kernel501: This is not a well thought out question because you are making the wrong assumption that there is any equivalence between a piece of land, its surface structures and the natural resources under that same land. In other words, it is possible for one person to own the land and another person to own what is underneath the land. For example, according to Nigerian law, a person can buy a piece of land today and have a valid C of O or legal title deed. But if oil is found in that land tomorrow that oil automatically belongs to the federal govt, the owner of the land cannot legally lay claim to the oil even though they are the rightful owners of the land. In other countries the law may be different. Indeed in the US, each state gets to enact its own laws governing the ownership of lands and their natural resources. As a general rule, in the US the owner of a piece of land whether private or government also owns whatever resources lie underneath that land. In some states a different person or institution can claim ownership of oil or other natural resources found at varying depths under the land. So one person can own anything found up to 500 ft below ground and another person can lay claim to what is found between 500 ft and 1,000 ft below ground and so on. 5 Likes |

Though we re all nigerians bided by nigeria constitution.But there is geo diversity and culture that made us know that,this people re called yoruba[their land belongs to them] same go with hausa and igbo. In oda words,under the constitution no tribe should lay claims on another geographical location. The laws say u can leave with in each odas territory. The issues raised are not the same and as such can't be compared. The oil in that region is the resources deposited there by God and according to the law of the land, they belong to the government. The resources in Lagos are not owned by Yorubas, eg the ocean, water even the newly discovered crude oil but they are controlled by the Fed govt. Therefore, Lagos is Yoruba 's land while Niger delta states are owned by the people but the crude oil remain the resources of the govt. 1 Like |

They lease their land and the resource deep inside their land belongs to people that paid for the rights of the resources. It's a concept called eminent domain. The Yorubas own Lagos, but does that mean they own Zenith bank? The owner of the bank leased the land and owns what's on the land and will surely renew the lease when it gets to term. 2 Likes |

quid: When you lease a land and pay for the mineral rights on that land, then what you do with it is yours during the tenure of the lease. The government also has the right to takeover land as they see fit. In the USA, it's called eminent domain rights. So between the local indigenes leasing the lands and/or the government implementing some sort of eminent domain, the rights to oil is relinquished to the lease owner. Some form of compensation can be arranged signed as part of the lease. Anything after the lease agreement is just good will. 2 Likes 1 Share |
