Dogalmighty17:This is myopic point of view. You grow old and you will appreciate passive income and good health than any other thing in life. Everything is not all about quick cash and fast ROI. One of my uncles is regretting not acquiring all the real estate properties that were cheap in the mid 80s just like some of his friends did. Now he is 70+, his children are yet to break even, he has no choice than to go out there and hustle for salary work at old age At present, his friends are enjoying passive income from all the properties they acquired back then. Some of them flip part of the properties to feed themselves and cater for the family and community. The case is different for my uncle, he has to leave the house latest at 5:30 am so that he will arrive workplace early. Worst part, transportation eats large chunk of his salary. |

Darlingme:What you do is this: 1. Get a lawyer to prepare a 6 month quit notice notification for the tenant with NBA seal 2. At the expiration of the 6 month, if he still refuses to go your lawyer will then forward to the court with the quit notice notification letter to get an eviction notice which the court will give him 7 days to go. 3. If he still refuses, the court will then give your lawyer an eviction letter which he will give to the Police to go and forcefully evict him. With this steps taken, he cannot challenge you anywhere even in the court for evicting him. But if you use any other method apart from this, he can challenge you anywhere even in the court and purposely drag the case for years and until judgement is made you cannot evict him no matter what. Remove the roof and see how the court will tell you to go and fix it back and then still ask you to pay for damages. So it's always good to do things legally. I am talking from experience |

beyep:This is purely a civil matter please. You only need to approach the court. And the process is not as easy as you may be thinking. Since the tenancy has been determined, such a person is now a tenant at will. And as such, notice to quit is no longer required. The landlord will have to serve a 7 days owners intention to recover possession. After this, the landlord can now sue the tenant. Both parties will be held and the court will give a judgment. Only the court of law can evict a tenant. |

Darlingme:There is no law like that. The tenant is grossly ignorant. In fact, that person is no longer a lawful tenant if the rent has expired already. So, he or she is not even entitled to a notice to quit anymore. Talk to a Lawyer to be guided so that you don't make costly mistakes in trying to recover possession. Because even though, such a person is only a tenant at will, he/she still enjoys certain protection as provided by the law. There is a legal process you MUST follow. |

