[size=16pt]Justice Kumai Bayang Aka'ahs (JCA) (CA/C/15/2009) ruled that Comandclem Nigeria Limited is the Statutory Inventor of the Anti-Corrosive Special Paint for Q.I.T (Mobile Blue Oil Enamel Paint) in his Judgment of 8th Dec, 2009.


But Justice Kumai Bayang Aka'ahs (JCA) failed to award multi-billion dollar monetary compensation, damages, and most importantly royalties because Justice Kumai Bayang Aka'ahs (JCA) claimed that Mobil Producing Nigeria Unlimited never continued to use the aforesaid patented invention of CCNL after the registration of the invention by King Professor CJA Uwemedimo on 5th of August, 1999.



Because of the deliberate failure of Justice Kumai Bayang Aka'ahs (JCA) to award multi-billion dollar monetary compensation, damages, and most importantly royalties against Mobil Producing Nigeria Unlimited, CCNL now appealed in the Supreme Court of Nigeria sometimes in 2011.

Arise O Compatriots: A Matter Of National Security By Ken Oloye


We must heed the clarion call. There is a judicial tsunami. A national earthquake brimming. A judicially-induced national eruption of volcanic proportion. Will we only brace ourselves for the apocalypse or take precautions? The ball is in our court to do what is needful to forge a better life for ourselves and the future of our Nation. We must sail the Nigerian ship to a land of safety and greatness.

Already Nigeria has a very bad name. Foreign countries don’t want to associate with Nigeria except when we lure them with something juicy at our own detriment. The situation on home soil is nothing encouraging as our youths curse Nigeria on daily basis while they seek greener pastures abroad. Nigerians in the Diaspora experience stigmatization and racism all over the globe and it is so unfortunate that their plight means nothing to the Government. We are our own undoing.

We have been blinded by personal gains and aggrandizement and that’s all we want from our involvement in politics. We are lost like a sheep without shepherd. Like a lost ship we wander the oceans hoping for a water goddess to show us the way. There are a thousand experiences to cite as it is no more news that nothing is working in Nigeria.

It is a national disgrace. We should bow our heads in shame and rethink. Does anyone remember the response of U.S. President Barack Obama to our plea for ZMMAP? An experimental drug famed to be the cure for Ebola virus that was used to treat two Americans on Ebola's death row was requested for by the Federal Government and President Barrack Obama was not economical in his outright refusal. He landed a punch that left us sprawling with a bloody nose. He asserted that we have failed to build strong public infrastructures over the YEARS hence, we deserve no pity. Nigeria has since been excluded from various grants.

While we have the resources and the skill to avoid our shameful begging and dependence on foreign aid, we still find ourselves in a sorry state. Why? A typical example is what brewed in our Judiciary in recent years. A classic case of how we sell our birthrights for a plate of porridge or morsel of bread. Suit: SC/69/2011 before the Supreme Court tells it all. While the United States basks in the glory and riches brought by various inventions including the recent ZMAPP we begged for, our judiciary and leaders are suppressing creativity and discouraging inventions.

Inventions and innovations during the Industrial Revolution were main contributing factors to the process of acceleration of the industrial development of Great Britain. Its industrial sector benefited from trade protection and other forms of government intervention in the trade flow through the Navigation Act and by means of political power and even military power. What has happened to our Patent and Designs Act? Bill Gates comes to mind for the effect of his invention on the United States economy and I will not forget in a hurry his financial grants towards eradication of Polio in Nigeria and many other various noble acts. In Nigeria we still apply for grants from the Bill Gates Foundation till date. Inventors are celebrated around the globe. America didn’t smile on the infringement of Apple patents by South Korea-owned Samsung. The court was not undecided to speedily do justice.

