My friend is attempting to get tourist Visa to a Schengen country, one of the requirements is proof of employment.
He have tried with Offer Letter but it got rejected, when asked at workplace nobody seems to have Employment Contract either.
When asked directly his boss, he is being told that there is only offer letter.

Are they trying to gaslight him or is it common practice to only get an offer letter ?

Work is long term, full time, already there for 2 years +

Offer letter requires you to respond, accepting the offer. Then you get an employment contract stating your hours of work, pay rate and probation period and others. In most case, you will have all the information already on the offer letter but you need an employment letter or reference letter from work for visa purposes.

Thank you so much for response. Indeed all the information was already included in in Offer Letter, however employer of my friend is pretending there is no "Employment Contract"/"Employment Letter" and that there is nothing they can do ("Reference Letter"/"Employment Confirmation" ). Which makes me feel like they are trying to hide something.
(For example officially they allow only 5 vacation days a year which is less than federal minimum I think)

What you said makes sense, but was giving them benefit of the doubt as I'm not local and there is only limited amount of resources for me online.

The company should generate employment letter for him with breakdown of his emoluments and benefits except they don't want him to japa

Well in the West the practice is to send you an initial offer letter outlining the terms of the proposed contract but this is not treated as the final agreement. I'm not sure why they do this, but you still need a subsequent contract.

Also you have used gaslight wrongly.

Na employment letter, dem fit offer you wey you no accept. As I dey, I got many offer letters wey I no accept.

We only have OFFER OF APPOINTMENT LETTER here after which it will be changed to PERMANENTLY LETTER OF EMPLOYMENT


Maybe they are referring to the LETTER OF EMPLOYMENT.

Why don’t you ask the company for a letter to the embassy confirming you are an employee stating how long you have been there as well as payslips.

Our own offer letter and employment contract are lumped up unlike what they are used to in Europe which is only employment contract.

Tell your friend to see how for sample employment contract in the European country he is visiting.
He should take the sample to his company in Nigeria and tell or ask them if they can draft an employment contract for him, using that sample as a guide.

It depends, it is not always the case. If I recall correctly as this was a while ago, I had jobs in the uk where all there was was the letter of appointment, no contract, no acceptance letter no nothing. I have also had jobs where it was in the form of a fixed term contract where a contract was prepared and signed. I also had jobs with offer letter, acceptance and employment contract. I also had jobs in my student days where there was no contract and no appointment letter but those were not serious jobs..I.e sales staff etc

His visa wouldn't be approved until the employer is committed via the employment contract or letter.

Also, the employer is acting like either a fraudster or he wants to use ur friend.

Tell him to becareful with that employer.

Yeah, but these are all different things: Appointment letters and contracts of employment, are final documents. An offer letter is a preparatory document that outlines terms that you can negotiate. The acceptance of an offer letter doesn't imply an employment relationship, only that any subsequent contract will be in accordance with the terms you have agreed upon. An offer letter can be rescinded but a contract of employment cannot be rescinded without legal consequences.

Offer letter is offering you a job

you accept job with agreed terms and conditions

then Employment letter is created and sent too you with a start date.

To mine mind,employment contract comes after offer letter,an offer simply means the right to accept or reject while employment contract spells out the obligations between an employer and employee with terms and conditions.

I do t think you understand what I wrote. I recall my first job after my master’s where (to the best of my recollection) all I had was the appointment letter. It was a small consultancy with many multinational clients. I am almost certain I did not write an acceptance letter as I remember I had the interview on a Friday and started on the Monday.


EDIT: Now that I think about it, there was indeed an employment contract( as I remember there was an issue over payment in lieu of statutory leave when the company went bust) but I am certain I did not write a formal acceptance. So I guess if there was an employment contract, then I must have signed it….which is in effect formal acceptance.

As an HR practitioner, there should be and offer letter and an employment contract. The offer letter is just stating the role you are offered, your pay and your date of resumption. However, the employment contract will state all the other conditions attached to the role. If any employer does not give an employment contract, the employer is up to no good, it means they want to vary the conditions of the role in directions that will favor them only!

It's either your employer gives you appointment letter or employment agreement. Offer letter is a prelude to these either letters.
