Men cheat and expect forgiveness from thier wives.Women cheat and also expect their husband to forgive them
Almost everybpdy in relationships nowadays are unfaithful.
Unfortunately there is nothing to deter people from cheating on their partners. Some are even proud of the act without any iota of remorse.

While pondering about this level of decadeness, a thought of criminalizing adultery came to mind. The negative consequences of cheating on the spouse, children and the society at large surpass that of already criminalized offences.

Since there are lots of court cases where couples accuse each other of infidelity, I do not see any reason why the cheated partner would not witness against the cheating partner.

Going by religious doctrine, adultery is a very serious offence that is punishable by death. But where is it correctly practised today?
Many people engage in the act because nothing really deters them except their faith. They also believe they would seek God's forgiveness thereby knowingly committing the sin.

Most Muslim countries.

The person has the option of taking the sin of adultery to the grave by not uttering a word of it to a single soul. Or they can put themselves up for death by confessing their sin of adultery.

It's sad that in the cultures where adultery is not criminalised, people just talk about their sin of adultery like it's nothing and this then desensitises people's views and thoughts around adultery this in turn spreads the act like wild fire...

In as much as the goverment has codified marriage into law, they are in a sense, already in. And how does that suggest a theocracy?


@OP, adultery was once widely criminalised. I feel there should at least be some sanctions, and it should be taken int account in dispues/dissolving marriages. In all, I don't see no-fault divorce as progres or an improvement.

Perjury is lying under certain conditions, under oath, in a court of law, wrongful signature of a legal document, etc. Thats hardly the same as uttering the common everyday falsehood, i.e, lying. Cheating is an act of deception/dishonesty, and an extension of that. It's as ridiculous a notion to lock someone up for cheating as it is to throw someone in fetters for breaking a promise or telling a common lie.

As it stands, it is largely irrational and pointless, often a menace to society and strongly biased against female-folk in particular when and if "enforced", and nearly impossible to effectively and fairly enforce in the first place through proof of so-called "innocence" or "guilt" unless "witnesses" are involved. It's nothing short of a dangerous idea.

No fault divorce makes sense from a logical, judicial standpoint.

That aside, I imagine greater than 60% of the entire US population would be incarcerated at some point in their lives. That's maddening, and cartoonish to even contemplate. A clean record wouldn't mean squat anymore 'cuz no one would have one, or know what it looks like grin

Can you imagine someone calling the cops because someone cheated? That's wild. That's what criminalizing an action does. This is some high-level emotional reasoning - it defies logic.

Lol...yh, let's not go there. But maybe then I might avoid getting pulled over for BS reasons like a fog light being out (there's legit this one nice but annoying cop in my neighborhood that always pulls me over for BS "maintenance" reasons and all manner of annoying small-talk DYKs), because all the cops'll be out there working overtime steady cheating duty instead grin

I don't think it is necessary to criminalize adultery because the criminal offences we have already have not stop criminal activities, I as a born again Christian have been taught to forgive but you must be so remorseful about your deed. Any fellow that has lost his or her mind can fall victim of adultery, it is not different from madness and such person seriously need psychiatric help. We have lost every sense of moral upbringing in this generation and it is becoming a case of if you can't beat them, join them. we don't see what is bad in fornication but we don't want adultery, what an irony. any relationship that involves sex (fornication) can also involve infidelity if they are married.
So instead of criminalizing adultery, let's us work on ourselves and be who God wants us to be not who devil wants.

I take your point about the particular use of "perjury" and it's specific conditions. However, it does not change the fact that "lying" is actionable. Fraud, or misrepresentation, or wrongs under "sale of goods" acts are all pursuable in the courts - they are all just legalistic terms for lying.

Likewise, anywhere "lying" has led to demonstrable harm, a case can be made for sanctions. It's morally wrong. Who does not correct their child when they lie, or punish them if they persist in what is obviously immoral/bad behaviour?

Which brings us to the point in question. Adultery is breaking a covenant, or contract - if one wishes to be legalistic. As such it should be actionable. The question is whether in a civil or criminal sense.

Even if it were criminalised based on religious doctrine in some areas, that is not the only reason. Marriage predates religion or law. Sanctions for adultery were due to the negative consequences.

To call it irrational and pointless is emotional. There can be damage to individuals and wider society when adultery is committed. And as marriage is entered to under oath, why should it not be punished?

Firstly, marriage was not initially a legal construct, and should never be legalistically driven. Secondly, it contravenes what marriage does and is for. No one is forced to marry. One can have any form of relationship they desire. Why choose marriage trash it and cry about societal pressure?

And no-fault divorce whilst not appotioning blame, stilll apportions burdens, mostly on men. This matches your cry of adultery unfaurly punishing women.

All in all, I fel adultery should be sanctioned, not least because - not that I agree - there are provisions for ending marriages if one spouse is not satisfied.
