I see alot arguments that the 6 months quit notice given to tenants is free and they don't pay a dime Case in point this thread https://www.nairaland.com/6450878/landlord-gave-me-6months-quit Like a tennant will drag you to court and they'll give him 6 months to live free of charge on your property? If that's the case then tenants will be renting houses every now and then only to cause trouble with the landlord in the hope that the matter gets to court so they can give him free use of the property for 6 months. After 6 months, he looks for the next available landlord to prey on. |

You must give the tenant notice to quite 6 months before expiration of his rent not after expiration of his rent. Otherwise wicked tenants will abuse the loophole in the existing law to stay in your house free. |

Immatex:This is the correct explanation of 6 months notice. You did justice to it. The owner must give the tenant 6 months evacuation notice before the expiration of his current rent. Immatex:Currently have one who's used his disability (blindness) to abuse the period he's meant to stay! At the renewal of his tenancy I informed him in writing there's no renewal after the current one he's to pay is ended... Several reminders later and the rent expired in July, he's now quoting laws upandan...now lawyer is waiting for the extra 3 months he awarded himself to expire...the the law will take its course. Lawyer said he must pay. |

Immatex:What if he did not get the notice like the notice was not communicated properly to him especially in a situation where he is outside the country but his wife or children are the ones occupying the property before and within the expiration of the rent |

blacksam01:My landlord took me to court once. The magistrates gave me six months on top the three months I lived after my rent expired. So, forget what you hear. 6 months is a legally binding right of a tenant. |

immaculatesense:Lol who told you it's rent free? You will pay for it. A tennant can decide to pack out at anytime. Some won't even inform the landlord. You'll just come one weekend and see that the house is empty and he has left your keys at the door . If a tennant can decide he's no longer interested in staying in your house before and even after his rent is due, Why can't a landlord also tell you he doesn't want you again when your rent is due? If you take the matter to court, the 6 months they'll give you is not for you to live rent free. It's simply for you to have more tike to get another place. A lot of Nigerian landlords collect agreement fee from tenants but have zero knowledge about what it's all about. Let me explain, if you're a landlord, have a lawyer on standby, whenever you're giving out your house, have that tenant sign an agreement with your lawyer. The agreement could be that he would be given 3 weeks grace after expiration of rent, after which the house shall be given to another tenant. As long as it is signed by the tenant, belive me, he doesn't have any case in court and you don't need to wait for 6 months before throwing him off your property. The reason why tenants deliberately refuse to pay and would prefer to go to court so they can have a free 6 months to enjoy is because there is no agreement binding their stay in that house. If there is, the verdict of the court would be based on the agreement you signed with your own hands and not the law. |

6 months grace period is where there is no written agreement between landlord and tenant. However if rent agreement says either party to give 3 months notice before exit and it is signed by both, it becomes binding instead general application of 6months |

NewDelhi:If you are a landlord, make sure to calculate well and give your tenant the 6months quick notice that will align with when their rents will expire, otherwise, you’ll find yourself in this situation. For example, if a yearly tenant’s rent is to expire on the 31st of December, make sure you give them a 6months quick notice starting from June 31st. |

It's not free. The tenants have to pay the rent provided he was informed as stipulated by the law. For instance if your rent is to expire by December and your landlord inform you by December that you have to quit the house by June, then you'll pay the 6 months rent and then quit the house by June |

In addition: Under Section 13(1) of the Lagos State Tenancy Law: Where there is no stipulation as to the notice to be given by either party to determine the tenancy, the following shall apply: A week’s notice for a tenant at will One (1) month’s notice for a monthly tenant Three (3) months’ notice for a quarterly tenant Three (3) months’ notice for a half-yearly tenant Six (6) months’ notice for a yearly tenant So yes, a six-month quit notice is legally required for yearly tenants, unless the tenancy agreement states otherwise. If you are the type that pays your landlord in bits, that is "whenever you have", you are entitled to just one week notice in Lagos State |

ARISHEM:E no really concern you. Just ensure the notice is received by someone in his apartment, then using the number on file, call him (recorded) and let him know he has been given a notice. If he claims he didn’t receive it, then contact your lawyer right away, as he technically no longer lives in the apartment, and is subletting it. |
