My honest advice to you is to you is to vacate his property in peace for him. No need to drag anything with him or try to prove your papa or mama na SAN. Try and get a place on or before the expiration date.

Talking from experience, my tenants wanted to play smart on me, they will never finish saying what they face afterwards. Some landlords are not smiling when it comes to someone wanting to drag their property.

Be a good tenant and God will also make you a landlord too, choose the path of Peace instead.

It is absolutely not correct, and your explanation makes it worse. Every other thing being equal, you should renew your tenancy (pay your rent) before the tenancy expires. So, unless there are other issues (such as financial problems), quit notice is highly likely to come when your tenancy is still valid. Once you stop paying your rent, you are no longer a tenant and that is almost another discussion on its own.

You will be a landlord one day.

Go and read the landlord and tenancy law before commenting further

You need to re read my piece again. Firstly, you didn’t addressed the issue of rent expiration and serving of notice as highlighted in my post. I did acknowledged that notices can be serviced anytime as per the landlord request.

Secondly, there is nowhere in my comment I said a tenant can stay in a rented apartment free for 6 months. It is pertinent to noted that standard practice requires at least 3 months before evictions and I clearly stated that it is always a slippery slope between a landlord and a tenant having issues about evictions.

I am appalled at your assertions and deeply troubled by your claims regarding a magistrate being interested in a clear case of eviction! Conclusively, I am inclined to believe that you either didn’t finish your law practice or totally oblivious of the basics of what tenancy law means.

I disagree with you. If his rent expires, then he is only entitled to 7days notice of owner's intention to recover possession.
The notice is apt,the wise thing to do is to start looking for a new apartment a month or two towards the expiration of his present rent.

If your rent is not valid, then you are not a tenant. There is no law that is designed to deny someone payment for the goods and services they rendered (or are rendering). It is not suya that you will ask for jara or taste small before you buy.

People just like to be difficult and cheat other people out of their sweat. That is why they misinterpret laws and take undue and ungodly advantage of loopholes.

We should all aspire to be the kind of tenant we would want when we become a landlord.

When I had a similar situation, I ensured that I was as Godly as much as I could.
- Agent increased rent, but it was too close to the expiration of my tenancy. I told him to give me 6 months to move out and I paid for the 6 months at the going rate. Eventually, I was too busy and I didn't move out as planned. So I asked for another 3 months but I paid the new rate.
- He asked me to paint the flat after moving out. I told him I would paint only after removing the new wiring, mosquito nets and other improvements that I installed. He quickly told me to forget it.

He may not like me, but he could not fault what I did. I would also not cry foul if a tenant did the same thing to me in the future. in fact I would be extremely grateful if I had my type of person as a tenant.

as a tenant we should all be thinking of getting our own house hence taken care of house being rent by we.
I have seen when tenant have don serious damage to their apartment.

And who will bear the lost?

Six months or three months quit notice should commence at the expiry of the rent. But Nigeria is a lawless country where people bully those they can with law enforcers and go away with it.

Just look for house move out and leave dem with their wahala.

Please kindly familiarize yourself with tenancy law in Nigeria so that you wont fall a victim. You only have grace of 7days after you receive 6 months quit notice during your tenancy period.

ou are absolutely right, however you will still need to pay for the three months, Im sure you are thinking it would be free but by the end of the tenancy since OP now has 6 months notice, he only needs 7 days to vacate the property!this is due t how long it take to pass judgement, ask that your Owerri lawyer!

This is not true, please get a copy of tenancy law in Nigeria or Google it to know more about it. The quit notice is in order according to the law. You only get 7 days grace to vacate the property after your tenancy expire.

My brother, the landlord is fair and has done the right thing to give u 6 months notice as the law requires. You don't lose and he doesn't lose.
You have enough time to look for another house to move out.
If you are demanding he gives you 6 months after your rent expires, are you going to pay for the extra 6 months or you want to stay free so that he loses??
Be Fair.
Just plan yourself and move out

Whatever you mean by being 'into the legal system' is not equivalent to being a lawyer. The Notice in this instance is clearly in accordance with the Tenancy Law. If you pay your rent yearly, you are entitled to 6 month's notice to quit.
Where the term expires and your rent is in arrears, you will receive only the 7-days Notice.
That the court system could be manipulated to prolong your stay in a house is a dying culture in Lagos now. Pray you don't tempt a wicked landlord with this jungle plan as you may find yourself on the streets without knowing why.....

When I prepare my tenancy agreement, I prepare it as a fixed tenancy, you’re only entitled to seven days notice to quit and seven days owner’s intention to recover premises.

It’s funny tenant’s think every yearly tenant is entitled to 6 months notice to quit .

By virtue of Section 13 of the Lagos State Tenancy Law 2011, The Landlord is within his rights. All you can do is to plead for extension of time, which he is not obligated by Law to grant.
If you are in doubt, please read the law. You can download it on the net. But i have included the relevant portion below

[b]13.-(1) where there is no stipulation as to the notice to be given by either party to determine the tenancy, the following shall apply-
(a) a week’s notice for a tenant at will;
(b) one (1) month’s notice for a monthly tenant;
(c) three (3) months notice for a quarterly tenant;
(d) three (3) months notice for a half-yearly tenant; and
(e) six months notice for a yearly tenant
(2) In the case of a monthly tenancy, where the tenant is in arrears of rent for six (6) months, the tenancy shall lapse and the Court shall make an order for possession and arrears of rent upon proof of the arrears by the landlord.
(3) In the case of a quarterly or half-yearly tenancy, where the tenant is in arrears of one (1) year rent, the tenancy shall lapse and the Court shall make an order for possession and arrears of rent upon proof of the arrears by the landlord.
(4) Notice for tenants under subsection (1) (c), (d) and (e) of this Section need not terminate on the anniversary of the tenancy but may terminate on or after the date of expiration of the tenancy.

"Fixed term" is another language that may be hidden in your agreement. Although, we all know that tenancy is over once your rent expires. The fixed term language sort of makes it clearer and enforceable.

Na why dem de call some lawyer charge and bail be this because e no pass that one.

And you no tell am say for that extra three months wey you wan use court (wey no go gree give am three months because the landlord serve am the legally required six months notice) go compel am to pay for the extra three months and all the other months wey una go waste for court abi na your commission you de fight after!

I believe you are the one who doesn't have an understanding of the law especially if it's within the jurisdiction of Lagos State Tenancy Law. You may read the section over again. Better still, you may get a lawyer to interpret the section to you.
