Mr Funny aka Sabinus, a Nigerian comedian, is planning to sue Peak Milk for 1 billion Naira and Gala for 100 million Naira for utilizing his intellectual property without his permission.


The comedian disclosed in a statement made by his legal team that the two corporations utilized his image and content in advertisements and promotions for their products. All of this is taking place without his knowledge or permission.

The Gala Company (UAC Food LTD) created an animated image of their client to promote their business, and it received a lot of attention.

Sabinus and his legal team are preparing to sue Peak Milk for one billion naira and Gala for one hundred million naira (DETAIL)

Peak Milk Company (Friesland Foods Wamco Nigeria PLC), on the other hand, utilized the trademarked tagline “Something Hooge” to advertise and promote its Peal Milk product.

The legal team urged them not to use anything belonging to Sabinus without his agreement or authority while demanding 1 billion naira and 100 million naira from Peak Milk and Gala Company, respectively.

They gave the two corporations a 14-day deadline to comply with their demands. If you don’t cooperate, we’ll take you to court to seek justice for intellectual property theft and infringement of our client’s intellectual property rights.

The only basis that could help him make sense is if he had trademarked it before Peak Milk's usage. Otherwise, his lawyers are just stunting.


Modified: I see he trademarked the phrase. But lawyers know that you don't "trademark" anything that isn't related to concrete goods or products. The phrase, at best, is related to his comedy brand. It's not tied to any concrete product (that's being sold and/or bought). The copyright/trademark registration would thus be null and void. He lucidly has very little chances...

You know... you didn't have to insult. You could make your point reasonably without needless insults.

Even at the registration, a copyright of the phrase is likely null and void, given that it isn't directly connected to any concrete product he sells or intends to sell. Copyright laws are only valid to the extent to which they relate to concrete products. Such a copyright registration would, in this case, be invalid.

What he has is an acceptance of application. After this, it will still be advertised in the newspaper before being published in the trademark journal.
You can get an Acceptance letter and your application will still be denied if the objection to it is valid and upheld.

Even if they didn't use the word "huge" I fail to see how he can justify this in court. For the Gala case his image was used albeit a cartoon usage so he may have a case there
