Dear VO,

My wife will be about 20 weeks pregnant when attending her interview and her stomach is already bulging. The holiday plan is for her and my son to spend 21 days with family friends in Maryland then return to Nigeria. But she wants to use the holiday period to choose a hospital and doctor so that she could return later to have our next baby there. She has grown scared of Nigerian hospitals as she nearly lost her life during delivery of our first son in one of the top and popular hospitals in Lagos State. This also prompted us to change hospitals to another top hospital in Lagos Island but I am afraid that we are still not completely satisfied with the medical services despite their huge bills. As a result of this phobia for Nigerian hospitals, she is determined to have our next baby in the US where she can get better medical attention.

My question is that during the interview should she categorically state that:
1. She is travelling to have her baby since she is going for holidays (using the opportunity to personally search for medical care that suits her) and would return later to have a baby in the US?
2. She is going for holidays with a high chance of going back to have her baby in the US?
3. She is just going for holidays since this is the reason for the immediate travel?

Or would you advise she tries to get in touch with a medical practitioner first before travelling?

Thank you in advance for your usual prompt responses.

Hello danowena,

If your wife is currently pregnant she will need to bring some additional documentation to the interview. Pregnant woman often undergo additional questioning at the port of entry in the U.S. They are required to show documentation from the medical center where they will be receiving treatment and proof of sufficient finances to pay for all medical and personal expenses while in the U.S. Because your wife is showing (clearly pregnant) she will need to prove to the officer during the interview that she has a plan for medical treatment in the U.S. (a doctor or hospital that she has been in contact with); she will need to show proof of finances and a provide a detailed budget for the estimated expenses that she will incur during her time in the U.S. Having all of these documents in order will help your wife not only during the visa interview but also if she is granted a visa, it will help her at the port of entry.

Hello VO,

Thank you for the wonderful response above. Coincidentally, I am in a replica situation with my wife's interview scheduled for next week in Lagos. Difference in our story is that my wife and child are planned for Texas. My challenges however are that we just learnt that airlines are reluctant to accommodate pregnant women that are more than 36 weeks gone. This has prompted us to change our plans from holidays to just having a baby. But we already submitted our DS-160 form that indicated she is planned to stay for only 3 weeks with relatives. However, with the change in plans we want to extend it to 4 months stay which is more than adequate for her to deliver. Additionally, I want to make provision for long stay accommodation rather than her staying with relatives who could start behaving very funny towards her later.
Sir, do you suggest we fill another DS-160 form to reflect the immediate changes in length of stay and intended accommodation? Or should we simply tell the interviewer of these changes during the interview?

Dear Abuja NIV team,

Please what could have gone wrong? I attended my interview on 8th December, i was denied base on flimsy excuse.

Here is the summary of my interview;

Q1. Why would u like to visit US at this time? I am visiting US to attend my cousin (mentioned his full name) graduation ceremony at Grambling state university and the event is coming up 18th Dec 2015

Q2. What do you for work? I work with xyz bank as bla bla

Q3. How long do you wanna stay in US? Just 2 weeks

Q4. When is your take off date? I will take off Dec 14th and return 28th

Q5. Are you married? Yes, i am happily married

Q6. Do you have kids? I have two lovely daughters

Q7. Why would you like to spend your Xmas with Cousin and leave your family behind? remember Xmas comes once in a year? Then i said myself and family already agreed that i go and return to spend new year here just to honour my cousin invitation.

****Then he handed over a green letter to me and my passport. But before he did, he touched the white and change his mind to the green because i can see inside his cubicle

When is the earliest time i can re-apply as a new year begin and i will be planning on my next year leave early enough?

Hello cleric,

The same answer applies for your situation as well. Plans can change - so the most important part for ALL interviews is to be honest and completely transparent about your purpose of travel. It is best to disclose to the officer immediately that your wife plans to have a baby in the U.S. and NOT to wait until the officer asks if she is expecting.

Dear AbujaNiv,
My wife just gave birth in the U.S Please I will like to know if I can use my b1 b2 visa that will expire in 3months to travel to the U.S please advise.

Thanks.
Hello G4money,

The visa that you have affords you the ability to go to a port of entry in the U.S. until the date of expiration on your visa. It is then the Customs and Border Patrol that will either approve or deny entry into the U.S. and determine how long you can stay.

Hello bmanbaba,

It is imperative for ALL interviews that applicants are honest, clear and transparent with the officers. Documents are not typically reviewed during the interview and the officers rely on the answers to the questions they pose to inform their decisions.

Dear VO,
Thank you for the great job you are doing!
My friend had her baby early and the baby is very sick. I am in the US and have a doctor friend that has agreed to provide treatment until the child is well. I am happy to provide housing and other needs. Would it be worth applying for a medical visa or would it best to try to get a regular visa? If a medical visa is the best option, can you tell me what is needed and if both mom and baby need a visa or just the baby? We are very worried for her and are hopeful that she would be seen soon.
Thank you, again.

Hello VO,

I have a question about the H-1B. Based on the list of documents here, http://www.ustraveldocs.com/ng/ng-niv-typework.asp

The I-129 receipt number is required for the interview to verify the application, but no longer the I-797 receipt.

The link says I must bring "The receipt number printed on your approved I-129 petition."

I'm confused as to whether I just need to have the number handy, which I do, or bring along a copy of the I-129 petition with the receipt number written on top of it. By my understanding, USCIS keeps the original for their records.

Thank you.
