The buyer must also have a surveyor who should chart the said landed property, overlaying on the Lagos base map to confirm if such falls within the allocated places for residential, commercial, Industrial or Government use. The role of surveyors in acquiring properties is also very important along side your lawyer

If you are a Lawyer - you have just broken one of the most important rules in the RPC - NEVER ADVERTISE OR SOLICIT!

You could have made this article without alluding to yourself. But you will likely get away with this as the NBA doesn’t even enforce its own rules as it should.

Show us where the law or the Rpc said lawyers cannot write educative articles. Tell us

Go and report him to the lawyers Bar committee or whatever your disciplinary body is called.

How do u verify the one gotten through inheritance having in mind that most times these land are shared after the demise of the owner ?

Inheritance lands can be verified either through a Will or a Letter of administration showing who the new beneficiaries of the land are. If there is no will or letter of administration, it can be verified through local knowledge of all the interested parties connected with the land confirming ownership of the land verbally.

For example in Yoruba lands, everyone is entitled to their own portion of land individually and covered under the general family name. You could have 20 plots of land belonging to a Balogun Family and 3 plots could belong to Kunle, 5 plots to Segun, 2 Plots to Nike, 4 Plots to Kamoru, 1 Plot to Gbenga, 2 Plots to Demola, and 3 Plots to Afeez.

All these 20 plots belong to the Balogun Family and each member has their own individual number of plots allocated to them and every member of the family knows the location of each other's land and the amount of land they own.

If Segun now decides to sell 2 out of his 5 plots allocated to him, all the other family members must be in the know that 2 out of his lands are going to be sold to a stranger so that there won't be any issues tomorrow.

Segun is not obliged to share money with them but he must inform them and in most situations to give comfort to the new buyer of Segun's lands, all the remaining members of the Balogun family would act as signatories to sign the deed of assignment for the new buyer to ratify the transaction,

These are some of the little steps one can take to verify a land if there is no existing paper work or inheritance. smiley

Rule 39 of Rules of Professional Conduct (RPC), 2007 provides that it is unprofessional for a lawyer to solicit professional employment directly or indirectly by circulars, advertisement for professional employment such as furnishing or inspiring newspaper comments or procuring his photograph to be published


So advising people on how to avoid being scammed when they intend to purchase a parcel of land is soliciting legal work? Would it have been different if i wrote an article advising people to verify the car papers of a vehicle they intend to buy or if i was advising people to purchase cryptocurrency but to be vigilant before they buy it? Did you see anything in my article soliciting for clients to bring their land cases of trespass, misrepresentation or breach of contract to me to file a suit against the defendants in court for money? Did you see anything in the article soliciting for legal jobs.

What if I wasn't a lawyer, am I not entitled to advise people on the pros and cons of purchasing property so they won't get scammed? Or are you happy that someone should be scammed for millions of Naira without being informed on what next to do?

What of Lawyers and Legal Professors that write books on law and give tips and advice on what to do from taxation law to criminal law and put their phone numbers to contact them? Do you have any grouse with them?

I would advise you to also write an article to teach people the pros and cons of what you are good at to help people save their money and we can also contact you to help us instead of getting angry for no reason. This life is too short. Be another person's brother's keeper. Expose your talent and make the world a better place. smiley

Mathew longtime. Happy new year, information reaching me from insider in Alausa that surveyor can filed any land acquisition, or non-acquisition land with red copy now. The responsibility as being shift to land information search to write on there search in land information office if the land is under acquisition or not in there finding . How true is this information?

Learned counsel please continue your good work. Even all the top firms routinely publish educational articles with the names of their counsel on it.

Don't mind all these internet lawyers that learned law from watching Suits and other TV series.

Section 46(1) states that a lawyer may write articles for publication. Go and read it to educate yourself with its provisions.
