This is not a well thought out question because you are making the wrong assumption that there is any equivalence between a piece of land, its surface structures and the natural resources under that same land. In other words, it is possible for one person to own the land and another person to own what is underneath the land. But if oil is found in that land tomorrow that oil automatically belongs to the federal govt, the owner of the land cannot legally lay claim to the oil even though they are the rightful owners of the land.

You are getting it twisted .. Land Use Act of 1978 only conveys rights of occupancy. The Act vests all land in the hands of governors with the exception of federal govt land. Governors are vested with the power to grant " statutory rights of occupancy" in urban areas while LGAs are granted "customary rights of occupancy " in rural areas.. So even though your village/family/community doesn't have C of O, it's the govt that grants right of occupancy and has the right to appropriate such land for its use..
