The Peoples Democratic Party has declared full control over Rivers State, asserting that Governor Siminalayi Fubara and the party now dominate the state’s political landscape.

In a statement by its National Publicity Secretary, Debo Ologunagba, on Saturday, the party claimed that all legislators who defected to the All Progressives Congress have forfeited their seats, citing constitutional provisions.

PUNCH Online, on Tuesday, reported that the Rivers State Government dismissed a call on the state House of Assembly by the Caretaker Committee of the APC in the state to commence impeachment proceedings against Fubara.

Ologunagba emphasized that legal considerations now overwhelmingly favour the PDP, dismissing the APC’s claims as futile attempts to subvert Nigeria’s constitution.

He stated, “It is indeed pathetic for the APC to think that the facts and true import of Section 109 (1) (g) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) to the effect that the former lawmakers have since lost their seats can be muddled and lost in litigation and lengthy press statements.

“Interestingly, in the failed bid to subvert the Constitution to give the former members of the Rivers State House of Assembly a lifeline, the APC ended up admitting the clarity of the provision of Section 109(1)(g) of the 1999 Constitution (as amended) in voiding their seats upon their defection.

“For the avoidance of doubt, Section 109 (1)(g) of the Constitution is clear in providing that “a member of a House of Assembly shall vacate his seat in the House if – being a person whose election to the House of Assembly was sponsored by a political party, he becomes a member of another political party before expiration of the period for which that House was elected:

“Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored.”

Ologunagba said that all House of Assembly members who joined the APC are now former members.

He urged both the APC and the legislators to abandon any hopes of their party assuming control of Rivers State.

“The former members of the Rivers State House of Assembly, for reasons best known to them, wittingly vacated and summarily lost their seats as nothing in the proviso protects or allows them to retain their membership of the Rivers State House of Assembly after decamping from the political party upon which they were elected.

“These former members of the Rivers State House of Assembly have only themselves to blame for Constitutionally vacating their seats; a course which cannot be reversed or remedied. They should admit their miscalculation and bear the inescapable consequences.

“This is especially so as the Supreme Court, in the case of Abegunde vs Ondo State House of Assembly and Others, has since clarified and affirmed the import of the proviso in Section 109(1)(g) in validating the automatic vacation of a seat by a member of a Legislative House who defected from the Party upon which he was elected into that House.

“For the umpteenth time, the PDP cautions the APC to steer clear of Rivers State; it should perish the thoughts of forcefully taking over the State and stop exasperating the public space by seeking to reverse the irreversible.

The APC should come to terms that with the vacation of seats by the former lawmakers, the quorum of the Rivers State House of Assembly will be determined by the number of the remaining lawmakers as provided by law; until a bye-election is conducted to fill the vacancies now existing in the Rivers State House of Assembly as a result of the defection by the former members,” Ologunagba further stated.

Amidst the many troubles rocking the Rivers State political structure, the APC on Friday stated that the “egregious actions” of Fubara are indicators of his impeachment process talks.

Right from May 29, 2923 Wike lost his grip on Rivers State.

In fact, Wike is a persona non grata in Rivers State today. 

The only people giving him relevance are the APC and BATerians, simply because they thrive in anarchy and chaos. They will be so happy to see Rivers State go up in flames just to give Wike the relevance he earnestly seeks.

The bulldozer should just level the house of assembly quarters after which the RS government should turn it to a cemetery while constructing another HOAQ elsewhere .

No individual must be bigger than a region or state to control and dictate to a sitting governor. It is undemocratic!

You bought a judgement in Rivers the peraon you are fighting with is the minister or Governor of Abuja and he is a friend of the judiciary he will buy his own court judgement, just pray it never get to a supreme court in Abuja where a permanent judgement will be made.

In a situation like this people are not going to tell you that you have a limitation, rather they'll tell you that you own the world.

Wike I don't like for his too much wahala but the stage of this Rivers political fight is not a stage to celebrate

bad ppl plenty for Nigeria.so in the way u see life Fubara has no blame in all of this?is this how u have been treating people who have helped u in the past?I am not saying wike is Jesus Christ he has his own bad sides but anybody who doesn’t see the bad and treacherous side of Fubara shocks me.i can’t treat anyone who has helped him the way Fubara is treating wike.i no fit.

Let's go back in history a bit. Would wike have been able to become Governor without the push of Amechi, Patience Jonathan and Uche Secondus (then PDP chairman) to mention but a few?

Who amongst them was he ever indebted to? Which of them tried to cage or control him the way he set out to do with Fubara? We know how their love affair ended.

Back to the present. When you say wike helped Fubara win the election, do you mean legitimately or illegally?

He should have allowed for a truly free and fair election so that the will of the people will prevail.

Fubara is the Governor of Rivers State. His indebtedness is to the rivers people.

great points.the truth is all of them na the same.even the Fubara that is fighting God fatherism will stl install someone when he’s leaving office.obaseki fought oshiomole but is being in asue now.im happy with what’s happening to wike.its a lesson to other govs.But u see me,I can’t betray someone who took me to a height I wouldn’t have been able to reach on my own.thats me o and that’s why I left politics.its not a decent game.

He rode on wike’s horse to became a governor,I’m sure they had a game plan then why would he wanto backstab him.
He claimed wike was demanding for some amount of money,does he have an evidence o prove that?
Wike has worked so well in rivers state as a governor,should fubara have any corrupt allegations against him then he should come up with it since you want people to see wike as a bad person.
Fubara knows wike’s antics and his person since they have beeen together in a long time,he shouldn’t have come along with him.
It is politics and it is what it is,some of us are just unreasonably sentimental cos we don’t know how politics play.
