The All Progressives Congress and its presidential candidate, Maj.-Gen. Muhammadu Buhari, have opposed the orders of a Federal High Court in Abuja, directing that they be served through substituted means‎ in a suit challenging Buhari’s eligibility to stand for the March 28 poll.

Justice Adeniyi Ademola had, in two separate suits challenging Buhari’s eligibility to contest in the election, last week granted ex parte orders permitting the plaintiffs to serve the defendants in the suits through newspaper publications.

The court had also granted an order of abridgment of time within which the defendants must respond to the suits.

The plaintiffs in the separate suits are Chukwunweike Okafor and Max Ozoaka. They were represented in court by their lawyers on Monday.

Apart from Buhari and the APC, the Independent National Electoral Commission is a defendant in the two suits.

On Monday, Buhari and his party, through their lawyers, told the court that they would file applications challenging the competence of the suits and the entire steps taken in the suit so far, including the orders of service through substituted means.

Though, both Buhari and the APC had yet to file any papers in the suit, their lawyers – Chief Wole Olanipekun and Lateef Fagbemi – urged the court to adjourn the matter to enable them to file all the necessary documents.

Fagbemi also urged the court to ‎set aside the order of abridgment of time within which the defendants must file their responses, arguing that the granting of the order hinged on urgency, had already been diminished with the postponement of the poll from February 14 to March 28.

The judge then adjourned till February 23.

There are at least three other suits ‎seeking an order directing INEC to disqualify Buhari from participating in the poll because he among other things, failed to attach evidence of his academic qualifications to the form he submitted to the electoral body.

‎The plaintiffs are in their separate suits contending that the INEC FORM CF 001 submitted to INEC by the APC candidate submitted to INEC was incomplete and therefore urged the court to declare the form as incompetent.

They further stated that the failure of Buhari to accompany the INEC Form with evidence of his educational qualifications and evidence of his birth certificate or affidavit of declaration of age had altogether rendered the form inchoate.

Ozoaka, in a supporting affidavit to the originating summons, stated that the INEC Form submitted by Buhari did not meet the requirements under sections 31(1)(2) & (3), and 31(cool of the Electoral Act 2010 (as amended).

In the same vein, do you expect his lawyers not to fight these or not to equally utilise any other technicalities available to them in order to defend their client - so as to make you and PDP happy?

Don't you think that GEJ and PDP already know that GMB is qualified for election; but rather than take him to court themselves, they are instead sponsoring individuals to carry out their dirty bidding by proxy; knowing they don't stand a chance in hell of getting the courts to disqualify him but simply just to cause distraction.

FYI, the constitution does not even require anyone seeking for elective office to earn/own/ possess or even submit a certificate in order to be eligible.
It rather required for that person to be educated to a minimum of school certificate LEVEL or its EQUIVALENT - (key words here being level and equivalent, not certicate - as many mofos are brainwashed to believe).

It also went further to explain what it meant by equivalent (see attached copy below).

Note, sub-section c(iii) only required a person to be literate (i.e. an ability to read and write) and to be able to communicate effectively; the interpretation of which along with sub-section d is furthermore entirely left at the discretion of the electoral body (INEC).

Accordingly, INEC had already deemed Buhari fit to stand for election so it is difficult to see how anyone can overturn such constitutional decision - except to just waste ppl's time.

GEJ is a heartless freak and so I wouldn't doubt your assertions but if that's the plan the whole world will see it and I'm sure the little supporter base he has down south will be reduced the more .

The postponement of the election already lost him some so making that move will be bad market. But like I said d guy is heartless and he might just be tempted to make that move. I really pity for my northern brothers and sisters whose life has become an experiment.

Why is buhari and his supporters afraid to prove the candidate eligibility in court? This is a shame of the highest order. He should have been proud to go to court and prove skeptics wrong.
Buhari is an arrogant person, have no respect for the rule of law. Avoiding being served by court is tantamount to a guilty conscience pleading silence, to avoid self incrimination.

How about GEJ 21 billion gathered for presidential campaign? That was just enough for INEC to disqualify him. Let the election hold, let Nigerians choose who they prefer as President. If the court stops either GMB or GEJ there will be terrible consequences! We need to be very careful!
