The political appointee must have resigned before he can be voted for….which means they must ALL have left their jobs before the dates of the Convention or Primaries!
a political office holder may not actually resign if he wouldn't be involved in the convention

Convention and primaries aren't the same date, so he can go resign in primaries if he wants to partake

According to the section 84(10) of the new Electoral act recently signed into law, act which any government appointee interested in contesting or voting for any candidate in Party primaries must resign their positions 3 months ahead of such primary elections.

Now according to the recently released INEC time table. Political partiers have between April 4 to June 3, 2022 to conduct their primaries and ensure resolution of disputes from the exercise.

It means, going by the above provisions in the act and INEC time table, any government appointe who may be interested to participate in his or her party primaries and didnt resign by at least March 3rd, 2020 stands disqualified..

You are aware the act contravenes the constitution, it'll be challenged in supreme court and nullified.

I don't know why legislators are always trying to introduce self service bills and making endless attempts to legislate the constitution.

Very ridiculous. They have become so paranoid about contests that they're doing everything to amper others

All of these you have stated especially about APC meaning well for the country by signing the Electoral Act into law along with this section under discourse would have made a lot of sense only if they didn't already try to get it expunged from the Act.

Are you not aware that the'presidency' already sent a bill to the NASS seeking an amendment to delete Section 84(10) which the NASS still entertained despite a subsisting court order barred them from doing so?

If the Senators hadn't voted against that amendment just yesterday, that section would have already been in the process of getting removed and it is clearly not over yet because even the government may file an action in court challenging the legality or otherwise of that provision.

Before you start hustling for praise to be given to APC, understand that they are already clearly acting like they scored an own goal hence all this scrambling.

Was the resignation done secretly? You can be sure that evidence of him still carrying out the functions or enjoying benefits of minister after that back-dated resignation will be swiftly tendered to counter any purpoted resignation.

Yes, but not 3 months before the convention as alleged by op. You can resign a day before the primary.

No be small own goal, even those appointees who are going to be delegates in the primaries are also ajjected. That includes commissioners, SAs, PAs, Supervisory Councillor's in Local government etc
The court cases that will mar this election and nullify many primaries will bring serious anarchy.

What do you mean by saying it contravenes the Constitution? Wasn't government appointees resigning previously before contesting for elections? Didn't Wike and Co resign as ministers under former President GEJ to contest for the elections?

My own question is what does the constitution say regarding the eligibility of contestants in any primary election? Because the constitution always supersedes any act.. I think that’s the loophole the candidates will explore.
