It's very dangerous especially if the person u are standing as a referee is not trustworthy. If the person commits crime and runs away, u will be held responsible, pay his/her or the debt or be punished for his or her crime.
I believe you are referring to a guarantor. A referee has no legal obligation. He's just someone that can be called to confirm whatever the candidate wrote in his resume.

A referee is a person who can recommend the person who you are considering hiring for the particular role. Thier job is to vouch for the qualifications or characters the candidate claims to have. A referee is typically for former teacher (for freshman grads), a former boss/supervisor or a well known person in the same field. Typically, you only need to supply thier contact details.

A guarantor is someone who offers a guarantee or a promise of certainty that if the person you hired doesn’t turn out to be who they have posed to be, they will bear fully the liability or partially (depending on the agreement) resulting from it. Typically, it is advised that a guarantor is someone who has known and is very familiar with the candidate for a certain period of time. This can be anyone (even family members). The guarantor must be comfortable with giving out personal information (sometimes, bank account details).

So you see, they play different roles and only certain kinds of organizations ask for guarantors. Some organizations (mostly financial and government organizations) don't accept the same person as a guarantor and referee). Finally, there's always a text before the guarantor's signature that gives a full detail of what he's signing while the referee doesn't have that.

There is no ado here. A referee is different from a guarantor except where the referee chooses to be both. In order word you can be a referee without being a guarantor. @Op, if you feel insecure about what the person's character could turn out in the future which could cost you your job, then you can limit yourself to been his referee based on past record of interactions. That way you free yourself from all likely future entanglement, only a guarantor is under legal obligation.

No they don't. I just gave you the difference. If they were the same thing, financial institutions wouldn't be asking for both and even insist the same person shouldn't be used for both roles. A few examples below:

1) Do you have a domicillary account with GT bank? Well, take a look at the form, you'd see both roles are required and the requirement is that only someone that has a dorm account with the bank can act as a guarantor.

2) Have you ever posed as a guarantor or referee for someone who got a banking job? Well, I have been asked to do both in the past and the requirement was that I must submit something called BVN to be accepted as a guarantor. I ended up posing as the referee instead.

3) Have you ever been asked to be a referee or a guarantor for someone applying for citizenship? I have and again, the requirements are different.

Finally, you have Google. But if you just want to keep repeating "they are the same!" it's fine. I just needed to clarify that for the OP and others reading the thread.

If you know the person and can vouch for him/her, why not? Who else can be a better referee for your office than you who knows the person personally and believe he will be an asset to the organisation.

Why i said they are the same is because without providing them, u won't be employed. The management would call them call to know things abt u and to ensure the person they are employing is trustworthy.

You seem to have forgotten what led to this chat. You said the person would be held responsible if the employee commits a crime.

And I said that only applies to a guarantor, not a referee cause a referee has no legal obligation. So it wasn't a matter of whether they'd be called or not. I only wanted to correct the misconception that a referee would be held accountable in case of professional misconduct or misrepresentation ok the employee's part. If I taught you in school and you were a good student, I could be your referee based on that alone, but that's not enough to be your guarantor except I'm also ready to bear the consequences of your actions.
