The same scenario apply here. The father is NCC and the son is MTN. The penalty of 20 lashes can be liken to N1.3 trillion naira. |

The Nigerian Communications Commission (NCC), in a late March report of its Compliance Monitoring Enforcement, published on its website, restated its commitment to monitor all significant matters relating to the performance of all licensed telecoms service providers as specified in Section 89 of the Nigerian Communication Act 2003. In an end of 2014 report, the Department listed six enforcement items on which the Commission gave approval for implementation. They include SIM registration, frequency interference, illegal operation, promotion and lottery, telephone billing, and cybercafé operation. Consequently, interference on Nigerian Liquefied Natural Gas Ltd, (NLNGL), and assigned radio frequency was traced to a microwave link deployed by INTELS Nigeria Limited. The Commission therefore directed INTELS to shut down the offending equipment failing which appropriate action would be considered against the Company. INTELS is an integrated logistics solution provider based in the Port Harcourt area and it is common knowledge that it owned by Atiku Abubakar, a former Vice President of Nigeria. NLNGL also operates in the Port Harcourt and Bonny axis for its major operations. Part II Monitoring and reporting 89. – (1) The Commission shall monitor all significant matters relating to the performance of all licensees and publish annual reports thereon at the end of each financial year of the Commission. (2) In performing its functions under subsection (1) of this section, the Commission shall – use any of its powers under this Chapter and in particular but without limitation, its powers of investigation and information-gathering pursuant to Parts III and IV of this Chapter; and have regard to such industry performance indicators as the Commission considers appropriate. (3) Matters upon which the Commission shall monitor and report include but are not limited to the following - the operation and administration of this Act and its subsidiary legislation; the efficiency in which licensees provide facilities and services; the quality of services; industry statistics generally including but not limited to service provisioning, traffic patterns, industry operators, etc; the tariff rates and charges paid by consumers for services; the development of industry self-regulation; the adequacy and availability of services in all parts of Nigeria; any deficiencies in the scope or operation of this Act and its subsidiary legislation; and other matters that the Commission is satisfied are relevant. (4) The Commission shall publish the report, in the manner it deems appropriate, provided that it is made publicly available. Nigerian Communications Commission, NCC, yesterday ordered all Global System for Mobile Communication, GSM, operators to deactivate all pre-registered SIM cards within seven days or face severe sanctions. The directive was part of decisions taken at a meeting in Abuja between Office of the National Security Adviser, NSA, Department of State Services, DSS, network operators and NCC. The directive was part of government’s efforts to tackle incessant occurrences of threats via telecommunications networks and the danger they portend for the psyche of the citizenry and the country. A statement by NCC’s Director, Public Affairs, Mr. Tony Ojobo, indicated that the meeting took into cognizance crimes committed against members of the public either by kidnappers, terrorists, robbers and threats to lives through the use of such unregistered SIM cards across all the networks. The SIM cards to be deactivated include all SIM cards without or improperly captured facial pictures and or finger-prints. Affected subscribers are to be notified to regularize their registrations. Ojobo clarified further that henceforth, all registrations must conform to the data dictionary, technical specifications on finger prints, facial images and the business rule agreed by all stakeholders. runzlord:it's not in Nigeria constitution per say. each industry has a regulatory commission that regulate them and it's back up by an act. read this act on sim card registration. it's contained in pdf document below go to paragraph 4 part 4 |

As far as I am concerned this OP is the standard definition of troll. So of all the articles explaining why MTN is being fined the only thing you could pick up is that MTN is being fined because it is a South African company? Such crap! MTN as a signatory understood the ramifications of failing but your rise to their defense is based on how unfair it is, what utter rubbish! |

@OP, there was a treaty! All the Telecoms companies signed it. MTN broke an agreement they signed, why should they not pay? You are mixing things up here! They were aware of the amount involved before they signed and as well broke the law. You coming here to say the fine levied on them is heavy is unjustified! A RULE IS A RULE. |

I thought so too until I borrowed #500 from mtn yesterday and they removed it without me making a single call. All efforts to reach their yeye customer care was zero. |

Nsonaso:Guy think before you talk. MTN and all Telcos accepted the fine on defaulters a year ago, N200,000 per an unregistered line. They deserve all they've gotten, if they think otherwise let them go to court and see if the fine won't increase. Mtn is too greedy to let go those lines cos of d meager gain, now they're paying for their sins. Have you ever thought of why they are being instead of defending themselves? ![]() |

Funny thing is that it's mtn that made this news public precisely to manipulate and coerce NCC. As it is its likely others got fines, but obviously much lower as they didn't have as many lines contravening the law and they have wisely chosen to keep quiet about it. So far all the arguments being put up have been sentimental. Unfortunately sentiment will do u no good. I'm very sure they could have negotiated this fine quietly and gotten away with much lower. But in the same attitude that they have put up for years they decided to be arrogant. Anyway like I've said, if u think it's unfair, help them to pay it. By the time 1 million Nigerians contribute 500 naira each, e go reach somewhere. Since you are so concerned about them. Na una type dey drink for bar finish come dey contest the price of the beer |
