ehie:Y most loans go bad in banks is mainly due to non diligence either on the part of the Bank, the creditor in qualifying their risk asset or the debtor via a number of means. Now if yhu read OP's statement, yhu will observe that the said bank refused the initial principal sum claiming that OP's folks should instead pay the interest, which going by its increasing rate will take another Paris Club meeting to liquidate. So yhu can't entirely blame OP's folks for not attempting to pay. The loan appears to be structured which means the bank "diligently" found the collateral satisfactory BEFORE granting the facility. Anything other than that should be tied to the customer's account. Knowing how Banks in Nigeria are credit shy, I can almost assert that bad loans are done in active connaivance with Bank management. |

I so don't know why I don't believe this. SARS ( state ANTI ROBBERY squard ) does not handle financial dealings there's the state CID and the EFCC more so the case in hand does not imply your mum to be from the underworld to warrant sars breaking into your house without a warrant. Meanwhile your mum is not arrested on felony charges so its a bailable offence highest they will cease her papers to avoid fleeing and order her to remain in the state with ur family member as surety. Some time we just refuse to read that's why we don't see answers to all our questions around us. And you say the deal is with a bank yeah wasn't there some sought of agreement that was reache? Its an entity that is ment to be carefull with money so that u claim that the bank is being unconstitutionally aggressive its either its not a bank or your family isn't telling the truth. That your family is still is unwilling to let go of worldly materials to secure you mums safety just means you aren't ready to solve your problems. If you value your mum and truely her case is that of defrauding a bank sell off the assest payoff your debts save your mums life and pride, pick up the pieces and get back on the horse. It's saddening when people trust their bank to keep their hard - earned money & in the process of the bank intermediating between depositors & borrowers they get stuck cos of unscrupulous debtors like the one the op is talking about. Jesus ur mum dey arm robbery cell, sth tells me urs dad shld ve presented himself n save d poor woman this pain. A lot is invoved here 7m u need to raise part of d money n get a surety to sign d bail bond and ur mum will b freed. Anything short of this plus a sound lawyer will lead to ur mum spending many weeks there. Right now d woman is in d same cell with female arm robbers, suicide bombers, killer etc pathetic. For nw someone shld visit her daily with food and water dt ll help her n explain to her dt u guys r making efforts to bring her out dt shld give her hope |

One got arrested and in jail for borrowing money from the bank, people owe millions of pounds here in the UK and still sue banks for harrasing them just for demanding for the money in fact the bank manager has no right to jail any one he is just a staff, just like the cleaner in the bank |

I have got some contacts from some NLDers here and those who feel like helping out. It's ok now atleast for those that are getting involved from now on, they will see how open the case is. The manager has taken a wrong step by using SARS instead of police department. He believed that through SARS, the seriousness of the bank will be noted but it has already been done. My father is doing his best. A Police commissioner has stepped into the matter now. All I see now is that our not having been able to pay the money has not been good but the department contacted by the bank manager for the arrest was wrong and it is affecting people's insinuations as to whether there is more to this case than this plain details I gave here but it's ok. My mom is fine. |

Ariel20:My dear, u dnt write things like dis online, u need to understand that all over d world, people approach banks for credit and govt encourage people to take credits frm banks to help d economy grow. Mind u, most debts that are defaulted or non performing are usually prepared and send to govt who waive taxes for dis banks to cover such non performing loans. If what the OP says is true, then the bank manager is just trying to flex muscles over nothing just to intimidate his family. Remember when list of bank debtors where published during merger, alot of respected Nigerians where indicted and non of the Non performing loan where recovered, because after AMCON investigated and find out that those loan received where really not performing, the CBN had to step in and write d loan off as bad debt. The OP simply needs to man up and take a step to show he knows his right..So dnt say banker lose their jobs because of loan issued to customers, because that's a big LIE...Bank will rather sack an employee for not bring a customer to take a loan than sack someone for a non performing loan which is obvious this is d case here. So pls be guided in ur comments |

U said its like 3 years so dat is classified "loss" according to cbn prudential guidline. Wat d bank do here is to appoint a recovery agent to act on dia behalf to recover d bad loan. 2.8Million s still on a low side to warrant all dis swat action in ur dads compound! D revovery agent stand to get 10% frm d revovery. Ur family can get a good lawyer to sue on dat action. Frm my experience as a credit risk officer in my bank, wat i'll advice ur dad do is his lawyer should write to d bank for concession or restructure of d loan. His lawyer shld plead dat bizness is bad dats why ur mum cldnt repay d loan. Dat d bank should give concession or waiver of paying just d 2.8M. D resultant 7M is as a result of debit interest accruals/accumulation frm d point d account went into debit. In banking accounting principle,everyday ur account goes into debit dia is debit interest against it so its unhealthy! So ur dads lawyer sld plead to cancel all d accumulated debit interest and interest element tide to d loan and just pay only d principal loan. Ur dads lawyer shld beg d bank to stop interest on d account so dat ur dad can effect credit swings. All dis plea above is done/granted by all banks, dey will approve ur dads plea. After all these, d bank will invite or write ur dad on d restructure/concession. Ur dad shld promise on a monthly payment or lump payment till he settles everyting. If u guys have money just settle it onze and for all....except ur mum/dad did sometin more atrouciouse, because i wonder why SARS will bé involved to d extent of jumping d fence into ur compound to make arrest.Sorry dear take hearth. The bank don buy market naaa! Was SARS involved when the loan was being obtained? Or did they find anything criminal with the loan given your parents? Let your lawyer sue the bank and claim N20Bn for unlawful breaking and harassment ...that will teach them a lesson ![]() BTW ...is this a conventional Nigerian bank or one of those Micro-finance Institutions? The MF are known for this sort of behavior a conventional Nigerian bank will not behave in such a way. Please name the bank so we can help out! |

StoneColdBiceps:. I strongly believe the parents did not cooperate with the bank and the recovery agent. I also believ there are still part of this story lurking somewhere we are not aware of. Banks take a long time and patience b4 it gets to this level. Even for collateral realisation, all other options wld hav been evaluated. Pls let ur dad request for Full and Final Settlement. Pay the original loan amount and add part of the interest. They will accept it and write off the remaining. But you must present sth tangible in ur negotiation since ur collateral is also in their custody. Next time, pls always be open to ur bank on any issues affecting u. They will more than willingly extend, restructure or refinance u. Sorry abt this whole thing. |

U don't have to panic.......ur family can hit a jackpot 4rm dis situation..........all u nid to do is to get a better Lawyer to commence breach of fundamental human rigth procedence against the Bank, the police, the manager and any other person that was instrumental to molesting ur mother......fundamental human rigth procedece can be commence at the federal high or the state high court, don't reach any compromise wit de. By the time u finish wit dem dey won't be talkin abt the loan again but how mch to to pay ur mother........I wish I was in Anambra state. |

Hmm, union bank isnt know for such. I was expecting UBA. The truth is dt ur dad allowed this to degenerate. He did not keep to his own terms and was not willing to keep to it. I believe the bank must have called him for several meetings in which he didnt keep up to the terms. Anyway, u shld get ready. I recommend Barr. Obi Anazoba (san ) for such a case as this. The man is huge in built. Once he steps in, he will start raking those ppl and they will do the needful immediately, and guess what? lawyers like bank cases cos money must drop. His office is sumwhere in new market road, onitsha,. get to hollywood and ask other lawyers where exactly obi anazoba's office is. he is an onitsha man . |
