SmartyPants:Threat to life? that's is even enshrined in the fundamental human right Article 2, read it up NB, if we were a Gun carrying country and someone threaten to blast you and they are armed you reserved the right to shoot them citing you felt fear for your life |

erico2k2:When you're charged for assault, it is the evidence of such charges that is required to nail you. There is no justification for violence especially on an officer. Let me ask you, what else are you looking for in the video? That the policeman say he was going to shoot her? Even if you find that part, you need to know a serious crime has been committed already. The police can even claim he said so to scare her when she became violent and aggressive but that doesn't even matter because that wouldn't be why they are in court. If she feels offended by what the officer said, she would have to file her own case in court. |

erico2k2:Not disputing that, witness summons are served when necessary. The fact that you came into Nigeria, according to you, to stand as a witness would entail a personal or official related matter. The video posted is an unplanned event. My stance is, how many people from the footage would want to leave their individual activities to go to court, knowing the time crunching scenario. For them to be legit witnesses, the have to accompany the Auntie to the police station, where the will make statements as witnesses to Auntie. The question is, how many folks would wanna sacrifice this time for who is not related to them? |

oladipuposadeeq:Lmao. Ko le to gbogbo eleyi, sir. If you think altercations are complex, why did you not give the same excuse for this lady? Should a man remain calm when a lady insults him - yes or no? Because these are your words. You said the lady ought to have remained calm and not attack him. So do you believe a man should remain calm too if a lady insults or threaten him in any way? |

udomma1005:Bro you taking it the wrong way, DO they have to be there? This is what I meant by plucking witnesses from thine air! The only way for the police to eliminate that possibility is to take Arial clip at the time of the event which I'm sure they did not! If I say I am there and you say I am not there its ur word against mine, however if I can give a good account of the event of the day plus add some of yours to my benefit I would have proven beyond reasonable doubt that I was there, You gerit? These will form what they call Agreed facts in Law. |

SmartyPants:Article 2: Right to life 1. Everyone’s right to life shall be protected by law. No one shall be deprived of his life intentionally save in the execution of a sentence of a court following his conviction of a crime for which the penalty is provided by law. 2. Deprivation of life shall not be regarded as inflicted in contravention of this Article when it results from the use of force which is no more than absolutely necessary: in defence of any person from unlawful violence in order to effect a lawful arrest or to prevent the escape of a person lawfully detained, and in action lawfully taken for the purpose of quelling a riot or insurrection. |

erico2k2:I'm calming down bro You said tugging on the Uniform is not an assault, if I may ask, what charge is admissible in this instance I can't state that she's been arrested but common sense will vindicate us to assume that she will be certainly taken into custody since video has gone viral. |

egunna:Whipped dog! What do you know about morals ![]() Mumu supporter of police brutality. Soon the evil you support will end you. Buffoons like you is why Nigerians can't even feel free in their own country. I bet you're one of those idiots who supported the shooting of unarmed protesters during Endsars. Moronic citizens who have no clue what human rights entail. Your whole education, which I doubt you underwent anyway, is a big joke. Totally useless! Again, the evil you support will be the end of you. |

erico2k2:I don't gerit! But this is my playground sire, so I know my stance. As I state now, prove me wrong with substantiate authority, in criminal cases heard in courts here, all witnesses that wish to give evidence in connection to the case at hand, in court, must make statements to the police either as prosecution witnesses or defence witnesses. Nobody bounces into the court room to testify as a witness! |

oladipuposadeeq: No. Not satisfactorily. I did not mention physical contact so it wasn't necessary for you to mention that. Let's try again.Should a man remain calm if a lady insults or threaten him?

erico2k2:My question is, what is the name of the instrument you are quoting? Also, can you distinguish between a mere threat to harm you, which at law is mere assault and carries little to no punishment, and an attempt to actually harm you, which at law is battery and carries a stiff penalty? Have yoh also ascertained the veracity of the assertion that he said he would gun her down? Have you also questioned what would make a poloce man randomly threaten to use his gun? Was he acting in self defence? These are the real legal issues. Don't quote laws you don't understand. |
