I have read it already. I repeat again the bone of contention in Osun is 749 polling units were BVAS was not deployed and hereby declared null and void due to overvoting. 749 out of 3k 700 units were BVAS was not deployed are under dispute. Electronic system makes no room for overvoting or vote duplicity.
Electronic system should be deployed to the 749 poll stations for a rerun . PERIOD!

That is where over voting occurred. Team oyetola insists on total disregard of the 749 polling units where BVAS was not deployed and overvoting occurred

BVAS was not used by a few voters in the 749 polling units, not all the voters in the 749 polling units, that was what brought about over voting(invalid votes) in those polling units.

Who knows maybe the multiple votes were planted by APC.Are they trying to say that the polling booths where APC won didn't have multiple votings as well?We know how APC rigged the last governorship election in osun state that brought in oyetola.When collations of votes were going against him their thugs scuttled the election and asked for a rerun which was massively rigged through incidence forms.Oyetola was eventually declared the winner.

Then, the race began in earnest for three years now, reaching a frenzy with the works of the two PDP committees on zoning. The first was the Gov Ifeanyi Ugwuanyi committee on the zoning of the PDP party offices. The Ugwuanyi committee quickly told the world the committee’s assignment did not cover zoning the office of the president. Though this was true, the question is: why didn’t the Ugwuanyi committee zone the PDP chairmanship to the North without aligning it to the divide that would produce the PDP presidential flag-bearer? The second committee headed by Gov Samuel Ortom of Benue state was specifically on the zoning of the presidential ticket and, with the votes of the representatives of all the 17 Southern states without any exception, the Committee unanimously recommended throwing open the PDP presidential ticket, which the PDP NEC simply upheld.

One thing irrefutably stands out – Wike shot himself in the leg. Here was a man who had an overarching influence on both committees but could not insist that the ticket be zoned South. Many had wondered why? The reason is also relatively in plain sight: the Southeast factor. As the clamour for zoning of the presidential ticket of the PDP to South reached its crescendo, many had pointed out the fact that though the PDP Constitution had prescribed zoning of the office of the president to be between North and South since the South-west and South-south had taken their turns in producing the president and the vice in this current dispensation in the persons of Olusegun Obasanjo and Goodluck Jonathan, zoning this time around, should not just be to the South but the Southeast.

Atiku Abubakar went a step further by offering to step down from the race if it would be agreed that the touted zoning to the South would mean micro-zoning to the Southeast. Wike and the rest could not take the Atiku challenge maybe because Atiku would likely back Peter Obi, who was his vice-presidential running mate in 2019 and an ally. The prospects of Peter Obi picking the ticket if PDP zoned South was so real compelling Wike to go for an open contest, believing he could pick it up ahead of Atiku, Tambuwal and Bala Mohammed, given his large war chest.

.They said over voting which means the votes were tampered with. How sure are you that Adeleke should even be second in the election that was rigged? This was the reason Buhari rejected electronic voting in 2019 because he knew a party that has invested in and ruled Nigeria through rigging him out many times in the past. If I were the judge, I will jail anyone trying to force himself to rule over people who didn't believe in him by rigging himself to win.

If there were actually 353 Accredited Voters on the BVAS inside a polling-unit.


But the INEC Officials in the PO recorded 362 Accredited Voters and 359 total voters in the results-sheet.

And then,, APC Got 165 Votes..
PDP Got 169 Votes...
All the other parties together got 23 Votes.
2 votes were rejected as Void..


Now, if you check the details well, you can see that there is “Over-voting” in the Polling-unit with 6-votes.


So,, if we are to deduct those 6-votes,, tell me how we are going to deduct them.


Use the above example that I have already given.

8.) At the Tribunal, each party strove to prove which BVAS was credible and which was not.

How exactly do you detect the over votes? You realize that there's are no names on the ballot. And which party do you want to remove the over votes from?

Do you understand? It's impossible to detect which ballot was not accredited. The best thing is to cancel.

Do you understand? It's impossible to detect which ballot was not accredited. The best thing is to cancel.
Number of over was detected using the BVAS, so it doensg matter the party involved, just deduct the over votes and count the valid ones...

Now,, let it be that you were one of the Tribunal Judges.
And this same situation came up.
(Just like in Osun Election Tribunal)..
You were not there in the field where they conducted the election.
You were just a Tribunal Judge.
Use that same magic of yours to determine the number of over-voting that went to each of the parties, and deduct them accordingly.

After finding out the method used for the judgement on the election tribunal that gave victory to Oyetola over Adeleke, I would say it is a recipe for disaster, the method applied was cancelling all the votes of a polling unit because of over voting in that particular polling unit.


