Akwamkpuruamu:
Because Hope Uzodimma is not in Tinubu's good books the now brought back a case filed three years ago to now adjudicate. They won't remember it's time barred.

Nigeria politicians are crude, brutal and barbaric

1. It's not true that Hope Uzodimma is not in the good books of Tinubu
2. Even if Uzodimma is not in the good books of Tinubu, how will that affect the outcome of the case?
3. Any case filed is no longer time bared as long as you file the case before the time expired.

I don't know and wasn't referring to this case in particular. I only pointed out the effects of delayed judgement

Kukutente23:

Fine? Why's that? This was one of my many issues with the SC judgement then. The issue of nomination was a constitutional issue and the SC should have suo moto made a pronouncement on whether Hope was a valid nominee based on the judgement it gave against Uche Nwosu.
The SC's refusal to pronounce on that matter when it gave judgement just recently smirks of deliberate amnesia if you ask me
It's an abuse of Court process and the Supreme Court has no jurisdiction.

It is akin to APGA trying to review a Supreme Court decision. The Court has a maximum 60 days to sit on same but it's already 3 years.

The SC on Oct 31 will simply tell us that it is functus officio and without jurisdiction.

Seems like you didn't fully get the gist.
It's a hearing date that was fixed...not judgement date

Wow. If justice and the wishes of the masses are what Nigeria's court judges go for, this is an opportunity to retrieve Imo state from the Hobessian state it became since January 2020.

In Nigeria the sitting governor is always innocent and wins a court case

you mean just like the following past sitting governors?

Ihedioha of Imo state
Governor Ayodele Fayose (Ekiti State)
Governor Murtala Nyako (Adamawa State)
Governor Joshua Dariye (Jos State)
Chris Ngige (Anambra State)
Diepreye Alamieyeseigha (Bayelsa state)
Rasheed Ladoja (Oyo State)

Really? What about the fact that the SC displayed amnesia in the case. I mean does anyone need to remind them they just gave judgement against Uche Nwosu then?
I think this particular case will always reign in ignominy as far as SC is concerned

The reason why they will cite it as an example.
Why?
The case is neither pre-election nor post-election. They have many spaces to hide under in order to dismiss same.

This goes to bring back the fact that the Imo Judgement was a hoax and a mandate heist..

But..

After that Judgement in 2020,, what were the parties supposed to do?

Go back to the High-Court and start afresh to determine that Hope was never a candidate - going by the decision of the Supreme Court??

OR WHAT EXACTLY.??

Actually, do nothing because there is no jurisdiction.

It cannot fall either in pre or post-election. This type of case first existed in Imo between Ararume v. Rochas Okorocha in 2012, then Sylva v INEC the following year.

So, the actual thing to do is nothing. This is because APGA did not sue Nwosu neither did they go to the tribunal. So, the truth is they should and will be fined.

It is already functus officio.

The big elephant in the room was Buhari and APC
They intimidated the judges with the DSS and the Onnoghen treatment.
The fact of Buhari suspending a CJN being allowed to stand killed the judiciary's independence.
Go check throughout our democracy. Any autonomous body whose head was suspended successfully soon became subservient to the executive. From efcc with Yaradua to CBN with Jonathan and now Judiciary with Buhari.
What is lost on almost all sane minds is that all those suspensions are clearly illegal

The truth of the matter is that practically, everybody or arm of govt is subservient to the president in most part of Africa esp nigeria.tinubu can do and undo as he deems fit..by the way,gej showed tinubu the way by suspending jca Isa salami

I am still surprised..

That time PDP went back to the Supreme Court for the review of this case,, didn't it cross their mind to file this motion then??
Why did they even leave it for APGA?

It is very clear that the supreme court will base on “court processes and technicalities”, and strike this case off.
May even fine APGA.
