from the company. Once you counter-sue they’ll withdraw their case and call you for settlement immediately.

Yes he signed a contract, and he has about 1 or 2 years to stay with them before leaving.

But they were not fulfilling their own part of the contract. And it was really affecting him because he was not able to take care of his family.

they are contract breachers, if your brother's lawyer doesn't know that, he should look for a better lawyer that knows what he is doing!

Make sure ur brother counter sues to get all his money and legal expenses back.

They took him abroad for training doesn't mean anything cos be worked for them with it while they didn't pay him his salary ontime. There's not contract that says staff refund money for training anywhere, it's stupid. Counter sue them after he wins.

Tell your brother to take his time and look for a good lawyer, let him even walk into one of those big chambers they’ll handle it for free. That company would pay more, they’re MAD

If what you've written is true, your brother has a good case against them. He can also couter sue them for loss of interest from his pension fund, distress from late payment of his entitlement and breach of contract from their refusal to pay his wages on time.

Your brother should counter claim for delayed salaries and all. Was the pension paid to him direct, if yes he should join PENCOM in the suit. Pensions should be remitted to PENCOM monthly. It is criminal not to do that and PENCOM will come hard on the company. This matter should be taken to the industrial court and sorted out quickly, the court gives quick judgments. Unfortunately details of the contract are not known. He can sue for restraint of trade among other things. If the lawyer knows what he is doing, there shouldn't be so much issues. Contracts in restraint of trade is against public policy and can be effectively challenged. Let him use a good lawyer and all of these will be sorted

First of, was your brother issued a letter of employment by the company?

If yes, what were the terms
for disengagement by either party?

Did your brother violate this, for instance; giving specified period of notice or paying salary in lieu of notice.

If he didn't give sufficient notice, did he instruct the company to deduct the amount in lieu of the notice from his outstanding salaries with them?

You can only help your brother if more details are made available to those conversant with the labour laws.

That company must have been paying a lawyer on retainership and they want him to do some jobs for all the money he has been collecting and your brother unfortunately is the scapegoat

Afterrall they accepted his resignation letter and they have paid salary arrears/pension.
He should go back to them do things that will get the company fedup, hence dismiss him. As simple as XYZ. He will only need to exclude the company name from his CV.

Your brother should stop wasting money and do seld representation. The way people are afraid of being sued ehn. He has all evidence, bank statements of salaries. All he need do is present them while while saying his side to the judge.

I repeat he does not need a lawyer. He should overcome his fears first, thats where all this stems from

Yes he has all the evidence, they gave him a training he did online, so that training is a bond he has with them, due to that training he is to spend about 3 years with them and he has done 2 already.

Basically it was like a slavery, having to go to work every month and not getting paid.

So he found a way to leave because they were not meeting up to the terms of contract, so he too has to do the same.

If an employee signed a contract and the employer failed to meet its own part of the comtract eg paying salaries as at when due, remitting pensions promptly, they have breached the agreement in the first instance. The law does not expect a worker to go beg for alms to survive. Even an undergraduate law student can fight the case for him.
He just needs to gather all the evidence against them, and prove their malicious intent and coming to court in bad faith.

I don't know if you will get to see this. But if want you have stated is correct, then the employer/company filed a frivolous case.

One, all your brother is entitled to give the company for breach of giving them a notice of resignation, is to calculate his salary for that period of notice. If its one month, his one month salary etc.

If the lawyer your brother called is a good one, the first thing he should have done is to counterclaim against the company as well. The payments would show that it was done in anticipation of a litigation.

He should have spoken to a lawyer before leaving the company. In Nigeria, we hate to pay lawyers but eventually end up paying lawyers more.

I am writing this because I feel the management of this company is a group of people who do not want its workers to succeed.

My brother worked for this company for about 5 years, and within these 5 years, salary has never been consistent.

At times they may even stay up to six months before they pay one month

Even when his wife gave birth he met with them and asked them to help him with little money to cushion the cost of the hospital bills, but all to no avail.

Not only the fact that they were not paying salaries, but they were not also remitting his pensions.

You know what that means, these pensions are supposed to be paid on time to enable them to compound in interest.

Before he resigned they were owing to him four months' salary.

He was willing to let it go

So he left without getting paid

As soon as he left it wasn't even up to a week they paid him four months salary at once

After they paid him the salary they sent him a letter that he should come and pay them some money as a sort of compensation to them.

When my brother talked about the fact that they also owe him a pension, it didn't take them a week to remit pension of over 1 year 6 months

So they took him to court, ever since then my brother has been paying a lawyer who has been demanding money-wise.

This is a company that will sack its workers without any sort of compensation.

I feel they are doing this just to create fear in the mind of all the workers in the company so they can also tread with caution, but the effect of their decision is telling on my brother.

Right now he is not concentrating and he is spending money that he doesn't have.

Some time ago they gave him the training he did online and they claim they sent him to Australia to study.

And thereby he should pay them 2 million as compensation.

Guys please I need your advice and how he could handle this case very well.



Your brother has money to spend ooo..
He owes em nothing n has no reason going to court sef.
He got what belongs to him n nothing more

You said he left? He didn't resign, did they accept his resignation? On what basis are they suing him?