The questions I ask are:

1. As it happened that there were over voting in various polling units in the Osun election, what if each opposition connives to perpetrate over voting in polling units in each opposition strong holds?

2. What then is the use for BVAS in over voting if after the BVAS is able to identify the number of over votes only to end up cancelling all votes(valid) and over votes(invalid) ? That is like throwing away a baby with the bath water.

3. If there is an election tribunal like this and a rerun takes place, what if the same over voting keeps occurring over and over, would they keep repeating the election tribunal process and back to rerun again?

In my opinion, the law is just an error or a purposeful scheme to rig an election using what I call reverse voting
Just simply tamper with your opposition strong holds and invalidate their votes, So we might be having a case where a carefully selected and protected minority will determine winners of an election instead of the majority carrying the votes.


Implications:

1. It will make elections become very dirty because politicians will be all about scheming to invalidate votes in opposition strong holds.

2. It will make the voters lose confidence in the electoral process, because a voter will not be sure if his vote will be invalidated or not by someone else scheming with a politician in his/her polling unit.

3. It will make voters wear out easily and may cause voter apathy when you have reruns after stressful elections, thereby reducing voters turn-up in reruns.

4. It may not reflect the true will of the people and also reduce the total number of voter participation, just like the Osun election tribunal, the total number of votes cast for both PDP and APC after the cancellation doesn't reflect the true will of the people to declare Oyetola the winner.

5. Elections will cost more because of Tribunal, reruns and time wasting.

6. It could lead to anarchy and total chaos, like in some volatile states in the north where they riot over political results, just imagine after election and INEC says they have cancelled over 20,000 polling units across the north which were all stronghold of a particular candidate, because of over voting of less than 2000 voters, imagine what will happen in the aftermath of such news.

Solution:

In situations of over voting, Why not just deduct the invalid votes(over votes) and count the rest, the BVAS already identifies the number of over votes(invalid votes), doing so, INEC will avoid a lot of election tribunals, scheming by politicians, reduce cost of doing reruns, make more accurate results, increase voters confidence, reduce time wasting, reflect the true will of the people and avoid anarchy.

The judgement is like saying that if a passenger from a particular plane was caught with an invalid passport then you should deport the entire passengers that came with him in the plane, that we are not sure about all the passengers, does it make any sense if you can simply remove the affected passenger and deport and allow the rest go in, if such happens to you in the airport and you were deported because of a particular passenger or a few passengers even if there is a law in that country for it, won't you see it as an erroneous law?, how would you feel, so you just wasted your time money and resources and did not still achieve your aim because of another person or people.

that is just the same thing here....

Including those people who tested them after they landed.
And all those who came in contact with them.



So,, bring up another scenario.
Quarantine is different from deportation, deportation is total cancellation, quarantine is to hold, do proper treatment and then release, that is still he same thing I am saying, quarantine the entire polling units affected do the deductions(treatment and inspection) and release the valid ones( non infected) and then you can deport the ones that are infected, you will not just deport everybody.

If you opened it and counted 325 fruits altogether, how would you know which of the fruits exactly were in excess of what the person originally sent??

(You don't know these answers.. all you know is that there were 25 extra fruits)

Thus, you don't have to disenfranchise the wrong party by deducting wrongly from them.

I agree that the punishment is huge..
But then also, the punishment also gives people the excess powers to join INEC and all the stakeholders involved in avoiding its occurrence.

Quarantine is different from deportation, deportation is total cancellation, quarantine is to hold, do proper treatment and then release, that is still he same thing I am saying, quarantine the entire polling units affected do the deductions(treatment and inspection) and release the valid ones( non infected) and then you can deport the ones that are infected, you will not just deport everybody.
You have not experienced an isolated quarantine in an isolated facility.

Secondly, nothing prevents the country from deporting all of them, if the country got to know that they all actually tested negative in their country before leaving.

This is not a deadly virus disease, this is an election, that is why I asked, do you know if the INEC official in your polling unit is already compromised, so is it the voters fault in the polling unit, why make people's efforts waste in things they have no control over....

This Election is a do-or-die affair.
It's even more serious than a deadly virus disease.
It is the people at a polling-unit that would always allow the INEC Official to do nonsense, being that they themselves wanted such manipulations to happen.

But in a situation where they don't want any manipulations, and the INEC Official tries to do any nonsense, that is suicidal on the part of the INEC Official.

INEC on the other part should warn politicians to desist from over-voting, since they would be doing themselves more harm than good by involving in such.

The people have control over it.
And it's very simple.
Don't let over-voting to occur.
In fact, guard against it.
