Defying the United Nations and the Western nations that supply Kenya with millions of dollars in aid, President Daniel arap Moi is refusing to hand over to a war crimes tribunal any Rwandans charged in the mass killings that took place in Rwanda last year and said he would arrest anyone who came to Kenya to pursue defendants.

Officials of the tribunal in The Hague said Kenya's announcement on Wednesday of its refusal to cooperate with a United Nations-created war crimes tribunal was a major setback in the effort to prosecute the Rwandans who organized and led the massacres that killed an estimated 500,000 people.

It would effectively create a sanctuary in Kenya for Rwandans involved in the genocide, many of whom already either live in Kenya or frequently pass through here and have close ties with Government officials, human rights officials say. Despite expressions of concern from tribunal officials, Mr. Moi did not back down and said the causes of the mass killings had to be investigated before any arrests could be made.

"I shall not allow any one of them to enter Kenya to serve summonses and look for people here, no way," Mr. Moi said in a speech at an agricultural fair in Nairobi. "If any such characters come here, they will be arrested. We must respect ourselves. We must not be harassed."

Mr. Moi did not seem fazed by a statement from the office of the chief prosecutor, Judge Richard Goldstone, who said that such a move was "a breach of Kenya's obligations under international law, a matter for the Security Council of the United Nations."

Reuters reported today that Mr. Moi said, "Kenya is not a signatory to any haphazard process like the tribunal. We agree we are signatories when things are organized properly.

Mr. Moi's decision will seriously affect the prospect for peace in a region torn by ethnic strife, human rights officials and diplomats say. Kenya has benefited financially from wealthy and powerful Rwandans from the previous Government who fled to Kenya when war broke out, human rights officials said. Kenya, no friend to the new Rwandan Government, has also been the scene of some transactions to rearm militias who left Rwanda. Offering protection to fugitives from Rwanda could further undercut the long-term viability of the Rwandan Government.


It will also hamper Kenya's efforts to woo increasingly reluctant Western countries to provide the foreign aid that Kenya desperately needs. Western donors critical of Kenya's worsening human rights record and slowing economic and political reforms have either suspended aid or pegged it to tangible reforms.


In the past months, Mr. Moi has increasingly accused Western nations of meddling in African affairs, and of exploiting ethnic tensions.

"Look at the Simpson trial," Mr. Moi said today referring to the verdict of not guilty delivered Tuesday in the trial of O. J. Simpson. "It's shaken a superpower. The greatest nation on earth. A racial thing has set them back 50 years, and they talk about tribalism in Africa," he said.

The massacres in Rwanda began in April 1994 within hours of the death of Rwanda's President, Juvenal Habyarimana and Burundi's President, Cyprien Ntaryamira, when their plane was shot down near Kigali, the Rwandan capital. Most of the people slain in the following weeks were from the minority Tutsi ethnic group, but they also included moderate Hutu Government officials.

Human rights and United Nations officials said the massacres were organized by the Hutu military and militias whose aim was to exterminate the Tutsi and all opposition. In the ensuing civil war between the militias and the Tutsi rebels who ultimately took power, more than two million Hutu fled Rwanda. Today more than one million Hutu are still refugees. Many of the Rwandan civilian and military leaders who are accused by human rights officials of participating in the massacres fled to Zaire, Tanzania and Kenya. And a great deal of money that flowed out of Rwanda during the war came to Kenya.


Both the Rwandan Government and world powers agree that justice and bringing the guilty to trial must come before there can be any real reconciliation or any major return of refugees to their homelands. Financially strapped Rwanda still has no functioning judiciary system, but its prisons are overflowing with more than 52,000 people. The international tribunal has repeatedly delayed issuing indictments, but last month it said the first indictments would be issued in November and the trials would begin in Arusha, Tanzania.

Kenya's role is instrumental in the prosecution. About 10,000 Rwandan refugees, mostly Hutu, live here. Mr. Moi has close ties with the family of the former Rwandan President, Mr. Habyarimana, a Hutu, who helped create and organize the militias that later carried out the massacres, human rights officials say. The President's widow, Agathe, has a home in Nairobi and even recently traveled to China with Mr. Moi.

Mr. Moi said he would like an international investigation of the circumstances behind the crash that killed her husband.

A report by Human Rights Watch said that many of these former Government and military officials were buying weapons to resupply the former military in the refugee camps. Some of the financial deals were being carried out in Nairobi. It is unclear whether the Kenyan Government has any connection with these weapons deals, officials said.

The Kenyan Government has an antagonistic relationship with the present Tutsi-led Government in Kigali. Earlier this year, it expelled Rwanda's senior diplomat here.

Referring to Mr. Moi, Alison des Forges of Human Rights Watch/Africa, said: "He has shown his sympathies with the former members of the Rwandan Government since the beginning. The international community has been concerned with President Moi's human rights record. This will raise further concerns on his seriousness to his commitments to democracy."