It is a different story in Nigeria. The history of suit SC/69/2011 at the Supreme Court of Nigeria over infringement of patent rights is a classic case of how judges auction judgment for sale and jeopardize the future of our Nation and that of all stake holders. The invention called the Anti-Corrosive Special Paint is the enabling paint that makes possible the exploration of Crude oil offshore. It is being used by many oil multinationals in their daily operations and offshore oil drilling is impossible without it. The proud Nigerian Inventor of this enabling paint has been cheated, humiliated, and persecuted for more than 14 years by the oil multinationals that make use of the product, by the judiciary that has by ignorance and corruption denied him Justice and by the Federal Government that turned deaf ears to the cry for intervention in this cruel act. King Clement Uwemedimo, the proud inventor of the Anti-Corrosive Special Paint is yet to get rewards for this invention.

We care less about our resources, leaving it to ravaging wolves to plunder while we beg for crumbs from abroad. Patent RP 13522 issued by the Federal Government of Nigeria on the 5th of August 1999 is worth more than 150 billion U.S. dollars. The Inventor had prepared a blueprint of how the royalties should be used. The building of refineries across the country, provision of stable electricity, industrialization, motor-able and safe roads, employment, a social security scheme that will put an end to abject poverty to mention a few. Despite these noble intentions of our rights, a few corrupt individuals are placing cogs in the wheel of progress.

It is a matter of National Security because the invention is a game changer. It carries the financial power to set Nigeria free of begging and solve our infrastructural and institutional problems. It has the capability to create employment in millions as designed by the inventor. It will send a clear message to the outside world that we the citizens of Nigeria are not terrorists and scam artists. We are good people, hardworking and inventors.

We must all rise against the manipulators and auctioneers of judgment in suit SC/69/2011 before the Supreme Court. This is our own invention worth more than ZMAPP and no one will take it from us. It will be a national tsunami if the benefits of this Invention are lost to corruption in the Judiciary, nonchalance of public office holders, and all Nigerian citizens who are stake holders and automatic beneficiaries of this messianic invention.

Just as we must remove the Boko Haram cancer in our country, as much as need be for eradication of the stubborn Ebola Virus, we must also as a matter of public policy and national security ensure that the royalties of this Invention are gotten and put to noble use in good time.

The attention of the Management of Comandclem Nigeria Limited has been drawn to a possible clash of Id el Kabir festival day with the 7th of October, 2014 hearing date in the case involving CCNL and Mobil Producing Nigeria Unlimited ongoing in the Supreme Court of Nigeria.


The above discovery was made known to the Management of Comandclem Nigeria Limited through Mr. Awoniyi Afeez , a member of Comandclem Patentees’ Association, Nigeria some weeks ago. In actual fact, I appreciate his observations immeasurably in the course of giving the Management lights/directions on how to prevent any possible and unnecessary adjournment in the case.


In less than forty-eight (48) hours to this time, I shall explain in details the plausible reasons why the 7th of October, 2014 may not clash with the Id el Kabir festival day so as to prevent any possible case adjournment.


I have observed that unnecessary adjournment is detrimental to the speedy determination of the case involving CCNL and Mobil Oil.


In actual, it is only Oyewo Muideen Adekunle (A Fake Patentee from Kwara State) that is asking the Supreme Court of Nigeria to adjourn the case of Comandclem Nigeria Limited for additional ninety days (90) so as to make him an inventor. But unfortunately for him, he presented a fake registration receipt as exhibit to prove his case.


I shall address the issue of clash of hearing date with the Id el Kabir festival in less than fort-eight (48) hours to this time. Thanks

1.0 Introduction


1.1 Following a cry out by Mr. Awoniyi Afeez that Eid el Kabir Festival Day may likely clash with the 7th of October, 2014 hearing date on the case involving Mobil Oil and Comandclem Nigeria Limited ongoing in the Supreme Court of Nigeria, I carried out an extensive investigation on the subject matter to uncover its possibility or otherwise.


1.2 To fully appreciate the events that led to 7th of October, 2014 hearing date, there are plausible needs to review the pronouncements of Honourable Justice Walter Nkanu Onnoghen (JSC) on 5th of May, 2014 in the Supreme Court of Nigeria. As a result of this, I will exhibit an extract of blow by blow account of live proceeding in the Supreme Court of Nigeria on 5th of May, 2014. Happy reading.


