The BBC seems to hint at the reason why this change is likely coming into force later this year and not next week like the changes to asylum https://www.bbc.co.uk/news/articles/cp32ddzdjxko

Labour has priced in their likely failures in the May elections already. They'll also have planned how to make their changes definitive. For what it's worth, both Starmer and Mahmood are lawyers.

Many won't. Most people did not get sponsorship right off the bat so a lot will still get locked in. There's nothing that suggests they cant bring something up again when people are due at the end of their proposed 10 years

The (only) precedent is HSMP overturning the ILR extension and other new requirements which were applied to all skilled workers at the time. The main reason HSMP was successful is because they were able to prove legitimate expectation based on an unconditional and unambiguous guarantee from the Home Office of settlement in 4 years "regardless of any revisions" to the scheme.

AFAIK, no such explicit guarantees have been given since HSMP so it will be a lot more difficult to prove legitimate expectation in court - and even where it exists, legitimate expectation can be lawfully overridden if there is an overriding public interest or it is demonstrated that the change is a proportionate response to new circumstances.

There is probably a stronger chance in arguing proportionality.

There's too much optimism around this issue if you ask me. I expect by now folks should have started doing some basic research on other options rather than all these petitions, surveys, legal challenges etc.

Life itself is full of uncertainties and this is just another one folks will have to wiggle through. I don't see optimism as a strategy here.

People should have started to make plans immediately the white paper and all came out but I guess they are still waiting for youtube influencers to tell them the next step

The changes, cannot be retrospective...... Those on the old system, would still qualify for the 5 year route......

Once the white paper becomes black paper, only new applicants going 4ward, would be caught in the 10 year trap..... But if Kemi wins, she might make it 20 years...... 😉🤔😂

The stats are not good & its a reasonable decision

I see further changes like "If you have arrived on a student visa, you will not be eligible to claim asylum" based on this --> "According to Home Office figures, 39% of the 100,000 people who claimed asylum in 2025 did so after arriving in the UK through a legal migration route such as a study visa."

That’s usually the progression; they will start by claiming they after only criminals, then move on by saying any illegal is a criminal then from there they will go after legal residents saying it’s not a right but a privilege then finally pounce on settled ethnic minorities by saying they are not English or British or attack DEI policies! It’s like this ‘my parents and grandparents were proper and legal migrants (asylum seekers o) who made lots of net contributions to this country unlike you immigrants now coming here for benefits’ 😂 I understand what it means to be British unlike you! In summary am British but you cannot be one as our country shouldn’t become an hotel.
