Technically, his rent has not expired! Notices are to be served after rent expiration, eviction can still be done on the discretion of the owner! It’s in the law you give him at least 3 months to move out of the property after rent expiration!

The landlord is a wicked man and thinks he wants to outsmart you through his lawyer. But this is a slippery slope, you can get a lawyer and amass law fees or just start looking for another rental.

Infact a lawyer tried this with Me, at business place... We stayed extra one year, and paid him for 6 months before we left.

How can someone just pay for rent for a year, and 6 months later your are bringing notice to quit.. why not reject the rent and give him 6 months to quit??

The 6 months' notice actually covers his rent period which is only accepted by people that doesn't know their rights, the notice should start from the expiration of his rent and not in between his rent.

Why didn't advise your proprietor not to collect the yearly due, and give the tenant the 6 months notice to quit?? But the landlord collected the new rent and still gave 6 months to quit...

You can use the remaining time to look for another apartment or try to appeal to the landlord of the apartment to see if he can have a change of heart.

yes. The lawyer's right. Your notice to quit commence 6 months before your tenancy expires. No law state that, you should used additional days or months after your rent expired. After the expire date, you are tenant at sufferance.

Assumptions, The 6 months notice is statutory by law, no court order needed. You will need a court order if eviction is to take place.

lol. You are out of law. The law stipulates 6 month for a yearly tenant. If the notice is six month even before the expiration of the rent then it is valid.

I laugh when people argue about rent, they should try and build, imagine spending N40m to build your bungalow of flats and you charge N1.2m in a year and some be shouting

He gave you 6months and 23days notice. The law actually requires him to give you 6months. You should thank him for the extra 23days.

what state is this? In lagos a lawyer will issue the quit notice and after the 6 month if the tenant refused to vacate then you will issue a 7 days notice and after that you will go to court. All these are precedent you must follow before going to court

Where is the money to renew your lease once your lease expires? Use the same money to pay for a new property. If you have to downsize then do so. This is somebody’s house and they have given you sufficient advance notice.

Whatever you mean by being 'into the legal system' is not equivalent to being a lawyer. The Notice in this instance is clearly in accordance with the Tenancy Law. If you pay your rent yearly, you are entitled to 6 month's notice to quit.
Where the term expires and your rent is in arrears, you will receive only the 7-days Notice.
That the court system could be manipulated to prolong your stay in a house is a dying culture in Lagos now. Pray you don't tempt a wicked landlord with this jungle plan as you may find yourself on the streets without knowing why.....

Don't mind them. They are always looking for ways to stay in people's house for free. They usually interpret the notice as "6 (plus x) months free rent period". They want to go to court and continue to stay in someone's house for free until the case is determined. Yet they are also praying for blessings and returns on their own investment. May God help all of us in this country.

I saw the way the operate, cos i had loads of them come down, and some are very aggressive and intimidating. But nah my area i dey.The rents Im collecting has no significant bearing relative to the amount spent on the house so I am not leveraging on it,I just wanted quiet reasonable and responsible family o stay!
