Only a court of law that have the constitutional right to sentence a Criminal suspect to death and not even the police.
The right of the police is to arrest and prosecute the suspect.
By law it is extrajudicial killing.
Nobody have the constitutional right to condemned a criminal unless the court of law.
If it was during a gun battle or shoot out, then the killing will be backed by the rules of engagement.

If he is a jihadist territorists, or armed robber/kidnapper, then job well done... otherwise it needs investigation.
