Why is APC and Tinubu scared of turning up for the petitions if they are sure they wouldn't be debated out of the courts through Obi's lawyer to the judge's no option?

For fairness, this case shouldn't be struck out. Let's see the court proceedings unfold and learn if Tinubu is good to go or not.

At least, this will help fix once and for all Tinubu's for ever defended identity.

Tinubu was required to respond to the suit and not institute a suit.

Where is Tinubu's response to the petition? Tinubu and INEC are defendants.
God bless you, this Agbado guys don't think well at, they should counter the petition Obi laid against them rather they are trying to stall to buy more time, I don't even see how ApC will win this when they are not in labour party.

Maybe that's why they installed Lamidi Apapa has a fake LP chairman, they did that to cause disarray so Lamidi can perhaps file a petition against Obi because of not being a party member within 30days. APC is just wasting their time. The rubbish counter petition only concerns LP members to file.

Oga only LP is eligible to file this kind of petition, is APC now LP? APC doesn't have that right to file a petition against Obi because of a 30 day window of cross carpeting or whatever.

What section of the electoral act?

It means you did not read the preliminary objection raised on the very post we are all comenting on.

Section 77, Sub section 1, 2 and 3.

But Subsection 3 is the killer.

If you don't understand it, we can explain further only if you are open-minded.

APC did not file petition but responded to Obi's petition.
In her response, he can challenge grounds the petitioner raised.

Uncle, can we use Coca-Cola bottles cork cover to count these numbers?

How's 180 days equal to 3 months.

60 secs = 1 min
60 mins = 1 hour
24 hours = 1 day
7 days = 1 week
4 weeks = 1month.

7×4 = 28 days
28 days = 1 month.
Note that some months are 30 or 31 days.

Averagely, if we take a month to be 30 days, 180/30=6.

Therefore, 180days = 6months.
QED.
Common sense should tell you that the three months I put there is in reference to the period between the election and the swearing-in date. That's Feb to May.

Does the electoral act mention waiver?
Parties give waiver to members who joined less than 6 months.

Oga it's only LP that can file a petition to that, nothing concern APC with this. They should focus on their druglord case. This isn't even a counter petition, it would be thrown out of the window.

In your myopic reasoning APC can’t petition the election tribunal that Obi is not a qualified LP candidate, but Obi can meddle into APC nominations by saying someone is not qualified to run.

So in your little mind a druglord will be president even though there will be court cases that might last 180 days. Why are you so funny. He has cases of age falsification, fake results etc and you think he will still be president? Keep believing your own lies to make yourself feel good.
I ask you, show us the law you have made to put interim government in place on May 29 in Nigeria, before the final determination of the case against your "drug lord".

It's not that the case "might last 180 days"; it will surely last for 180 days. As a matter of fact, It will even last for 60 more days at the Supreme Court.

So, get ready, because the whole case will last for 8 months and that will be in November when the Supreme Court will finally decide. Tinubu will be 6 months into his 4-year tenure at that time.

Populism of the blind and headstrong slant have no place in the dispensation of Justice. Peter Obi was a member of LP within the 30 day period prior to the election. If he had stayed in PDP Tinubu would have found it near impossible to win.

27th May, 2022 ---- OBI joins labour party.
30th May, 2022 ---- Obi Participated in Labour Party's primary.

I can see that your 30 days is intact.

Tinubu has put everything in order to win by all means, but God will shame him and bring him down!!

Mindful of your conclusion. This election is totally different from anyother election, the introduction of BVAS and IREV makes the judiciary unable to perform magic like subsequent elections. We will be having more of such cases from states governors and the overturn of some elections to the rightful winner.
I will say any politician is really unlucky in contesting at a time like this, unless he truly wins the people mandate...
With time it will discouraged politicians from electoral fraud, because after all your sweat ,the court will return it to the original Winner.

You’re the one arguing wrongly, you can’t count when the election was held. You start counting the 180 days from the day the petition was filed. Tribunal will be done in September then the losing party will file appeal at the Supreme Court within 14 days, the 60 days will start counting when the appeal is filed at the Supreme Court.
unfortunately for you and your likes Tinubu will be president from May till December when the Supreme Court will deliver judgement

Oga if you like write epistle wey go back 3 pages, a druglord won't rule and an Interim govt will take over. That's the normal thing to do, you can't expect a man with certificate forgery, drugcases, money laundry etc to rule because a case will go on as long as 180 or 200years. An interim govt will be there till the cases are settled and cleared. You want a druglord to be sworn in with all the electoral fraud. Continue to make yourself happy if you believe Bat will rule you and your Irigbigi kingdom that's ok with you but not Nigeria.

Number 1 fault is that Obi and his lawyers didn’t present each polling unit results in states that they are challenging, results that are different from what INEC upload.
Mind you the Constitution and Electoral act gave Inec the power to choose any guidelines she deem fit at any time.

Many of you are legally illiterate. If you know the law, you will see that their counter argument is very strong and compelling. How can Obi contest election when he was not a member of LP? How can Obi claim irregularities without giving evidence on polling unit basis? Answer those questions based on the law.

Serous cost for wasting everybody’s time.

The APC equally argued that the petition was improperly constituted having failed to join Atiku Abubakar and PDP who were necessary parties to be affected by the reliefs sought

“By Paragraph 17 of the petition, the petitioners, on their own, stated that Alhaji Atiku Abubakar came second in the presidential election with 6,984,520 votes as against the petitioners who came third with 6,101,533 votes;

“At Paragraph 102 (ii) of the petition, the petitioners urged the tribunal to determine that 1st petitioner scored the majority of lawful votes without joining Alhaji Atiku Abubakar in the petition.

“For the tribunal to grant prayer (iii) of the petitioners, the tribunal must have set aside the scores and election of Alhaji Atiku Abubakar,

“Alhaji Atiku Abubakar must be heard before his votes can be discountenanced by the tribunal,” it said.

This point alone has destroyed Peter Obi’s petition. The quacks who filed Obi Obi’s petition will be sweating after reading this technical point. Wole Olanipekun is damn good in destroying cases on technical grounds.

To delusional obedients, it’s game over. Obi’s watery case has been shredded to pieces.

Does imo governor joined the second and third position before him that was no 4 had the result upturned, it is a simple question, the same court that granted this are the one to still adjudicate on this one.
