I made a post about a month ago on Nairaland about my landlord. He gave me a quit notice when my rent is yet to due, we have not been in good terms, I was rest assured that I still have three months left so no need to panic.

I got home now and saw carpenters removing the roof of my apartment with two abled young men which I haven't seen their face before, the roof of my apartment has been removed now.

I went to the nearby station to lodge a complain but I was told the man had come earlier, and told the police has giving me quit notice that he wants to renovate his house.

It's really a hard time for me and my siblings, getting a quick accomodation. He never informed us of renovating the apartment, I just lost my job last week and this is happening to me again.

My life is in a mess right now as I don't know where to start from, this is just a challenge for me and I will stay stronger and fight this battle till the end, probably God is preparing me for a better place ahead....

Meanwhile. You should snap pictures of the house... Have details of your landlord.. And see how this will be resolved..

Is this your room? Is this one roof? So you opened your door and they came inside to remove the ceiling because I don't understand this picture. To be honest, you're only trying to garner sympathy with your post and maybe some cash as well because this your stories nor make sense again.

I can assure you that if he provides a receipt showing payment and the tenancy agreement he signed with the landlord, everyone will support him.

As long as he continues to be evasive, he sure will look more of a scammer.

There's no how he won't be able to snap a freshly removed zinc and people will not be able to identify it.

That's what they've been telling him in layman terms since yesterday but he didn't think through when he was formulating the idea to scam us.

The court cannot go against the tenancy agreement both of them signed because it is binding.

We've earlier asked him to provide his last payment receipt and include the tenancy agreement to know if the landlord is at fault or not but he hasn't done that.

See this is a one sided story and if he is able to provide those documents we requested, even everybody against him now will jump to his train.

I understand the one-sided story possibility though. If you read my previous responses, I mentioned that possibility. My words bitterness against the landlord is only valid of the guy has paid his dues and the landlord and police are treating him this way.

There is a clause in the tenancy law that makes the tenancy agreement supercede the other duration of either 6 or 3 months eviction notice to be given.

Where no such rule of duration is included in the tenancy agreement, that's where the law on duration comes into play.

Go over the tenancy law again and come back.

I don't need to review any tenancy law. It is basic that any landlord can only evict after the court has granted an order or judgement to that effect. You have no right to self help as a landlord. Under the right to property, the tenant who is in possession has a right over the landlord. While the landlord has ownership rights, the tenant has possession rights and possession is 9/10th of the law. I hope you know that a landlord can become a trespasser on his property let out to a tenant. Go and read a bit of legal jurisprudence before you start standing the law on its head. I don't comment for likes, I say it the way I know it to be. I also don't dabble into what I know nothing about

RIGHT TO A VALID QUIT NOTICE
A tenant cannot be thrown out of his apartment unless there is a strict compliance by the landlord with relevant Recovery of Premises Law.

Recovery of Premises Law provides that a valid “quit notice” of a landlord’s intention to terminate/quit the tenancy of the tenant must be written and served to the tenant. The amount of time given to the tenant, whether weekly, monthly, yearly, depends on his rent. Thus it is advised that a tenant thoroughly read through the Tenancy Agreement before signing as some might even sign away their rights for a ‘quit notice’. Remember, ignorance is not an excuse in law.

If you look at the bolded words above, you'd see the recourse to tenancy agreement being the determining factor in the duration of a quit notice and that is what I'm making reference to.

A tenancy agreement cannot give the landlord the rights to forcefully eject a tenant. Even if there was a tenancy agreement, the its still courts will eject the tenant.

What the landlord is alleged to have done is a criminal offence.

We are not talking about tenancy law or quit notice, we are talking about forceful eviction. To tenancy agreement can allow forceful eviction. You cannot sign away your rights to legal eviction. If such is in the tenancy agreement, then it is illegal ab initio according to learned people.
