In the country where I live, the law is anything that grows into your yard over the fence, you have the right to cut it down without the owners permission.

You are never the owner as the tree is not in your compound and it can be proven that when the banana was younger you bent the tree towards your compound which translates to coded stealing let the owner who planted come to harvest it at the due time and you will get your share of it.

No, you're not the owner but if your neighbour is a good person, he'll share the harvest with you.
It needed the space that your compound provide to thrive.

you can actually cut it but you don't have to though. If you cut it nothing will happen. It's weed as far as you are concerned. You didn't plant it, the owner can't enter your compound to cut it by force but you don't have to do all that

Thank you oga lawyer. Luckily I took property law in school. Anything below and above a land belongs to the owner of the land. The person that planted the banana should have taken measures that his tree does not encroach on another person's land. In the alternative he should pay rent on the space accepted by his tree on another person's land.