A Landlord, Patrick Emeka Onukafor, 50, Has been arrested by the police at Ago Palace, Okota, Lagos, and charged before the Cele Magistrate's Court for conduct likely to cause a breach of peace. He was accused by his tenant, Edith Ndu of an attempt to eject her from the 3 bedroom flat she occupied at 1, havana street, Ago-Okota, by dropping a live snake in her flat. Apart from dropping the snake, she also accused him of recruiting thugs and fake policemen to intimidate her, even though she didn't owe him. She reported the matter to the police and the landlord was arrested. In his statement to the police, the Landlord said that the tenant owe him one (1) year rent and she refuse to park out of the house. Hello NLs I type this message with a very confused and worried heart because i don't know what to do next, I had financial challenges after losing my job in 2008, I had to cut down on my living so i moved from my 2 bedroom flat in Ifako Ijaye to a room and parlor house off AIT road, Alagbado, I am married with 2 kids and we live together here, we are the last of 5 tenants, my second year rent just ended February 2016 ( Last month), I owe no house rent nor electricity bill nor lawma bills. I was able to manage my home with my farm management job. My landlord arrived by late January from London, Uk where he is based and said i should not bother paying this year's rent that we should all pack out of the house, He said some two tenants who have been in the house for many years owes him money and they also don't pay bills, he wants to send everyone packing and he gave us just 5 DAYS to move, I explained to him that i have not gathered enough money to rent new place, He said he will refund a year rent for me which is 60k (5k monthly for the 2 rooms). I was satisfied because i had about N50,000 in my account and i have been planning to move out of this out because i am not recording any progress since i moved in. I believe i could get another place with that amount. He did not promise the others any help before he left. The two oldest tenant that have stayed for about 7 years told us after he left that he will still come back to collect the rent, that is his usual method whenever he comes around. He has been telling them to vacate the house since first year they moved in, To cut the story short, I started looking for a place and i got a place, I called him for the 60k promise to add to what i have to pay the rent. He started posting me until i got tired of calling him only for him to surface again on Sunday 13th of March after a month plus with a bricklayer, they started blocking the back door with bricks, he said everyone must move out, after much pleading, he blocked off the two old tenants while they hurriedly move out their belongings, their belongings still litter around the compound, he blocked off the toilet bath and kitchen and he brought an electrician to disconnect the light. We are now left in darkness with no bathroom toilet and kitchen. He said he is coming back again for the rest of us by Friday 18th of March with OPC to move us out. I pleaded with him that i have gotten a new place that he should give me the money he promised so i can pay for the place and move in there before friday. He said NO, he insisted that i will have to pack my properties outside first before he can give me the money. The people who live on the same street with us started coming in with different stories of how the man has ejected tenants in the past, How he sometimes bring in Nigerian Army to throw people out, How he is heavily charmed, How he has placed charms on the four corners of the house and people started dying until they moved out, Although i don't believe that any evil power can overcome me, i am not afraid of charms because i serve a living God. They said that is how he usually promise people he thinks can resist him and he will suddenly storm the house and move them out. They were telling me with assurance that he will not give me a dime. I am concerned about him coming with who ever he has in his plan to throw my belongings out when i don't have anywhere to go or money to get another place. I do not owe this man any rent, I still have the teller i used to pay the last rent into his account. He has not served me any letter or quit notice. Please mods i plead with you to help me move this to front-page so i can get advice and possible help. I don't know exactly where to post this but please help me move it to the right session. This is going to be on hell of a long post. Please read and bear with me. I'm writing on behalf of someone who happens to be my bestie and her mom is like my mom too. So bestie's mom is a civil servant that earns on monthly basis, she took loan severally to build herself a house located in ogun state. With plenty of pains, starvation and hunger she finally completed 4 flats of two bedrooms each after like 10 years. Ever since the building has been ready she has never for once enjoyed steady flow of rentals her tenants, it's either they are unable to pay and get kicked out or the new tenant comes up with a story of how his business went bad. The house has been ready for not less than 6 years now with various categories of tenants. Mom is really sad and decided to hand over to a caretaker, the caretaker suggested that all old tenant be sent out and fresh new people taken in. The debt of some of the old tenants was up to 2 years oo. For one particular guy who happened to be a colleague of my friends' mom , his own debt is up to 3 years without single pay. He keeps coming up with cock and bull stories. The idea of the caretaker was that mom holds a meeting with the tenants and tells them that she sold the house to someone and that the old tenants should move out as per they don't kuku have rent in advance. The meeting was held a lawyer was called and quit notice was served to those tenants giving them 6 months. Now the issue is 6 months lapsed with 3 month on top of it. Meaning for going to 3 years for some tenants no pay and she hasn't gotten paid for 3 years by any of the 4 flats. Salary isn't steady again, debt has risen and bills has skyrocketted. My friends' mom seriously and badly needs money. The supposed caretaker and Lawyer isn't handling the issue like they should and our mommy is fed up. The caretaker keeps saying she should still hold on because if the matter is taken to court it might even take much longer than it has already. She keeps thinking about it daily and begin to get worried that it's not worth the stress building a house. These tenants are bunch of frustrating beings. Is there a way to send those people out more quickly? Have you ever been in this situation and how did you handle it? What are the consequences of getting a court involved? I will make this as short as possible There is this tenant that we gave quit notice since 2018 because of inability to pay the house rent. Up till now he has not moved out, we handled the case legally and its still in court till now. This is the 3rd year that the man and his family have stayed without paying 1 naira because of our poor judicial system, we are still hoping the court will eject them this year. Now there is another tenant that is very close to the man's wife, she did not pay 2019 rent and she was given quit notice 6 months ago to leave before December 31st, up till now, nothing has happened, we think she wants us to open a legal case so that she can stay for some more years free of charge like her friend. Seeing this got me thinking. Well let me be brief with this. Good day landlords, engineers, architectures and all. I have a decent 3 bedroom, 2 parlor bungalow with all facilities intact that’s nicely seating on a secured plot with interlock and a beautiful seat out vegetation along the Benin/Agbor bypass. I spend lots of money on maintenance, clearing, cleaning, security and (painting the structure almost on yearly basis) which is much for me and I feel the need for it to be occupied to cutout these expense because I have no current or future plan relocating or using the said apartment. All facilities are intact. I intend to rent it out at a very discounted rate so it can be occupied. Although I do not intend to collect AGENT/AGREEMENT FEE, but CAUTION FEE will apply In as much as I don’t want the house to look depleted because of most tenant’s attitude, it’s also clear that some tenants are cultured when handling other people’s property. I am so worried about lack of maintenance by occupant(tenant) as I based in Lagos and work offshore and rarely, do I travel to Benin or neither do I have direct family(ies) that base in Benin. I need honest advice from landlords whom may have had similar experience. |

