So today the lawyer in charge of the property I stay in brought a notice to quit for us. Our rent is due November 31st and in the quit notice, it states we must leave that same date.

Please I want to ask is this what the law states ? Because he claims we now have 6 months notice to vacate the apartment even as our rent will be due in November...

This is a very sudden one for me

He is suppose to refund 6month money for you out of your house rent.

Or

You will stay in the house for another 6month after November for free.

The 6 month notice is what one will tag as "over wiseness".

The 6 months' notice actually covers his rent period which is only accepted by people that doesn't know their rights, the notice should start from the expiration of his rent and not in between his rent.

My thoughts
What if he does not leave after the 6mths when his rent just expired
What will the landlord claim as his evidence for giving quit notice when ur rent is still valid.
I doubt he can take any legal actions on him, cos I wonder which Ballif will follow home to execute it

Which tenancy law are you quoting from?

The law states that 6 months notice should be given for a yearly tenant if breaks any of the tenancy agreement or the landlord wants to use his apartment.

They have served him the 6 months quit notice

no mind that guy!

Tenants always assume they have 6 months to live rent free after their rents have expired once they've been served with eviction notice. Your six month notice starts from the time you've been served the notice, that's more than enough time to make alternative accommodation arrangements

go and ask your school to refund your money. a quit notice cannot run concurrently with his rent. when his rent expires then you can give him the quit notice.

Where is the money to renew your lease once your lease expires? Use the same money to pay for a new property. If you have to downsize then do so. This is somebodyā€™s house and they have given you sufficient advance notice.
Right now in Nigeria, it is easy to renew rent than to get new apartment because of greedy agents everywhere. Adding those ridiculous charges while getting new apartment is crazy. So, he might be thinking of such too.

If the landlord is ready for you, you will pay for every day you spend in his property.

A notice to quit is given when your rent is still in effect not after expiry.

It basically means, ā€œuse the remaining 6 months on your tenancy to find a new placeā€. If you stay one day extra, then you are automatically owing one day rent and your landlord can recover that money.

Donā€™t try to stay for free in another personā€™s house. Tenancy law does not allow you to do that.

Don't mind Nigerians with the entitlement mentality and trying to reap where they didn't sow!

Like who does that? šŸ˜

How can you dare to stay in house where you are in conflict with the owner and you still won't pay?

Then you want to sleep in that house with your two eyes closed? Make some people sef dey think na?

He's not out of law to serve you 6 months quit notice.

You can use the remaining time to look for another apartment or try to appeal to the landlord of the apartment to see if he can have a change of heart.

I beg to differ, if they are paying yearly it could be 6 to 8 months notice to quit,

in the event their rent is still Running, asking them to leave on n3, which implies 6 months, means he must refund their rent from date of the quit notice to the duration give

That can be done, but he will pay the rent for these 3 months.

Some Nigerians are always looking for ways to exploit others. In this situation, OP may he expecting free 3 months rent

AlphaNugget:

You are not getting it, how can you expect him to park out just at the expiration of his rent?
Why not give him an extra 3 months' notice, the 3 months' notice will start counting from the day his rent expires.

Thats one of those who want to exploit others. In this case, the landlord.

If 6 months notice is not enough fir him, is it the 3 months that will be enough?

I agree with you, some tenant do have this wrong perception that they are entitled to 6 months notice after the expiration of their tenancy which is wrong. Even 7 days owner's intention is even allowed when the tenant is holding.pver the premises

By virtue of Section 13 of the Lagos State Tenancy Law 2011, The Landlord is within his rights. All you can do is to plead for extension of time, which he is not obligated by Law to grant.
If you are in doubt, please read the law. You can download it on the net. But i have included the relevant portion below

13.-(1) where there is no stipulation as to the notice to be given by either party to determine the tenancy, the following shall apply-
(a) a weekā€™s notice for a tenant at will;
(b) one (1) monthā€™s notice for a monthly tenant;
(c) three (3) months notice for a quarterly tenant;
(d) three (3) months notice for a half-yearly tenant; and
(e) six months notice for a yearly tenant
(2) In the case of a monthly tenancy, where the tenant is in arrears of rent for six (6) months, the tenancy shall lapse and the Court shall make an order for possession and arrears of rent upon proof of the arrears by the landlord.
(3) In the case of a quarterly or half-yearly tenancy, where the tenant is in arrears of one (1) year rent, the tenancy shall lapse and the Court shall make an order for possession and arrears of rent upon proof of the arrears by the landlord.
(4) Notice for tenants under subsection (1) (c), (d) and (e) of this Section need not terminate on the anniversary of the tenancy but may terminate on or after the date of expiration of the tenancy.
(5) In the case of a tenancy for a fixed term, no notice to quit shall be required once the tenancy has been determined by efflux ion of time and where the landlord intends to proceed to Court to recover possession, he shall serve a seven (7) days written notice of his intention to apply to recover possession as in Form TL5 in the Schedule to this Law.
(6) The nature of a tenancy shall, in the absence of any evidence to the contrary, be determined by reference to the time when the rent is paid or demanded

Wowwww,............, the general believe is that the notice starts counting after expiration or rent. But why are some lawyers ignorant of this cos they will even be the one to serve it with effect from after expiration of rent.

Whatever you mean by being 'into the legal system' is not equivalent to being a lawyer. The Notice in this instance is clearly in accordance with the Tenancy Law. If you pay your rent yearly, you are entitled to 6 month's notice to quit.
Where the term expires and your rent is in arrears, you will receive only the 7-days Notice.
That the court system could be manipulated to prolong your stay in a house is a dying culture in Lagos now. Pray you don't tempt a wicked landlord with this jungle plan as you may find yourself on the streets without knowing why.....

My own question is this...

"What if the "stubborn" still refuses still leave after the 7-day notice, what will you do to wbict such tenant to avoid going against the law?

Your input is well appreciated Sir!

Thanks in advance

You don't know what you are saying.

It's Normal to take your landlord to court over quit notice and the case might drag for years but believe me, after the expiration of the case , the court will still mandate him to pay all is debts.

This is exactly why my landlord has been begging me now...because of wickedness...

He gave me a six months notice and during d expiration, i begged him and heeded his friend's advice to send him money so he can beg for me....my buziness is a night one nd closest to my house, instead, he told his friend its his final decision....den the friend ask that he refunds me, but he refused...and den sent me to court, claiming demand to deduct the two months i HV stayed extra and cost of his lawyer since according to him, i made him get the lawyer.

Note: i sent him the money even before his next notice expired and i hv ever been sking him for refund so i could park out, but he refused to send it back, instead preferring to humilate me....this got me really really angry..nd i decided to pay back....

After the court heard us they gave me one month extra ,declined his request for my to pay for his lawyer but accepted i pay his over stay, but he must hv me the balance immidiately..DT was how i lost another 50k....

But ,nay, I was determimed to get my pond of flesh....unfortunately for him, he once called me a thief in the public in our compound meeting..nd repeated such wen i was begging him...

Now I reported him to the shrine to take and oath that i stole his.money, he called a lawyer ,the lawyers all washed their hands off it....i demanded a 1million naira damage for his accusations, he has been calling me crazily ,hi wife ,family ,all have been begging me, but i still refused.....

I HV already taken an oath to die if I stole or he dies if he he made false allegations on me...

Either of us will not see next week Wednesday, my mind is very strong that its not me...i beliv he is running around for thr funds..he has already begged for 500k nd i refused...this is.my time to shine...

In fact, I want him dead.....my laff comes last...

Some tenants can be stubborn unnecessarily.
Landlord gives you 6 months to quit and you are hoping for a free 3 more months in his house
