Please advise me on how to recover my unpaid pension of about 385,000 from my formal company, a private company

I worked with the company for 14months,and I was fired for misconduct because I don't take any shit from any bastard, I was duely engaged with engagement letter and equally disengaged with a discontinuation letter or sack letter boldly,

For the 14months I worked with them my pension was paid only twice but the deduction of 8% from my own side was steady, when I couldn't take it anymore, I enquired why the pension is not being paid and the accountant started forming big boy I wire him slap heavily and boom I was fired, after much trouble the accountant was also fired, after all one person no dey fight, two fighting two dismisal.

I have moved on and gotten another job which this new company is also paying my pension regularly on the same RSA

I wrote the company after two months requesting for my pension and they have not responded up till now.

Please can anyone advise me on how to go about the money.i learnt late payment or non payment of persons attractions 2% interest,

Op, is the company an indigenous one or owned by a foreigner? I asked cos most foreign companies are very sincere and they comply with the remission.
385k is a big cash in this Buhari regime. If this said amount is remitted promptly,it would have yielded closed to 500k cos interest who have catapulted it.
If i may ask, the 385k, is it with or without the addition of same amount from your former employer as enshrined in the 2004 act?

I have these suggestions for you:

1. If they have a workers union, involve them (the excos) to mediate on your behalf, at least u did not steal company property that is the only offence that can make you to forteit all.

2. Write the company, threaten them that you are going to report them to NPC, Nig pension commission. Their main function is to regulate the pension firms, they also have oversight function to discpline any employer of labour who refuse to comply with pension act 2004.

3. You can also threaten to sue them cos it's an act ... established by law of the land. You can approach one charge n bail lawyer who understands the pension act very well to help you put together some law jargons issuing like 7- day ultimatum which your statutory deduction must be remitted to your choiced pension firm

Hmmn, i kw it's going to be an indigenous comp. Nig disobeying nig laws. Most comp owned by foreigners don't have that gut.
This is one good legacy Obasanjo left behind. I benefitted greatly from it. Many new employees are afraid when they get their payslips and see pension deduction, they think it's a scam, but it's not.

It depends on the pension plan you have from your employer and when you became - or would have become - vested in the plan

I always advise people that one of the things you ask around for before taking an offer is to find out whether they remit pensions regularly.
Many employers especially small companies are very fraudulent, they deduct without remitting. And government is the greatest culprit, most government parastatals are not remitting pensions.

Op, get a lawyer to write to them for you and send a petition to pencom attaching the demand letter and evidence of the deductions.

OP so they havent paid your pension contribution to your PFA or what? if thats the case i dont think they are going to give you a dime....

You don't recover pension, and beside your formal company and present company doesn't have hand or power over your pension RSA.

Write a petition to the Nigerian Pension Commission reporting the company and copying your Pension Fund Administrator. Make sure you attach evidence of pension deduction from your salary i.e payslip, by your former company.

Alternatively you can get a lawyer to threaten to report them to the Pension Commission if they dont regularize your pension payments.

That said, trading blows in a corporate environment isnt good for your credentials. Learn to manage conflict better without compromising your stance.

Get a competent lawyer, let him write the company and copy PENCom. You will be credited to your RSA which you can only access when you attain age 50.... best of luck

I beg to differ on the fact he doesn’t need a lawyer. The PFA may write to his former company but a lawyer is needed to diligently follow up with the case. There are many of such cases and the case managers of the PFA’s are often overwhelmed, attaching no preference to any case file.

I would advice seek a good lawyer versatile in employment/labour matters and he or she can see your case through.

Attach the letter you have written to you former company and write a letter to PENCOM. Copy your PFA too in the letter. If you can get a copy of your letter also send to their compliance unit. After 2 weeks if you do not get a reply or acknowledgement send a reminder again and copy all. Put your former company in copy too of the letters you're sending out. They will credit your account through your PFA if the owners or leadership know what they are doing. PENCOM compliance unit is a no nonesence unit. Your former company will pay penalty too for late remittances. If you need help constructing the letter. Get in touch. I will do it for you FOC.

Is the Company in Nigeria or RSA which of them is the company located

Get a lawyer to write them a letter with ultimatum, if they still love that company they would pay instantly

Dear Sambright2012, I will advise you to report them to an human right organisation, who will help you to petition them to Alagbon for financial crime (make Alagbon officers first chop dia money ).
After that you engage a lawyer to write them, demanding for evidence of you pension remittance and if no evidence you now petition them to PENCOM.

Send them an email and copy the complaints email of the pensions board, they will sharply pay up

For young people out there listen...never get in a fight with anyone whose ever offered you a job!! It's not worth it.

@OP, when u get older, u will realise that the road to the top is littered with nonsense and only those who can stoop so low to take nonsense will last at the top.

385k will not make you a millionaire not a billionaire anytime soon and since ur current firm is remitting ur pension, I will advice you to take the positives if any from your experience and move on because you never get ahead looking back.
PS. I resigned in 2017 from a job, about 900k had not been remitted even till date to my RSA from that firm. But it's not stopped me from going on since then to become what I aspired.
I know how u feel... BUT learn the lesson and move on; that's what experiences are made for

Why did u slap d accountant thereby causing him his Job in retaliation.

You have a case regarding you pension and I wanted to side you but for what u did to the accountant I hope u don't get any penny back
