Peacecore:Now let me get into the meat of the case. 1. Anywhere you see election in the Electoral Act, in this context, refers to the (general) election. The Courts have long decided this. What takes place in political parties is Primaries, so there is nothing like 2. I have taken time to x-ray Sections 29(1), (5) and (6). 29(5) speaks about an aspirant in the Primaries of that Political Party. 29(6) speaks about Candidate in an election. There is a world of difference between an aspirant and a Candidate in an election. An aspirant is a person with a strong desire to achieve a position of importance or to win a competition (SC in PDP v Sylva). A Candidate is one presented by the Party to be so elected. So (5) and (6) are mutually exclusive. Look at the second part of (6): ...and then declare the candidate with the second highest number of valid votes and who satisfies the constitutional requirement as the winner of the election. "and" is a co-ordinating conjunction.... -'So who is the candidate with the second highest number of valid votes that the Judge should now pronounce as winner of the election since you subscribe to the first part of that paragraph? -So how will the Act speak of disqualifying the Sponsoring political party then announcing the Candidate with the second highest votes when no election (in the true sense of it) has been conducted. This is my interpretation of that section: We have situations were pre-election matters run in and elections are conducted like in PDP v Degi and Marafa v APC. That is what (6) is talking about. (5) speaks about the interim, what is happening now..... I asked garfield1 a question he hasn't answered up till now, I will like to ask same to you: If Tinubu is disqualified today on the basis of Certificate, I mean today, who is the beneficiary? garfield1 knows it is Amaechi but doesn't want to say so because it stands on all fours with this case. S33 is not a new provision. It was in the old Electoral Act as S33 (voluntary withdrawal or death).... It did not bar the SC in Saleh v Abah, and was not brought up in this case hence the higher Courts won't touch it. It is now DEAD. What the Courts want to look into is who is the PDP Candidate? My personal take in all of this is: One, Oborevwori does not have a complete nomination. Nomination of Guber Candidates can only be complete when they have a Deputy and properly submitted to INEC. The window is still open. Two, Oborevwori has been disqualified... PDP submits the name of the man who came second. That's the only way out! In all of this, the PDP and Okowa have the yam and the knife. Again, I referenced those names because the APC have no candidate for now. It is empty, both in Yobe, AKS and Edo PDP. Will you now say APC, PDP are disqualified? The Court will only say Akpabio, Lawan are disqualified... that's the reference. If I use your analogy, can you put something on nothing? APC submitted names of people who did not even pick form for a position, does that not contravene Sections 84 and 33? Are you saying if Machina challenges same, the Court will now rule that APC is disqualified? no. The Court will say Lawan is not the Candidate. |

garfield1:How? It is not the party that was disqualified. Either the party is allowed to conduct another primary to replace him, or he withdraws and the party sends a replacement. Elections have not held so you can't stop PDP from having a candidate in an election that's yet to hold except if the court expressly says so |