2.0 An Extract Of Blow By Blow Account Of Live Proceeding Of Event On 5th Of May, 2014.


After the dismissal of CCNL appeal by the court,
Honourable Justice Walter Nkanu Onnoghen (JSC) said and I quote him verbatim as follows.


“At this stage of the proceeding, Doctor Atake, the S.A.N., has asked for a date for the hearing of the Cross Appeal, any other matters will be dealt with in the Cross Appeal if need be on a date to be adjourned now, and agreed upon now or fixed by the court now. “


The lawyers of Mobil Oil said
“Adopted.”


The court room remained silent for a while and
Honourable Justice Walter Nkanu Onnoghen (JSC) softly said to Dr Atake as follows.


“Doctor atake, I didn`t know you intend to put-on some weights? “


The judges were laughing and all the lawyers of Mobil Oil were also laughing in the court room.


Mike ozekhome stood up with dangling fingers and elaborated smiles on his face and he said.


“My Lord Sirs, it has nothing to do with age but a lot to do with the money………….., money……….., money……………….. Sirs. “


After a while, Honourable Justice Walter Nkanu Onnoghen (JSC) said loudly as follows.


“Yes, the Cross Appeal is adjourned to 7th of October, 2014 for hearing.”


The lawyers of Mobil Oil said
“Adopted”

3.0 The Reasons Why Eld El Kabir Festival Day May Not Clash With The 7th Of October, 2014 Hearing Date.


3.1 Having ruled that the hearing of the Cross Appeal filed by Mobil Oil has been fixed for 7th of October, 2014, Honourable Justice Walter Nkanu Onnoghen (JSC) also categorically stated that the court will entertain other applications/ matters in conjunction with the Cross Appeal on the same day. One of such matters is the Restoration Application filed by CCNL on 11th of August, 2014 in the Supreme Court of Nigeria.


3.2 Detailed explanations as to why Eld el Kabir festival day may not clash with the 7th of October, 2014 hearing date in the case involving Comandclem Nigeria Limited and Mobil Producing Nigeria Unlimited ongoing in the Supreme Court of Nigeria, I shall adopt three (3) approaches to corroborate my arguments namely as follows.

(1) Religious Approach

(2) Scientific Approach

(3) Legal Approach



4.0 Religious Approach


4.1 This methodology takes into consideration the number of days in the months of Shawwal (10th Month of Islamic Calendar) and Dhu al-Qi`day (11th Month of the Islamic Calandar) to determine Eld el Kabir festival day in 1435 (year 2014). It is indisputable that Eld el Kabir festival is celebrated on the 10th day of Dhu al-Hijjah (12th Month of Islamic Calendar).


4.2 So, the number of days between the end of Ramadan (Eid al-Fitr festival day) and Eld el Kabir festival day may either be 69 days accurately or approximately 70 days depending of the sight of moon.


4.3 Information at my disposal shows that, Shawwal (10th Month of Islamic Calendar) has twenty-nine (29) days while Dhu al-Qi`day (11th Month of Islamic Calendar) has thirty (30) days in 1435 (year 2014).


4.4 Arithmetically, the number of days in between Eid al-Fitr festival day and Eld el Kabir festival day in 1435 (year 2014) is sixty-nine (69) days as stated in the analyses below.


Shawwal (10th Month) 29 days
Dhu al-Qi`day (11th Month) 30 days
Dhu al-Hijjah (12th Month) 10 days
Total number of days 69days


4.5 The Federal Government of Nigeria declared 28/07/2014 (Monday) and 29/07/2014 (Tuesday) as public holidays to celebrate the end of Ramadan (Eid al-Fitr festival day) in 1435 (year 2014).


4.6 From the above information, let us now determine/ calculate Eld el Kabir festival day for 1435 (year 2014).


4.7 28/07/2014 (Eid al-Fitr festival day) plus 69 days = 5th of October, 2014 (On Sunday).


4.8 The Federal Government of Nigeria can only declare 6th of October, 2014 (Monday) as a public holiday. The 7th of October, 2014 may not be declared as a public holiday because of the LEGAL APPROACH which I will explain in the course of my respond to this issue set aside for determination.


