Even the constitution have no answers to ur question that's why the judge in charge says status quo should be maintained untill deliberations. Almost everything about our constitution is ambigious, at times i dont blame our politicians for their rascality just like the ekiti saga now, i blame the past rulers and the framers of the constitution whom make section dabbling for their selfish ends.

None of the folks screaming here has looked at what the law says about decamping, or about the powers of the Nigerian Police force people are just frothing at the mouth.

I'm not interested in who we perceive to be right or wrong here, i am interested in what the law says

1. Is Tambuwal legally still a member of the HOR
2. Are the Police force allowed to tear gas members of the HOR?

No one here has answered these two very simple questions, we are busying abusing APC and PDP...

The Honourable Speaker of the House of Representatives of the Federal Republic of Nigeria is presently presiding inside the house.

The clueless slowpoke Jonathan failed again as usual.

Tambuwal has proven to be a hero.
He was taken into the HoR by other members-PDP and APC, David Mark walked with him into the house in Solidarity.

Jonathan must lose in 2015 oooooo.NO OTHER WAY.Even if heaven falls when he loses,it will fall on him too.

Mr man,your thought lacks objectivity.So in your constitution,the pdp members are supposed to be allowed in while the apc members are locked out right? Tell me what I don't know.
section 68 of the nigerian constitution, state that a member of the senate or of the house of representative shall vacate his seat in the house of which he is a member, "g" if being a person whose election to the house was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that house was elected.

there you can see clearly that your Tambuwal don't have right to attain a meeting or any sitting, except being invited as a guest. he lost his seat right from the day he decamped.

Since folks have been too lazy to dig up stuff for themselves, here is the part of the Constitution of the FRN that pertains to the Tambuwal scenario

Chapter V
The Legislature
Part I

National Assembly

68. (1) A member of the Senate or of the House of Representatives shall vacate his seat in the House of which he is a member if -
(a) he becomes a member of another legislative house.

(b) any other circumstances arise that, if he were not a member of the Senate or the House of Representatives, would cause him to be disqualified for election as a member;

(c) he ceases to be a citizen of Nigeria;

(d) he becomes President, Vice-President, Governor, Deputy Governor or a Minister of the Government of the Federation or a Commissioner of the Government of a State or a Special Adviser.

(e) save as otherwise prescribed by this Constitution, he becomes a member of a commission or other body established by this Constitution or by any other law.

(f) without just cause he is absent from meetings of the House of which he is a member for a period amounting in the aggregate to more than one-third of the total number of days during which the House meets in any one year;

(g) being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected;

Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored; or

(h) the President of the Senate or, as the case may be, the Speaker of the House of Representatives receives a certificate under the hand of the Chairman of the Independent National Electoral Commission stating that the provisions of section 69 of this Constitution have been complied with in respect of the recall of that member.

Now, the question is "Is PDP divided?" Remember that in the nPDP vs PDP scenario, a previous court ruling had ruled that PDP was not divided.

Tambuwal's best bet would been to allow the court explicitly state his case (even though its clear from above) AND not try to preside over the HOR. He pushed his luck too far...

The members of the house elected him as speaker not the president. If he decamps to another party why not allow the same members that elected him remove him as speaker and elect someone else?

This is a case of the mourner crying more than the bereaved.

Is it the President that will now do the work of members of the lower house for them? Why not allow the rep members to remove him themselves? The best he could have done was lobby the PDP members to start impeachment proceedings against him. But he knows even the PDP members are not happy with him, especially many of them from the north.

Laughable. The PDP, out of sheer 2015 desperation, now acting in an intolerantly despicable and dictatorial manner that will only see even its most staunch allies begin to sympathise with and support APC. When the speaker has not been formally and authoritatively declared to have lost his position, how can he be tear-gassed like a common criminal?

At this time when Nigeria is alarmingly and dangerously divided, these sort of directly incendiary and antagonistic actions from the PDP are not what we need ahead of a general election that is itself going to be 'war'. Politicians have been warned to check their ambition and not plunge the nation in chaos. Certainly some folks are too power-drunk to listen as was the case before the civil war.

My brother, I am just a concerned citizen. The future of our once great nation is at stake, yet others are allowing political divisions based on fact-less sentiments cloud their reasoning ability. This is what acute poverty does to a nation, citizens begin to expect less from leaders, instead of questioning morality and integrity they question the motive of the other side. A ruling party that has ruled for more than 10 years with countless allegations on its neck and zero score card in core areas of our national development (the real growth drivers= energy sector, public infrastructure, health, education, security) Shouldn't be preventing the rise of the opposition, but instead see it as a wake up call to reinvent themselves. In our long history, this is the first time I see citizens asking the wrong questions on issues that affect our collective destiny.

If our once proud and brave Nigerian Army can be taken to the cleaners by a rag tag rebel group to the extent of conceding villages and towns to them, questions should be asked about the leadership of the military and their political leadership, their finances and weaponry, how funds channel there are spent, information leakages and sabotage. The idea of blaming the issues of the nation on the opposition is just another way politicians use our ethnic and religion divid to confuse us on issues of national important.

Any person or leader who can't do his core job without blaming it on others should just step down peacefully. These guys make Abacha look like an Einstein

I think some people are trying to sabotage the President and paint him in bad light.

What is happening is extremely awful! OBJ never did anything this close despite the fact that there were several attempts at impeaching him.

I smell a script being played out. More like a set up.

The President has to be careful at this time especially with his so-called supporters/handlers from the north.

I just knew this! I knew some pathetic GEJ supporters will still find a way of blaming his "enemies" for this.

This is a right move.

Is he still the speaker of the House? NO

He got Speaker's post because PDP was and is still the majority in the House. Now that he has pitched his tent with APC which has minority in the House, the right thing to do is to relinquish his position immediately he decamped.

I don't know why some people want to create unnecessary attention.

You can't eat your 'gworo kola' and have it back!
You are obviously a mo r o n. So has he been impeached? So who is the speaker?
