GeneralDae: I am not arguing with anyone.. I just stated my opinion... you can state yours as well and we can always agree to disagree.. In real life scenario, prosecutors often offers a plea deal with a suspect.. basically if you make their life easy... they make yours easy as well.. Someone that was picked up as a suspect in a crime depending on the complexity of the case and the corporation of the suspect.. prosecution sometimes offer them a soft landing.. |

A man forfeited hundreds of thousands of dollars on drug dealing and money laundering. And yet you still voted him for president. It did not occur to you guys that such a person is lacking in character and integrity, instead you rewarded him with the highest office in the land. GeneralDae: I never said their was. The purpose of my post was to say that it could be a possibility. Also plea deal are 'not always' advertised in court documents.. Recall, the court case was over 30 years ago and the guidelines then and now are not always the same. |

Lotanna2: In Abacha v F.R.N. 2014 6 N.W.L.R. part 1402 Page 43 per Kekere-Ekun JSC and Ariwoola JSC (now CJN), the Supreme Court quoted the definition of Forfeiture in Black’s Law Dictionary 8th & 9th Edition thus: “1. The divestiture of property without compensation. 2. The loss of a right, privilege or property because of a crime, breach of obligation or neglect of duty”. The Apex Court further held that: "Therefore, forfeiture connotes punishment for a crime committed, and it’s effect is instantaneous”. 2 Likes |

MatrixCircle: Tinubu isn’t my president and he doesn’t have any affect on me but you’re not far off at all. This began as a Judicial Forfeiture stemming from Criminal Charges which were filed against him. In order for the money to be successfully taken, the prosecution and DEA proved that the money was derived from drug trafficking. The interesting part is that most Americans fight against forfeiture and even though it can take years, it is not unusual for them to win. Contesting a forfeiture is pretty easy but Tinubu did not contest the forfeiture at all—he agreed to it in lieu of a conviction. Another interesting thing is that he filed to have his arrest and everything else expunged from his record and the expungement was granted which is one reason why only the details of the forfeiture are easily available. If you agree to a forfeiture, you’re basically admitting that the money was derived as a result of crime. 5 Likes |

Badgers14:So you just imposed plea deal on the case. If there is no evidence of a plea deal, there's no need to suppose it. Court deals only with facts. Besides, in a drug crime case, a plea deal doesn't mean you wouldn't serve your prison terms. If you have examples to the contrary, you can post it here. |

Once again, I don’t have any stake in this but Tinubu filed for and was granted an expungement—how can anyone say that he was not prosecuted or convicted if the records from the case were expunged or sealed? 1 Like |

INEC opened their defense, presented one witness and closed their case yesterday. APC only opened their case today, presented just one witness and closed same today. The reason is simple, there's NO CASE to waste time upon🤣🤣🤣 Even me wey no enter Court sabi say na this Peter Obi and Atiku case be the easiest and shortest PEPT case wey Court go dismiss.... The reason is simple: 1. The election was conducted and collated MANNAULY. 2. The collation and announcement of results were done MANUALLY. 3. What was used to announced those results NATIONWIDE were PHYSICAL RECORDS MANUUALY handed over to each party agents across PUs. 4. If you have problem with blurred result on iREV, that's your wahala, take the physical one from which anything or EVERYTHING on iREV was scanned & posted, that's the PRIMARY SOURCE, not iREV. 5. If you tell me you have blurred result online, sebi I will ask you to show me the original one given to your Party physically from which the collation and announcements were made, did anyone announce result waiting for iREV when the PRIMARY SOURCE was physically used? Lotanna2: No person shall be qualified for election to the office of Governor of a State if - (a) subject to the provisions of section 28 of this Constitution, he has voluntarily acquired the citizenship of a country other than Nigeria or, except in such cases as may be prescribed by the National Assembly, he has made a declaration of allegiance to such other country; or (b) he has been elected to such office at any two previous elections; or (c) under the law in any part of Nigeria, he is adjudged to be a lunatic or otherwise declared to be of unsound mind; or (d) he is under a sentence of death imposed by any competent court of law or tribunal in Nigeria or a sentence of imprisonment for any offence involving dishonesty or fraud (by whatever name called) or any other offence imposed on him by any court or tribunal or substituted by a competent authority for any other sentence imposed on him by such a court or tribunal; or (e) within a period of less than ten years before the date of election to the office of Governor of a State he has been convicted and sentenced for an offence involving dishonesty or he has been found guilty of the contravention of the code of Conduct; or read D and E carefully. 001Lagos: Learn to read and understand. His statement read that the forfeiture was handled as a civil case as a result, there was no conviction or sentencing and therefore cannot be regarded as a criminal case. Even Tinubu himself didn't deny that it happened, he willfully admitted because he knows so well that it can't be valuable in this case because a reasonable person will know that if he didn't go to jail for it, he can't be termed a criminal or an ex convict. |