4.9 From the information above, I have been able to demonstrate that the hearing date schedule for October 7th, 2014 in the case involving CCNL and Mobil Oil may not clash with Eld el Kabir festival day.


4.10 Please, your attention is drawn to the Legal Approach at paragraph 6.0 for you to appreciate my arguments on this issue. Thanks.


5.0 Scientific Approach


5.1 This approach entails the adoption of meteorological research work to forecast dates and months with the aid of sophisticated weather and climate equipment.


5.2 Unprecedented development in science and technology in recent times has made forecast and prediction of days and months accurately reliable. The prediction of solar eclipse is a living testimony.


5.3 With respect to the forecast and prediction of Eld el Kabir festival day for 1435 (year 2014) adopting Scientific Approach, it has been confirmed that of Eld el Kabir festival day may either hold on 4th of October (Saturday) or on 5th of October, 2014 (Sunday).

5.5 From the information above, I have been able to demonstrate that the hearing date schedule for October 7th, 2014 in the case involving CCNL and Mobil Oil may not clash with Eld el Kabir festival day.


5.6 Please, your attention is drawn to the Legal Approach at Paragraph 6.0 for you to appreciate my arguments on this issue. Thanks.


6.0 Legal Approach


6.1 This methodology takes into considerations those legal conditions to be satisfied before a particular day can be declared as a public holiday in Nigeria.


6.2 In Nigeria today, the only law that regulates public holiday is called “Public Holidays Act, (1979), Chapter 378 Laws of the Federation of Nigeria”.


6.3 From both the Religious Approach (Paragraph 4.0) and the Scientific Approach (Paragraph 5.0) stated above, my arguments are Eld el Kabir festival day for 1435 (year 2014) may come up on 5th of October, 2014 (Sunday), even on 4th of October, 2014 (Saturday).


6.4 The only issue set aside for determination here is,

Can the Minister for Internal Affairs declare 7th of October, 2014 (Tuesday) as a public holiday in view of section 5d of the Public Holidays Act, (1979), Chapter 378 Laws of the Federation of Nigeria?


6.5 With your due permission, allow me to quote section 5d of the Public Holidays Act, (1979), Chapter 378 Laws of the Federation of Nigeria.
5. Notwithstanding any other provision of this Act but subject to section 3 thereof,

(d) if two days appointed as public holidays fall successively on a Sunday and a Monday, only the Monday concerned and no additional day in lieu of that Sunday shall be kept as a public holiday.


6.6 The interpretation of the above section of the Public Holiday Act is that


(1) If Eld el Kabir festival day for 1435 (year 2014) comes up on 5th of October, 2014 (Sunday), the Minister for Internal Affairs can only declare 6th of October, 2014 (Monday) as a public holiday.


(2) If Eld el Kabir festival day for 1435 (year 2014) comes up on 5th of October, 2014 (Sunday), the Minister for Internal Affairs must not declare 7th of October, 2014 (Tuesday) as a public holiday.


6.7 From the above statutory provision of the Public Holidays Act, (1979), Chapter 378 Laws of the Federation of Nigeria, you will agree with me that the 7th of October, 2014 may not be declared as a public holiday in Nigeria.



7.0 Conclusion.


7.1 I don’t want to over flag a dead horse on this issue of public holiday. Meet me in the Supreme Court of Nigeria on 7th of October, 2014 for the hearing of the case involving Comandclem Nigeria Limited and Mobil Producing Nigeria Unlimited.


7.2 But before I go, it is more reasonable to say emphatically that nobody can predict accurately the future except ALLAH (GOD). In the event that there is a clash of date, the Supreme Court of Nigeria will be duly informed so as to fix a new date for hearing the case.


7.3 My advice is that let us wait and see how the events will unfold in this regard.

There will be Public holiday on October 7th. So don't let anybody deceive you that there will be court seating that day. Beside, Comandclem case was dismissed on May 5 and remain dissmissed. comandclem have only applied for a restoration of her case which is yet to be granted. It was just Mobil cross appeal that was set for hearing on October 7th which is already affected by the eidir-kab public holiday which is set for 6 and 7th October. Beware of deceits.

