So she should sue for criminal breach of trust which will in any case not get her judgment in specific performance but only in penal damages which again as i said before will neither get the man back nor even damages as it will revert to the state. I should defend that guy.

You can force a horse to the stream but you can't force it to drink the water from the stream. The court can't impose the lady on the man afterall its a personal matter and at the first instance shouldn't have gotten to law court. The man in question must have observe some inefficiencies in the lady and quietly and peacefully left. Otherwise, the relationship wouldn't had turned sour. But the man considering the condition of the lady shouldn't had abandoned her even when she's carrying his unborn child no matter what. Ladies no matter hw a guy loves you, try hold yourself till he pays ur bride price.

This evidence will be torn to shreds by a young wig under cross examination. She will consistently contradict herself and will be treated as a witness of untruth. The guy should even bring her character into issue and mess her up thoroughly in the public court. I will even pay an area boy that will testify to have been sleeping with her.

Like one poster rightly said, cases and suits on breach of promise of marriage otherwise called heart balm or breach of contract to marry hardly find support by the court this days. Especially in common law countries, where such has been abolished.

It used to be as a result of the fact that denial of the woman's expectation was a concern and also damage of the woman's reputation and marriage chances was important. But with civilisation such is no longer the case.

The requirement for such case to succeed include firstly a prove that such promise was expressly and verbally made. Such promise must also be corroborated by evidence of one who was present when the promise was made.

Secondly the lady must have acted and furnished considerations based on such promise. Such consideration may include rendering matrimonial duties and assisting the man with the mindset that she will become his wife.

Also there must have been an engagement of the lady in question

In conclusion with the abolishment of such claims, such case as this will not hold water.

It's like when you promise your wife that you will give her a car as a gift if she can give you a baby boy.

If you choose not to buy her the car after giving birth to a baby boy is a mere domestic agreement and cannot be valid in a court of law

I just made a research of this criminal code and the application into marriage is simple and this is important to understand,If you are a man who leaves your marriage non-cons-equally to marry or impregnate another woman then the woman you marry as well as you can be charged by your legal wife with an offense under this code except the man properly divorced his formal wife or can prove that she was the one who left the marriage.

As a lady who also leaves her marriage non-cons-equally to move in,get pregnant or marry another guy without properly divorcing the former husband,both the lady and the man she is with can be charged under the penal code.

This is why i always advice a man or woman who leaves his or her marriage especially legal wedding for any reason to make sure a proper divorce is done before hooking up at all with another man or woman or you must have strong evidence that it was actually the other person who left you without mutual consent.

My concern is not about the marriage but the fact that he would be compelled to take resposibility to a certain extent.
I like that the woman will not go through this alone.
