25% Votes In 2/3 Of All The States And The FCT: What Is The Spirit Of The Law? by EmeeNaka: 8:43pm On Feb 28, 2023 |
Since the discussion of Bola Ahmed Tinubu not meeting the 25% of the votes in Abuja became a subject matter, I begin to wonder what exactly the law says and why. We need to give meaning to whatever we think about the situation. The truth is, whatever decision INEC will take will be done with regards to the spirit of the law and not the letters of the Law. The spirit of the law is the Justice and that's what Supreme court will use in deciding any issue that may arise in the problem. Why does any Political party need to get 25% in Abuja? What is it about Abuja that makes it imperative for a Presidential Aspirants to get 25% votes in Abuja? If there is nothing special about Abuja and it's just a state in Nigeria with no special status, then I doubt it will make sense to expect 25% in Abuja before a presidential aspirant is declared Winner. 1 Like 1 Share |

Abuja is not a state, having 25% in Abuja is a plus but not Mandatory as long as you can get it elsewhere Moreover, why should getting 25% a must? What's special about Abuja? 3 Likes 1 Share |

helinues:that is the question begging for answer. If by law, there is nothing special about Abuja, then getting 25% in Abuja can't be mandatory even if it looks like that in constitution. 1 Like 1 Share |

As the name implies "Federal Capital Territory" a.k.a The Center of Unity. Being the melting pot of all the States/citizens of the Federation, it only makes sense that anyone who intends to superintend over the country should be able to garner the support of at least 25% of the mini-Nigeria (F.C.T) and in my opinion, this clause was well intended and finely drafted. This goes for those asking about "what's so special about FCT". 3 Likes 1 Share |

helinues:He is correct bros but there is a problem with that law. The law needs amendment after election. I feel it's not fair that someone will win all the state and because the person fails in Abuja the person shouldn't be declare winner. I'ts just like the USA electoral college. If you like get 1 billion votes, if you don't win some states you go loose. 1 Like |

Tinubu needs at Least 25% of votes in at least 24 states and the FCT. If the 25% of votes from the FCT wasn't a necessity as it could be gotten from another state, it would not be mentioned. The FCT is not a state but the Federal Capital Territory with a different form of administration from the state. Tinubu did not get the 25% required from there so there's most likely going to be a rerun. |
