Wike and his men messing up the judiciary and judges. Supreme court had ruled b4 I don't see why this issue was taken to court in the first place. Why stopping a convention of an opposition party?

With PDP split down the line, there is no time the court will not intervene.
That Supreme Court ruling in LP was ok, but in this PDP case, it cannot stand.
The judiciary will have to come in before they start killing themselves.

As long as INEC is concerned, Damagum and Anyanwu are still in-charge. The 608th NWC meeting held showed that out of 19 NWC members of PDP, 14 were present and signed for the suspension of four officers for one month. This is an internal party matter. (All their signatures attached and they formed a quorum).

The other four can be invited as guests to Ibadan. So the Party is not fractionalised. I have read Omotosho judgement, even INEC backed the Damagum-led NWC, surprisingly the Judge did what he is best known for.

The whole meat of this matter now is: Does the Court have jurisdiction to pry into affairs that concerns Congresses, membership and leadership of political parties?

If it does not comply with the law, It won't stand.

The Judgement earlier at Abuja High Court said INEC should not recognize the outcome of the convention for not complying with party constitution and electoral law.

If it is not recognized and supervised by INEC, then it is an act in futility since they did not appeal earlier judgement.

Every action by the waring parties kept playing into Tinubu's favour.

Matters about a political party’s congress to elect officers of any level of its executive committees, the constitution of such executive committees, and matters related to the administration of the party are its internal affairs and not within the jurisdiction of courts. In other words, the issues of party leadership and or membership are domestic affairs of political parties and non-justiciable. So, the issues however they arise cannot be entertained by a court. Only a primary election congress is open to litigation as a pre-election action by virtue of section 84 of the Electoral Act 2022. A congress to elect officers of any level of the executive committees of a political party has to do with the internal management of the political party. It is non-justiciable. Therefore, a court or tribunal has no jurisdiction to entertain any dispute arising therefrom. In this case, the preponderance of evidence adduced at the tribunal was that the 4th respondent complied with the order of the High Court of Plateau State by conducting a repeat congress on 25th September 2021.Consequently, the Court of Appeal erred when it went into whether or not the congress was properly organised or conformed to the dictates of the Electoral Act or the 4th respondent’s constitution and guidelines. Therefore, the judgment of the Court of Appeal was founded on a faulty premise that it had jurisdiction to determine pre-election and non-justiciable matters. Hence, that judgment is therefore set aside.

Fayose & Wike Have Brought Shame To PDP – Ali Sheriff

PDP national chairman, Ali Modu Sheriff gave a statement after his Victory at the appeal court. He said he will restructure the party in such a way that Governors Ayo Fayose and Nyesom Wike cannot contain because they have brought “shame” to the party.

Muazu Magaji, a former governorship aspirant of the Peoples Democratic Party in Kano State, has alleged that the Governor of Rivers State, Nyesom Wike, lobbied members of the party’s committee constituted to advise the presidential candidate, Atiku Abubakar, on the choice of his running mate.

Magaji disclosed this while speaking on Channels TV’s Sunrise Daily, on Thursday.

The Kano politician also argued that there was no proof that Atiku promised Wike the vice president position as claimed.

The PDP committee had recommended the Governor of Delta State, Ifeanyi Okowa; Governor of Akwa Ibom State, Udom Emmanuel and Wike.

The committee, however, scored Wike above the other two contenders but Atiku decided to settle for Okowa. A decision that has since unsettled Wike’s camp.

Magaji, however, claimed that Wike lobbied to be scored ahead of others, adding that the Rivers State governor should not be trusted with important positions in the country.

Then, the race began in earnest for three years now, reaching a frenzy with the works of the two PDP committees on zoning. The first was the Gov Ifeanyi Ugwuanyi committee on the zoning of the PDP party offices. The Ugwuanyi committee quickly told the world the committee’s assignment did not cover zoning the office of the president. Though this was true, the question is: why didn’t the Ugwuanyi committee zone the PDP chairmanship to the North without aligning it to the divide that would produce the PDP presidential flag-bearer? The second committee headed by Gov Samuel Ortom of Benue state was specifically on the zoning of the presidential ticket and, with the votes of the representatives of all the 17 Southern states without any exception, the Committee unanimously recommended throwing open the PDP presidential ticket, which the PDP NEC simply upheld.

One thing irrefutably stands out – Wike shot himself in the leg. Here was a man who had an overarching influence on both committees but could not insist that the ticket be zoned South. Many had wondered why? The reason is also relatively in plain sight: the Southeast factor. As the clamour for zoning of the presidential ticket of the PDP to South reached its crescendo, many had pointed out the fact that though the PDP Constitution had prescribed zoning of the office of the president to be between North and South since the South-west and South-south had taken their turns in producing the president and the vice in this current dispensation in the persons of Olusegun Obasanjo and Goodluck Jonathan, zoning this time around, should not just be to the South but the Southeast.

Atiku Abubakar went a step further by offering to step down from the race if it would be agreed that the touted zoning to the South would mean micro-zoning to the Southeast. Wike and the rest could not take the Atiku challenge maybe because Atiku would likely back Peter Obi, who was his vice-presidential running mate in 2019 and an ally. The prospects of Peter Obi picking the ticket if PDP zoned South was so real compelling Wike to go for an open contest, believing he could pick it up ahead of Atiku, Tambuwal and Bala Mohammed, given his large war chest.

The convection that has already been put on hold by a court of the same competent jurisdiction,the only court that can over turned it is an appeal court. Any outcome of that convection remains null and void.

I'm familiar with this judgement. But the courts including the Appeal Court ignored this longstanding principle of the SC. However, in the case of Zamfara and Rivers in 2018, the same SC delved into matters of congress and elections of delegates did it not? If it prevaricates, where does it have the moral rights to accuse the lower courts of contempt for its principles?

You need to read the judgement by Justice Omotosho, you will weep

The case is framed against the PDP National Convention Committee. INEC is only asked to carry out its responsibilities. the judgements and decisions were to the 1st-3rd defendants.

The subject matter ab initio, is what confers jurisdiction and not whether the party is a FG Agency or not.
