PDPGuy:It was an expected ruling. Every honest person who watched what transpired should have thought it was a coup attempt. But with the revelations of the secret Twitter account that was revealed last week, that one of Trump's attorneys lied to prosecutors about having, it should have been clear to anyone on the fence that the plan was to fraudulently put Trump in office. I don't fault the state courts for doing what they did. But I understand the Supreme Court's aversion to allowing states to decide this. However, I also disagree with the conservative majority creating new "law" by allowing the House to decide this. It's a fundamental flaw given that the House is no longer representative of the US because of things like gerrymandering. |

Wade was in that area on a greater percentage of days (23 out of 92 in Jan-Mar) when Willis didn't live in that area than he was (35 out of 244 in Apr-Nov) when Willis did live in that area. |

bemeruca:I thought the words in the Constitution are clear regarding insurrections. I believe the question should have been about the mechanism of disqualification. The states believed they were the mechanism, and from what I have heard, the Supreme Court believed the House is the mechanism. Again, I think it would be hard for a nonpartisan, unbiased person to say Trump didn't commit an insurrection. Your posts always seem so emotional, and your arguments and writing are impacted by that emotion. I can even barely understand your posts at times. In my humble opinion, if you were more dispassionate, I'm sure you would make better rational arguments and could have more fulsome discussions with people. |

I had a chance to listen to the Willis hearing over the weekend and also read a good article/discussion on the legal aspects of the decision. Honestly, to me, the defense didn't seem to have made their case and resorted to proverbially 'banging on the table' to create a PR issue and bias the jury pool, which they may have succeeded in doing. The prosecutor's attorney who presented the case was a little weak in his approach, but I think he was on point regarding the legal issues and case law, especially in critiquing the judge's understanding. It seems the case will come down to what standard Judge McAfee uses, either the standard of 'actual conflict of interest' or 'appearance of impropriety.' My understanding is that the based on Georgia law the defense must show an 'actual conflict of interest.' I don't think, and I don't believe anyone else thinks, that the defense has met that burden. One of the cases cited involved a married couple who were on opposing sides—one was a prosecutor and the other a defense counsel. The court was asked to disqualify them, but the court said they couldn't find a reason. These were people with an intimate relationship on opposing sides. If they weren't disqualified, why would two non-married people on the same side be? See Jones, 258 Ga. at 354–355 (“We have found no authority, and none has been cited to us, for the proposition that married lawyers who are involved in active litigation on opposing sides of a case must be disqualified.”). Georgia courts have explained that, “[w]hile we cannot disagree with the proposition that the marital relationship may be the most intimate relationship of a person’s life, it does not follow that professional people allow this intimacy to interfere with professional obligations.” Ventura, 346 Ga. App. at 311, 816 S.E.2d at 154. |

What they expected in a worse-case scenario was a split decision where all the conservative judges sided with Trump and the liberal judges sided with Colorado.