It is worrisome when people write and speak out of ignorance or frustration. In this struggle, Comandclem has always played its part and should allow the Court to do their job. It is understandable that as patentees, we want return on our investment. It is also not debatable that a labourer deserves his wages because it is biblical. But the way and manner some patentees have been going about it leaves much to be desired. We should know that Comandclem cannot be a judge in its own case. If Comandclem has its way, it would have decided the case in its favour long ago.

Now coming to October 7, 2014, whether it will be declared public holiday or not, we should allow the Federal Government through the Ministry of Interior to announce the date. Secondly, even if 7th of October 2014 is public holiday, the Supreme Court in its wisdom will defer the hearing to a closer date that may not exceed two weeks. For instance, the Federal Court of Appeal Calabar Division had adjourned the case involving Comandclem and Mobil for judgment to be 2nd of December 2009. In the mean time, the then President of the Federal Courts of Appeal through-out the federation was to retire on that same 2nd of December 2009. As a result, all the Appeal Court judges gathered in Abuja to honour the out-going Judge thereby affecting the earlier judgment date of 2nd December 2009. But when the Appeal Court resumed after the Abuja event, it quickly fixed the judgment date to be 8th of December 2009 leaving a delay of six days. The same could be applied if eventually 7th of October is declared public holiday.

Meanwhile, as events unfold, I believe that the management will update us. Our attitude on this thread sometimes is not encouraging because if we do not appreciate the efforts of the people giving us useful and valuable information, when we are finally paid and they tell us, we will still doubt them.

@Justino76 you have failed to address the issue affecting the dissmissed case. Why are we talking about 7th Oct when we dont have any case at the supreme court at present, except the application for a restoration of the dissmissed case. We cannot continue to diseminate false information and keep giving patentees false hope. Many patentees have already got their mind on 7th Oct which have been a usual practice when the management already know that there nothing very spectacular about the date. As an investor in CCNL is being my prayer and remain my prayer that Comandclem win the case with Mobil and apparently get all the due royalties paid by Mobil. However, I cannot but see things with an objective eyes despite the fact that I want a return from my investment. CCNL are not very sincere with the patentees you and I know that if something is not urgently done to step up our approach to this legal battle it will continue to linger untill it ends up as a mere academic exercise.

@umehemeka, I want to say without mincing words that nobody is disseminating any false information and patentees hope are not raised falsly. Let me categorically say this one more time that I am NOT a staff of Comandclem but a patentee just like anybody who invested in Comandclem. The quest for us to get return on our investment should never becloud our sense of reasoning. The question we should ask ourselves is did Comandclem fix the date of hearing of cross appeal for 7th October? Did Justice Walter Samuel Onnoghen on the 5th of May 2014 say that the cross appeal and any other application will be heard on 7th of October 2014? Did Comandclem authorize its former Counsel Dr. Tony Ukam to withdraw the case against Mobil but have been pursuing the case religiously? Will it not amount to foolhardiness on the part of Comandclem to authorize withdrawal and in turn be going to the Supreme Court for three years? If the above questions are answered, we should understand that Comandclem as a company needs the money more than the patentees. I am not speaking for Comandclem but for myself as a patentee. I have been at the Supreme Court on four occasions the case came up in Abuja. It is because of the stake I have in Comandclem that makes me to go to any length to seek information even if it means I should be at the Supreme Court. I have read a lot of literatures that border on invention, intellectual properties and their like. I as a patentee will rise against Comandclem when our royalties are paid and we are told stories. For now, we should give Comandclem benefit of doubt and support it to fight our common enemy, Mobil. I am not interested in working in Comandclem. My return on investment should be enough for me when collected. We should not be pessimists. Let us be optimists for once. It is high time we tell ourselves home truth. Even if people are inciting us against the company, we should ask ourselves what our benefits would be if we take up arms against them now.
