I do not know how the penal code works. But a better approach would have been to sue in a civil action and claim damages for breach. Proof in criminal cases are more stringent while in a civil matter it could be grounded on balance of probability. Besides, the guy should contest jurisdiction except it is really a codified offence in the penal code. At any rate, in criminal matters, the fine payable belongs to the state as against what would be the case in a civil matter. But as i said, i dont quite have a grip on the penal code.

All said and done, the man was an imp and the lady was a dummy. The courts only give judgment but not peace of mind. She will never be truly married to that man irrespective of the court's decision.

With a good lawyer this case won't succeed, otherwise all the baby mamas in Nigeria would be rushing to court.

in some countries that woman is entitled to compensation. I believe it is right if he was making some money at the time they were together to compensate her. And it will serve as a deterrent to other guys not to lie to and live with girls in their houses when they have no marriage intentions.

Except in the US. American contract law/(CA civil code) provides no remedy for a heart-broken boyfriend or girlfriend that has been dumped.

Try Google or read the case of Sowande v Sowande and if you can get ur hands on the Nigerian evidence act, read Section 197. The guy would pay damages but d court can't force him to marry her. Its just that it is very hard to prove because there must be someone to corroborate the fact that he made a promise to marry her.

You are starting to mix issues. You mentioned that her case is breach of promise of marry, now you are talking about presumption of marriage under common law. If there is a presumption of marriage, then there cant be a breach of promise to marry again since the marriage is already presumed by law.

If you go by S.197 of the current Evidence act, breach of promise to marry expressly needs corroboration. If that is the case she is setting up in court she can't succeed without it. There are also judicial authorities to that effect. It is not a matter of opinion, it is express in d statute.

That is still not an excuse. There is no guarantee that he wouldn't have acted otherwise if they were married. Heck! Some husbands have done worse things to their wives despite the bond between them. Therefore regardless of what she did or did not do, it is no excuse for the man to act inhumanely.

She won't win! She can't win! The only thing the court can do is to ask the guy to start paying child support. And that is if the guy does not contest the pregnancy. If he denies the pregnancy, the court will have to rely on a DNA test to pass judgement in the woman's favour.
