Hello House, please this is urgent! I am applying for study permit but going with my dependants (husband and child). We are on the IRCC webiste now. I have clicked that i am applying for a study permit. Please what for my husband and child apply for? Initially, my husband clicked work permit but it is requesting for my own UCI (unique client identfier) but i do know what it means or how to get it. Please how do i get my UCI? I am confused |

Good day, I was given a removal order because I couldn't not continue my education in Canada and I had serious health issues along the line.I was admitted in a public hospital for long period of time and in this period I applied for asylum but the lawyer that helped to process the application did not do a good job as my doctor was telling me,the lawyer should reach out to him for supporting documents. When I the day for removal was almost due the doctor narrated my ordeal to a canadian(white) lawyer and the lawyer felt bad about my situation and asked the doctor to drive down to my house on the day I was scheduled to removed from canada and both of them whisked me away to the hospital for admission. The lawyer was able to file 2 months extension for me but finally the 2 months extension elapsed and I arrived in Nigeria early this month. My question, can I apply for PR from Nigeria or what should I do as my visa will expire in December 2025 |

Wow such a touching story. The mistake you did was to go for Asylum which is not your best bet. Even if you have the best lawyer, when facts are not convincing the Asylum case will be lost. For others here, when you find yourself unable to pay school fees due to illness or fund (mind you if you are using fund you must explain what happened to your PoF because it was based on that you were given study permit), what you need to do is to apply for Open Work permit under distressed student. It is a provision by IRCC for International students with genuine reasons for not been able to continue there program maybe due to death of their sponsor or illness or some drastic events that can actually stall your study progression. You may be lucky to get two years Open Work Permit and its enough for you to forge your future in Canada. Asylum should not be your 1st option. A lot of people dont know about this option and I hope people will not start abusing it either, cos our people can abuse privileges. I know the failed asylum records makes it a bad case especially among the 5 eyes countries that collaborates with Canada to share info yet I will advise this fellow to approach the service of an experienced Canadian Lawyer who can examine your situation and advise accordingly. There are provisions for distressed workers too if you can proof your LMIA employer violates your employment contract and you are unable to continue working under them, you may be granted Open Work Permit based the proof of your case. Everything is not Asylum, it can backfire a great deal. |

Its not easier but if you go out of status with that option, you have opportunity to reapply again should you have to leave Canada. Can you do same with failed Asylum? Let us learn to think long term when taking decision not easy pathway. oluayebenz: |

Jeboy:All these options might have worked 3 to 5 years ago in Canada, but not now in 2024. The employer who sold you the LMIA won't go down without a fight because you're putting them in trouble with a criminal case, and they'll go all out against you, knowing exactly how you got the LMIA. The distressed student option no longer works, with over 13,000 international students out of school within 9 month , and the system ,the government and the public knows it's due to financial reasons, which are now becoming political. This is the worst time for any student to drop out of school and claim asylum, with the chances of winning the case being extremely low! |

You are getting it all wrong, I will advise you read slowly and assimilate. The option I shared is you can claim being a genuine distress student with proofs (which I believe the poster could easily defend with his experience of sickness and medical proofs) and get open work permit not Asylum as you have just concluded. Read again please as you are distorting the information I have shared. I believe you re not aware of this option and what everyone knows and goes for is Asylum which is very convenient but complex with damaging outcome if not done rightly. The post is to enable us aware of options in cases where one is genuinely affected. Finally, you dont get Canadian asylum by stating that you are in financial distress otherwise people will be getting the asylum. They claim something else that is complex to proof. funkyy598: |

The correct approach would have been to restore status within the 90-day window, either as a student or a visitor due to illness, before seeking a work permit. Skipping these steps suggests an intent to work rather than study, which can be viewed negatively, especially now with many students out of school. I'm speaking from a practical perspective in 2024, and you can connect with students facing tribunals to see the rejection rate. The majority of students seeking asylum are now being rejected, so using the excuse of being a distressed student is likely to fail. Note that when a student arrives in Canada in 2024, immediately collecting a student permit and work permit at the point of entry and then arriving at school, if they later drop out, any asylum claim made afterwards is likely to face a significant risk of failure! |