Please, can anyone highlight the procedure for ejecting a tenant from one's building in lagos? The said tenant was owing over 1 years rent, not paying and not leaving. Tenant was charged to court. The case has been ongoing for more than a year. Tenant and her lawyer do not show up in court on hearing date and have been adjourned for this reason each time... I moved into this apartment about two weeks ago. Mini flat, only myself, excellent neighbourhood; I'm constantly indoors and not social. But the landlady has been a pest so far. The property has three tenants, but only one has been there for over a year. The renter I replaced still works for her today, but quit the house only after a year. The longest-tenured tenant (five years, married man with kids) warned me about her before I moved in. That she meddled in the affairs of her tenants. He is also desperate to leave the house this year. Under the pretext of protection, she herself told me that she routinely informs her tenants' families of every move they make. Today, the camel's back broke. A female acquaintance of mine recently stayed with me for some days. The landlady took offence and informed me that she does not want any female visitors except a known girlfriend. Before relocating, she had also said that she did not want much male visitors in order to avoid disruptive behaviour. Made sense to me security-wise. Wasn't a problem since I don't have male friends. The next day, I saw her and informed her that an animal was running in the roof, as well as other anomalies I had noticed in the apartment. She said that it seemed I was dissatisfied with the home and that she would provide a full refund without delay. I made certain to inquire whether the prohibition on female visitors was on security grounds, but she said that the residence was a Christian home where everyone must be family, notwithstanding the fact that the tenant before me was a muslim. Today, my agent came on my door and informed me that the landlady had complained to him. We subsequently met with the landlady, who once again threatened a complete refund. She continued by saying that I am too young to have female companions because they would destroy my life. I'm 23. This evening I took the decision to collect the refund, cut my losses on the agreement and commission, and look for a new flat in the vicinity. I had only heard rumours, but I had no idea such toxic home owners exist. The husband of over 33 years is pretty laid-back and even made a joke about my bringing a female acquaintance around to my guarantor. Words of Wisdom. You are perfectly right. Most investment that would sustain you at old age makes little or no profit at all while acquiring them at your young age. Just like buying a large parcel of land or building a house for rent. If you look at the rents been paid to the value of the house and even maintenance, it's nothing to write home about. However, it's still your house and will ever be your house except you decide to sell it. The joy of being a landlord is the companionship with other people that aren't your family. Some great relationships developed from such and last for a life time. Tenants rents is mostly a long life pocket money for a landlord, especially if it's an old aged landlord. But younger landlords of nowadays gives little interest in tenant rent. Most younger landlords this days just employ a lawyer to collect the rent and put it in a particular account. They don't have that time to be asking a tenant question, most tenants don't even know their landlord but the lawyer alone...... richkal: |

Get a lawyer. Get police to oversee changing of the access and exit locks only when no one is in the house to avoid false imprisonment. The property should then be marked "sealed by the police; no forced entry". That way he can't access the building. The rest of the matter will be decided by the court who will issue the tenant with injunction to vaccate the property. These will cost you some money but what options have you got? Good luck. |
